HomeMy WebLinkAboutOrdinance 17242-10-2006ORDINANCE NO. 17242-10-2046 AN ORDINANCE VACATING AND EXTINGUISIiING A PORTION OF AN UNNAMED STREET RTGTTT-OF-WAY STTUATED TN THE ,IUD ROWLAND SURVEY, ABSTRACT NUMBER 1355, CITY OF FORT WORTI3, TEXAS, APPROXIMATELY 50 FEET BY 224 FEET, AND CONTAINING APPROXTMATELY 13,352 SQUARE FEET, AS RECORDED IN VOLUME 3337, PAGE 224 OF TTIE DEED RECORDS OF TARRANT COUNTY TEXAS, PROVTDING FOR THE REVERSION OF FEE TN SAID LAND; TIIE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVI+ DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of an unnamed street right-a£ way situated in the .lud Rowland Survey Abstract Nunabex 1355, as recorded in volume 3337, Page 224 of the deed retards of Tarrant County, approximately 50 feet by 220 feet and, and containing 13,352 square feet, as more specifically described an Exhibits "A", "B" and "C" attached hereto and incorporated herein by reference, be and the sazx~e is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street and alley rights-of--way is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTT®N 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTI®N ~. That this ordinance shall take effect upon adoption and publication as required by law. Adopt an ordinance vacating an unnamed street right-of-way approximately 50 feet by 220 feet in the Jud Rowland Survey, Abstract Number 1355, City of Fort Worth, Tarrant County, Texas, being a portion of that certain tract of land described in Deed to the Public, recorded in Vnlume 3337, Page 224, D.R.T.C.T. containing approximately 0.307 acre (13,352 square feet}; and 2. Waive the purchase fee of $42,686.34. ®ISCUSSION: Doug J. Woodson of Fort Worth, Texas, representing Hickman Investments, Inc., has requested vacation of the above referenced unimproved street right-af-way to provide for the development of the Clifford Retail Center. Reviewing City Departments and public utility companies have identified no recorded ar existing utilities in this right-of-way and have raised no objection to this request. The City Plan Commission at its meeting of June 28, 2006, recommended vacation of the street right-of-way. An acceptable plat (FP-06- 091 }has been received. The Engineering Department, Real Property Management Division, has established the fair market value of $42,686.34. Real Property Management Division has determined that the right-af-way was dedicated to the City via separate instrument. Staff recommends waiver of the purchase price. The right-of-way was dedicated and there is nv evidence that public funds were expended far the acquisition or any improvements.
