HomeMy WebLinkAboutOrdinance 17248-10-2006Ordinance No. 17248-10-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS 1N THE ENVIRONMENTAL MANAGEMENT PROJECTS FUND IN THE AMOUNT OF $150,000 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING AN AMENDMENT TO CITY 5ECRETARY CONTRACT NO. 31678 WITH INDUSTRIAL HYGIENE AND SAFETY TECHNOLOGY, INC.; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: S1=CTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Projects Fund in the amount of $150,000 from available funds, for the purpose of executing an Amendment to City Secretary Contract No. 31678 with Industrial Hygiene and Safety Technology, Inc.. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way Impair the remaining portions, Sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY: ~F~ Assisfiant 'ity Attorney ADOPTED AND 1=FFECTIVE: October 24 2006 ~'it~ ®f F®rf ®r~h, l°e~~s r~ i ~ r~ COUNCIL ACTION: Approved ort '1012412006 -Ordinance No. '17248-10-2006 ®ATE: Tuesday, October 24, 2006 LOG NAt1~E: 521HSTADMEND REFERENCE N®.: **C-21792 SUE3JECT: Authorize Amendment of City Secretary Contract Number 31678 with Industrial Hygiene and Safety Technology Inc., for Industrial Hygiene and Asbestos Assessment Services and Adopt Appropriation Ordinance RECOMiVIEN®ATION: It is recommended that the City Council: 1} Approve the transfer of $ 150,000.00 from undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund (R101); 2) Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $150,000.00 from available funds; and 3} Authorize the City Manager to execute an amendment to City Secretary Contract Na. 31678 with Industrial Hygiene and Safety Technology, Inc. increasing the not to exceed amount by $100,000.00 to $200,000.00 far the current contract term and by $50,000.00 to $150,000.00 for the contract renews! period April 1, 2007 through March 1, 2008. ®ISCUSSION. City Secretary Contract Number 31678 was approved by City Council nn March 24, 2005 (C-20609) and provided for industrial hygiene services in an amount not to exceed $100,000 per year for the period April 1, 2005 to March 31, 2006 with the option to renew far two additional one-year periods. The first renewal was exercised and the current contract term runs through March 31, 2007. On July 18, 2006, (C-21563} Council approved an agreement with Tarrant Regional Water District (TRWD) authorizing the Department of Environmental Management to provide lead based paint and asbestos assessments for approximately 70 properties TRWD will be acquiring for Trinity River Vision Project. This amendment will allow the Department of Environmental Management to fulfill its obligations with Tarrant Regional Water District for the Trinity River Vision Project. All work covered by this amendment is expected to be completed by September 30, 2007. Industrial Hygiene and Safety Technology, Inc., is in compliance with the City's M/WSE Ordinance by committing to 25 percent MIWBE participation. The City's goal on this project is 25 percent.
