AN ORDINANCE SPECIFYING THE AUTHORIZED
POSITIONS IN THE FIRE DEPARTMENT; PRO-
VIDING A SEVERABILITY CLAUSE; AND NAMING
AN EFFECTIVE DATE.
WHEREAS, in adopting the 1978-79 budget (ordinance
No. 7787) the City Council appropriated funds to cover the an-
ticipated salary and related costs for two (2) Fire Captains,
four (4) Fire Lieutenants, six (6) Fire Engineers, and eighteen
(18) Fire Privates in the Fire Department to staff two planned,
new firehouses (Stations 7 and 13) ; and
WHEREAS, the two planned, new firehouses have not
yet been completed and are not yet ready for staffing and
activation; and
WHEREAS, the City Council intended that the afore-
mentioned positions would not be created nor filled until the
firehouses were completed; and
WHEREAS, a controversy has arisen wherein several
firefighters wish to be promoted to the aforementioned un-
necessary and unauthorized positions; and
WHEREAS, the Council wishes to take action which is
diapositive of the issues involved; NOW, THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
THAT pending completion of new and additional
firehouses, the City Manager's report demonstrating the need
for increased staffing and requesting specified additional
positions in the City of Fort Worth Fire Department, the
following positions are the only positions authorized in the
City of Fort Worth Fire Department for fiscal year 1978-1979:
283 Fire Privates
149 Fire Engineers
81 Fire Lieutenants
60 Fire Captains
18 District Chiefs
3 Deputy Chiefs
36 Civilians
SECTION 2.
THAT all of the declarations and findings contained
in the preamble of this ordinance are made a part hereof and
shall be fully effective as part of the ordained subject matter
of this ordinance.
SECTION 3.
THAT if any section, part of a section or provisions
of any section of this ordinance shall be held to be void, in-
effective or unconstitutional by a court of competent juris-
diction, the holding of such section, part of a section or
provision of any section to be void, ineffective or unconsti-
tutional for any cause whatsoever shall in no way effect the
validity of the remaining sections and provisions of the
ordinance, which shall remain in full force and effect.
SECTION 4.
THAT this ordinance shall become effective and be in
full force and effect from and after the date of its passage
as provided by law, and it is so ordained.
