HomeMy WebLinkAboutResolution 5741-05-2023 (4)A Resolution NO. 5741-05-2023 APPROVING APPLICATION OF EINSTEIN GROUP, LLC FOR AN EMERGENCY MEDICAL SERVICES PROVIDER LICENSE WHEREAS, in 1988, Fort Worth and certain other Tarrant County municipalities came together to create a regional ambulance and emergency medical services ("EMS") agency known as the Area Metropolitan Ambulance Authority, d/b/a Medstar, (the "Authority") through the adoption of a uniform EMS ordinance and interlocal cooperative agreement (the "Agreement") under the provisions of Section 773.051 of the Texas Health and Safety Code and pursuant to Ordinance Number 10094 (the "Ordinance"); WHEREAS, since 2008 and as permitted by the Agreement and the Ordinance, on -site EMS at Texas Motor Speedway ("TMS") have been provided by Einstein Group, LLC d/b/a Overwatch Global Services d/b/a Speedway EMS ("Speedway EMS") while ambulance transport off of TMS property has been provided by the Authority; WHEREAS, to provide EMS exclusively on TMS property, the Agreement and Ordinance do not require permitting, but Speedway EMS must hold a license with the Texas Department of State Health Services; WHEREAS, Speedway EMS' license has expired and Speedway EMS must apply for a new license to continue to provide EMS at TMS; WHEREAS, in 2013, the Texas Legislature passed section 773.0573 of the Texas Health and Safety Code, which requires that any applicant for an EMS provider license obtain a letter of approval from the governing body of the municipality in which the applicant is located; and WHEREAS, section 773.0573 also requires that the governing body make certain determinations before issuing a letter of approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: Pursuant to the requirements in section 773.0573 of the Texas Health and Safety Code, the City Council hereby makes the following determinations: 1. The addition of another licensed EMS provider will not interfere with or adversely affect the provision of emergency medical services by the licensed EMS providers operating in the City; 2. The addition of another licensed EMS provider will remedy an existing provider shortage that cannot be resolved through the use of the licensed EMS providers operating in the City; 3. The addition of another licensed EMS provider will not cause an oversupply of licensed EMS providers in the City; and 4. The application for an EMS provider license by Speedway EMS is approved.
