Ordinance No. 1'7252-10-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER FUND IN THE AMOUNT OF $42,198 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH JCI, INC. THROUGH THE TEXAS MULTIPLE AWARD SCHEDULE FOR THE PURCHASE OF AN HVAC CHILLER AND START-UP SERVICES; PROVIDING FORA SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to these amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Fund in the amount of $42,198 from available funds far the purpose of executing a contract with JCI, Inc. through the Texas Multiple Award Schedule for the purchase of an HVAC chiller and start-up services. SECTION 2. That Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Fund in the amount of $42,198.00; and 2. Authorize the purchase of an HVAC chiller and start up services from Johnson Controls, Inc. (JCI}, through the Texas Multiple Award Schedule (TxMAS} for the Water Department for an amount not to exceed $42,198.00, with payment due 3fl days from invoice date. ©ISGLlSSION: The Water Department will replace a 47-ton chiller at the Eagle Mountain Water Treatment Plant (EMWTP}. The existing chiller has experienced failure of two refrigerant circuits, which reduced its working capacity to 50%. Water ^epartment staff received a quote in the amount ofi $32,000.00 for repairs. Since the EMWTP is in the process of being expanded to a 105 million gallon per day (MGD) facility from a 70 MGD facility, staff requested the EMWTP expansion HVAC engineer review the options and provide a recommendation. The engineer recommends replacement of the existing chiller. Specifications were drafted and forwarded to two vendors with established cooperative purchasing contracts (Trans on The Cooperative Purchasing Network and York International on the TxMAS.} York International was acquired by JCI in December 2005. Although State Law does not require solicitation from more than one vendor when purchasing from a cooperative purchasing contract, efforts were made to obtain the best value. JCI will deliver the chiller, provide start-up supervision and instruction, and provide afive-year parts and labor warranty. The chiller will be installed by the EMWTP expansion contractor. Staff certify the unit to be provided by JCI meets specifications and pricing is in accordance with the TxMAS contract. TxMAS was established by the State of Texas Building and Procurement Commission as a list of approved contracts that have been competitively bid and awarded by Federal, State or Local Government entities to increase and simplify the purchasing power of local government entities across the State of Texas. This satisfies the need for competitive bidding under the Local Government Code. Under Section 271.1fl2 of the Local Government Code, a local government purchasing an item under such Logname: 13P06-0254 Page 1 of 2 a contract satisfies any state law requiring that the local government seek competitive bids far purchase of the item.
