AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF E.
DASHWOOD STREET, AN ALLEY, AND A PORTION OF PULASKI
STREET, EACH SITUATED IN THE FRANKLIN RICHARDS SURVEY,
ABSTRACT NO. 1297, CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, THE PORTION OF E. DASHWOOD STREET AND THE ALLEY
LOCATED WITHIN BLOCK 1, SHLATERS SUBDIVISION, AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS, ACCORDING TO THE PLAT THEREOF, RECORDED IN
VOLUME 63, PAGE 143 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS, CONTAINING APPROXIMATELY .088 and .151
ACRES OF LAND RESPECTIVELY; THE PORTION OF PULASKI
STREET LOCATED WITHIN BLOCK 3, EVANS SOUTH ADDITION, AN
UNRECORDED ADDITION TO THE CITY OF FORT WORTH,
ACCORDING TO THE PLAT THEREOF, RECORDED IN CABINET A,
SLIDE 12103, PLAT RECORDS, TARRANT COUNTY, TEXAS AND
CONTAINING APPROXIMATELY .196 ACRES OF LAND; PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of that certain called Schlater Street, now known as E. Dashwood Street, a
sixty -foot -wide public right of way, situated in the Franklin Richards Survey, Abstract
No. 1297, City of Fort Worth, Tarrant County, Texas, Block 1, Schlaters Subdivision, an
addition to the City of Fort Worth, Tarrant County, Texas, according to the plat thereof
recorded in Volume 63, Page 143 of the Plat Records of Tarrant County, Texas, and
containing approximately 0.088 acres of land more or less, and as more specifically
described in Exhibit "A" and "B" attached hereto and incorporated herein by reference be

and the same is vacated and extinguished.
2. That a sixteen foot wide alley situated in the Franklin Richards Survey, Abstract Number
1297, City of Fort Worth, Tarrant County, Texas, Block 1, Schlaters Subdivision, an
addition to the City of Fort Worth, according to the plat thereof, recorded in Volume 63,
Page 143, Plat Records, Tarrant County, Texas, and containing approximately 0.151 acres
of land more or less, and as more specifically described in Exhibits "A" and `B" attached
hereto and incorporated herein by reference be and the same is vacated and extinguished.
3. That a portion of that called Pulaski Street, a five-foot by five-foot right-of-way, situated
in the Franklin Richards Survey, Abstract Number 1297, City of Fort Worth, Tarrant
County, Texas, Block 3, Evans South Addition, an unrecorded addition to the City of Fort
Worth, according to the plat thereof, recorded in Cabinet A, Slide 12103, Plat Records,
Tarrant County, Texas, and containing approximately 0.196 acres of land more or less,
and as more specifically described in Exhibits "A" and "B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easements to the land in the above -described vacated street and alleys rights of
way are hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
0.088 ACRES
BEING all that certain lot, tract, or parcel of land, situated in the Franklin Richards Survey, Abstract
Number 1297, City of Fort Worth, Tarrant County, Texas, and being part of that certain called Schlater
Street, now known E. Dashwood Street (60' right-of-way), as platted on Schlaters Subdivision, an
addition to the City of Forth Worth, according to the plat thereof, recorded in Volume 63, Page 143, Plat
Records, Tarrant County, Texas, and being more particularly described as follows:
BEGINNING at a TxDOT aluminum monument found, at the northwest corner of the herein described
tract of land, same being the southwest corner of Lot 9, Block 1, of said Schlaters plat, and being in the
north line of East Dashwood Street (60' right-of-way);
THENCE N 89°01'OS" E, with the north line of said E. Dashwood street, and the south line of said Lot 9,
passing at a distance of 98.80 feet, a 1/2" capped rebar found at the southeast corner thereof, being the
southwest corner off a 16' alley of said Schlaters plat, continuing with the south line thereof, passing at
a distance of 114.80 feet a 3/8" rebar found at the southeast corner thereof, and being the southwest
corner of Lot 8, Block 1, of said Schlaters plat, continuing with the south line thereof, a total distance of
239.39 feet to a 1/2" rebar found at the southeast corner thereof, and being on the west line of

be Replatted with the Adjoining Property for a Mixed -Use Development in the Evans and Rosedale Urban Village to be Known as The Rosedale
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of Dashwood Street, Pulaski Street and an Alley in Block 1, Schlater's Subdivision to be
replatted with the adjoining property for a mixed -use development in the Evans and Rosedale Urban Village to be known as The Rosedale; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
The John R. McAdams Company, LLC on behalf of Evans Rosedale Development Phase I, LP, has requested vacation of these rights -of -way to be
replatted with the adjoining property for a mixed -use development in the Evans and Rosedale Urban Village to be known as The Rosedale. The
City Plan Commission recommended approval of this request at its meeting on April 26, 2023. An acceptable final plat (FS-23-089) has been
received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights -of -way through plat dedication. The City does not own any fee interest
in the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and
Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the streets and alley.
This project is located in COUNCIL DISTRICT 8 and FUTURE COUNCIL DISTRICT 8.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
