ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF FOREST PARK BLVD. EZTENSION
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL
ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN
AUTHORIZED AND ALLOWED ACAINST SOME OF SAID ASSESSMENTS; DIRECTING
THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF
FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO-
PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE
DATE,
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with Worth Construction Co. for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and
public places in .said City, to-wit-
1. FOREST PARK BOULEVARD EXTENSION: From East-West Freeway to West Side Connection,
known and designated as Unit 1, Project No.
094-23000-107,
2. WEST TENTH STREET: From Forest Park Boulevard Extension to Penn
Street, known and designated as 'Unit 2, Project
No. 094-23000-.107.
3. WEST FIFTH STREET: From Forest Park Boulevard Extension to Penn
Street, known and designated as Unit 3, Project
No. 094-23000-107.
4. PURCEY STREET: From West Side Connection to West Peach, known
and designated as unit 4, Project No. 094-23000-107.
W-HEREAS, by sundry proceedings heretofore passed by the City Council of the
4ty of Fort Worth, Texas, including Ordinance No, a portion of the ecist of
said improvements was levied and assessed against the respective properties abutting
r-17 eaCh of the above described portions of streets, avenues and public places and against
the real anti true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5535 —,) and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments, The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment are the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted !and
allowed against the principal amount of some one or more of the assessments heret,,7fore
levied, and the principal amount for which, each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows'
When each of the certifiactes has been duly executed as hereinabove. provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth., Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage. day of "1 19

This project was completed, except for some minor ditch grading, and
opened for traffic on April 26, 1,9167. Coincident with this completion,
a request was made by the Tarrant County Water Control and Improvement
District 'NO. I asking that certain specific barren areas of the existing
river levee near the Fort Worth 'Holly Plant site be provided additional
vegetative cover. During construction of the Forest Park, Boulevard Ex-
ten,sion, it had been. necessary to perform a minimum of adjacent blading
on the levee to att.,ain conformity with the finished roadway and side
drainage sections . Therefore, beta mida grass sprigs and seedlings 'Were
planted by the paving contractor in these bladed areas on the levee and
areas below the levee. After a grass establishment period of taro months,
the project was final, inspected by the Public Works Department on June
26, 1967.

Deviation from Bid Price: $38,807.93 over-run for the following reasons:
1) During plan preparation soils tests indicated that lime
stabilization should be used in the subgrade on Units 11,
III and IV. After construction had begun, numerous rock

sections were encountered in the subgrade of the road-
ways. The cost of rock removal and replacing with
gravel foundation course exceeded the contract allowance
for lisle stabilization. + $17,299.80
2) Additional street excavation was required to remove
undesirable subgrade conditions. + $ 5,956.83
3) In order to allow more adequate protection to
roadway,, it was necessary to place additional em-
bankment material to flatten slopes. + 6,017.60
4) Be:causo, of insufficient top soil for proposed plant-
ing in parkways and medians, additional top soil was
required and placed. + $ 2,949.10
5) Variations between quantities estimated in 'the con-
tract s peel,ficat ions and quantities measured and
used at the job site. + 62584.60
Total Over-run $380807.93
Comgfiance with S,pecifications
Paving rest cores showed compliance with specifications within construc-
tion tolerance o,,),,.i striet improvements on Forest Park, Boulevard Extension,
except for one isolated area, On Unit 3,, Fifth Street, an isolated area
of approximately 44.4 square „ ards was found to be deficient in thickness.
In accordance with Section 300.5 of the contract Specifications, which
provides for penalty for deficient pavernent thickness, the contractor was
allowed to leave, this area, in place.* No payment will be made for the
44.4 square yards of pavement which results in a penalty of $1,39.20 wbich
was deducted from the tiotal monies due for concrete paving on Fifth Street.
During testing on this project, 120 surface corings and 114 base corin,gs
were made with the following results :

Specifications require 7.0 inches of reinforced concrete with the follow-
in tolerances and penalties. 1) Up to .25 inch - no penalty; 2) From

.2,5 to .50 inch - penalty in proportion to the deficient thickness; and,
3) Deficiency in excess of .50 inch - 100 per cent penalty. The 44.4
square foot paving section had an average thickness of 6.71 inches, 'With
the most deficient point having a thickness of 6.42 inches, a deficiency
of .58 inch.

Recommendations
It is recommended :
1) That a bond fund transfer of $15,500 be approved from Account
No. 094-23000-109 to Project No. 094-23000-107, Forest Park
Boulevard Extension, to provide additional funds for the
project; and
2) That the above project be accepted by adoption of an ordinance
and that final payment of $70,025.40 be authorized to Worth
Construction Company.
