CONTRACT No.12LIO WHEREAS, the City of Euless and the City of Fort Worth desire to provide adequate firefighting services to the citizens of their respective cities in the most efficient and economical manner; and WHEREAS, pursuant to Article 4413 (32c) of the revised Civil Statutes of Texas (also known as the Interlocal Coopera- tion Act) , the City of Euless and the City of Fort Worth desire to cooperate in the provision of fire protection services. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: This contract and agreement is entered into by and between the City of Euless, hereinafter called "Euless" acting herein by and through W. M. Sustaire, its duly authorized City Manager, and the City of Fort Worth, a home rule municipal corporation situated in Tarrant County, Texas, hereinafter called "Fort Worth," acting herein by and through Robert L. Herchert, its duly authorized City Manager. WITNESSETH: I. Euless shall provide the fire protection services required hereunder in an area within the city limits of Fort Worth des- cribed as follows: NORTH BOUNDARY Fort Worth - Euless city limits on S. Pipeline Road (1800' east of House Anderson Road as des- cribed in Fort Worth Fire Depart- ment Demand Zone #k305). East with Fort Worth - Euless city limit. line to the Dallas County line. afF191AL RICORD, CITY SECRETARY FT. WORTH, TEX. EAST BOUNDARY Fort Worth -- Euless city limits and Dallas County line south to the Fort Worth/Grand Prairie city limits at the West Fork of the Trinity River. SOUTH BOUNDARY Fort Worth - Grand Prairie city limit and the Dallas County line north and west to Highway #360. Highway #360 (west side of) north to C.R.I. & G. Railroad. C.R.I. & G. Railroad (south side of) west to a point just east of Rho- dolphus (extended) as described in Fort worth Fire Department Demand Zones 4306 and 4310. WEST BOUNDARY C.R.S. & G. Railroad just east of Rhodolphus (extended) north to the Fort worth-Euless city limit on S. Pipeline Road (1600' east of Mouse Anderson Road) as des- cribed in Fort Worth Fire Depart- ment Demand Zones #305, 4306, and #310. (alternate description). Euless shall provide the fire protection services required hereunder in an area within the City limits of Fort Worth encom- passing the following Fort Worth Fire Department Demand Zones: 4306, 0307, 4308, #311, #315, #316, #317, #31B, #319, #320, #321, #322, #323, and #324. The exact location of the above-described service area is colored green and designated on a location map marked Exhibit "A" attached hereto, and specifically made a part hereof. Ii. Fort Worth shall provide fire protection services required hereunder in an area within the city limits of Fort worth as described as follows: NORTH BOUNDARY East Loop 820 North and the Fort Worth-Hurst city limits (C.R.I. & G. Railroad) . C.R.I. & G. Rail- road (south side of) east to -2- South Norwood Drive. South Nor- wood Drive (west side of) south to Trinity Boulevard. Trinity Boulevard (south side of) east to Hell Spur. Hell Spur (east side of) north to C.R.I. and G. Rail- road. East with C.R.I. & G. Railroad (south side of) to just west of Jimison Lane (4000 feet west of House Anderson Road) as described in Fort Worth Fire Department Demand Zone #309. EAST BOUNDARY C.R.I. & G. Railroad just west of Jimison Lane (4000 feet west of House Anderson Road) south with the Fort Worth city limit line to the West Fork of the Trinity River. SOUTH BOUNDARY Fort Worth-Arlington city limit line and the West Fork of the Trinity River east of Arlington Bedford Road. West with the West Fork of the Trinity River to E. Loop 820 North. WEST BOUNDARY West fork of the Trinity River and E. Loop 820 North (east side of) north to the Fort Worth-Hurst city limit (C.R.I. & G. Rail- road) . (alternate descri Lion) Fort Worth shall provide the fire protection services required hereunder in an area within the City limits of Fort Worth encom- passing the following Fort Worth Fire Department Demand Zones: #279, #280, #282, and #312 The exact location of the above-described service area is colored blue and designated on a location map marked Exhibit "A" attached hereto, and specifically made a part hereof. III. Fort Worth and Euless shall provide the fire protection services required hereunder in an area within the city limits of Fort Worth as described as follows: -3- EAST BOUNDARY Fort Worth -- Euless city limit an S. Pipeline Road (1800 feet east of House Anderson Road) as described in Fort Worth Fire Department Demand Zone #305) south just east of Rhodolphus (extended) to G.R.I. and G. Railroad as described in Fort Worth Fire Department Demand Zones #305, #306, and #310. SOUTH BOUNDARY C.R.I. and G. Railroad just east of Rhodolphus (extended) as described in Fort Worth Demand Zones #306 and #310. West with C.R.I. & G. Railroad (south side of) to Bell Spur. Bell Spur (east side of) to Trinity Boulevard. Trinity Boulevard (south side of) west to South Norwood Drive. WEST BOUNDARY North on South Norwood Drive (west side of) north to Fort Worth-Hurst city limit (Highway #10) . NORTH BOUNDARY Fort Worth-Hurst city limit and South Norwood Drive and Highway #10 east to and including the Fort Worth-Euless city limit to a point on S. Pipeline Road 1800 feet east of House Anderson Road as described in Fort Worth Fire Department Demand Zone #305. (alternate description) Fort Worth and Euless shall provide fire protection services required hereunder in an area within the City limits of Fort Worth encompassing the following Fort Worth Fire Department Demand Zones: #281, #301, #302, #303, #304, #305, #309, and #310. The exact location of the above-described service area is colored yellow and designated on a location map marked Exhibit "A" attached hereto, and specifically made a part hereof. -4- Iv. The service area designated in Paragraph I of this agreement shall be mutually served by Euless Fire Station No. 1 located at 112 West Euless Boulevard, Euless, Texas and Euless Fire Station No. 2 located at 800 West Parkway, Euless, Texas. The service area designated in Paragraph II of this agreement shall be served by Fort Worth Fire Station No. 27 located at 200 Holder Drive, Hurst, Texas; Fort Worth Fire Station No. 24 located at 3100 Handley [hive, Fort Worth, Texas; and Fort Worth Fire Station No. 7 located at 7601 John T. White Road, Fort Worth, Texas. The Fort Worth and Euless service area designated in Paragraph III of this agreement shall be mutually served by Euless Fire Station No. 2 and Fort Worth Fire Station No. 27 and Fort Worth Fire Station No. 7. V. .Euless Fire Station No. 1 shall be equipped with one (1 ) 1500 gpm pumper; one ( 1) 1000 gallon tanker (4--wheel drive); and one (1 ) rescue squad. Four (4) firefighters shall be on duty at this station at all times. Euless Fire Station No. 2 shall be equipped with one (1 ) 1000 gallon pumper and one ( 1) combination 85 foot ladder and 1000 gpm pumper. Four (4) firefighters shall be on duty at this station at all times. Fort Worth Fire Station No. 27 shall be equipped with one ( 1) 1000 gpm pumper. Three (3) firefighters shall be on duty at this station at all times. Fort Worth Fire Station No. 7 shall be equipped with one (1) 1500 gpm pumper and one (1) 500 gallon tanker (4 wheel drive). Three (3) firefighters shall be on duty at this station at all times. -5- Fort Worth Fire Station No. 24 shall be equipped with one ( 1) 1000 gpm pumper and one (1) 85 foot aerial ladder truck. Six (6) firefighters shall be on duty at this station at all times. Any of the equipment required hereunder may be replaced with other equipment provided that the substitute equipment meets the approval of the Fort Worth Fire Chief or his duly authorized representative. It is understood by both parties that temporary adjustments in manpower and equipment requirements as designated herein can be made by either party without notification to the other party in cases of fire responses, training exercises, fire prevention assignments, and equipment maintenance requirements. "Temporary" shall be defined as a period no longer or less than 24 hours' duration. If longer adjustment periods are necessitated due to labor relations or other employee relations problems, each party agrees to make diligent, good faith efforts to notify the other party of such adjustments and to make diligent, good faith efforts to carry out the terms of this contract regardless of any firefighter and equipment shortages. VI. Euless shall provide the following services to the areas designated to be served by Euless: A) Initial fare suppression response; B) Fire Department first responder emergency medical service equal to that provided by the Fort Worth Fire Department; C) Initial contact for fire code enforcement by Pumper companies during pre-fire planning tours; D) Pre-fire planning with plans being updated on an annual basis; and E) Necessary reports and records in accordance with the normal Fort Worth reporting procedures. -6- VII. Euless shall make the initial response to all fires in its service area. If it appears that the fire will require lengthy extinguishment, operation and/or overhaul, it shall immediately inform the Fare Alarm Dispatch Office, and Fort Worth shall provide backup or assume extinguishment/overhaul operations at the discretion of the senior Euless command officer. "Backup" shall be defined herein as the provision of a com- pany by one of the parties to this agreement to cover a vacant fire station during the absence of the home company, provided, however, that such delay will not be of unreasonable duration, and that Euless shall respond to the fire alarm immediately upon cessation of the delay. VIII. Euless shall, make the initial response to all fires in its service area. If a working fire within the Euless service area is also located within the city limits of Fort Worth, Fort Worth shall provide backup, upon request, at least equivalent to the amount of equipment and manpower being used by Euless in fire suppression activities in Fort Worth. Fort Worth will also endeavor to supply any additional equipment or manpower requested by Euless. The request for additional equipment shall be subject to equipment and manpower availability and the approval of the Fort Worth Fire Chief or his duly authorized representative. IX. After initial response, Euless shall immediately notify the Fire Alarm Dispatch Office of any responses located in commer- cial, industrial or similar large occupancies of Fort Worth. Upon such notification, Fort Worth shall dispatch equipment to equal a one (t ) alarm assignment to the fire unless the Euless officer in command of the fare suppression activities direct the -7- equipment to be sent to its station as backup during its absence or orders the equipment to be returned to Fort Worth. A one alarm assignment is comprised of two (2) pump companies, one (1 ) ladder company, and one (1) chief officer. X. Euless shall notify the Fire Alarm Dispatch Office of the City of Fort worth when any of the equipment or manpower required hereunder is out-of-service or not available for service. Euless shall also notify the Fire Alarm Dispatch office when reported equipment or manpower deficiencies are rectified. If for any reason Euless cannot respond to or will be delayed in responding to a fire alarm in the Fort Worth city limits, the Euless command officer shall immediately inform the Fort Worth Alarm Center, provided, however, that such delay will not be of unreasonable duration, and that Euless shall respond to the fire alarm immediately upon cessation of the delay. Response areas need not be strictly adhered to in the event of major fire situations or other situations whereby a mutual aid concept would be advantageous. Police Department responses into contract areas may be requested by individual departments to provide immediate traffic and crowd control. XI. Fort Worth shall provide upon request the following servi- ces to Euless, subject to equipment and manpower availability and the approval of the Fort Worth Fire Chief or his duly authorized representative: A) Fort worth shall provide backup response to Euless while Euless is fighting fire(s-) within its own city limits; B) Fort worth shall provide manpower and equipment to Euless as backup in its city while it is engaged in training activities which require its equipment and manpower to be unavailable for service; _g_ C) Fort Worth shall provide backup equip- ment to Euless while its equipment is undergoing extensive repairs; D) Fort Worth shall provide firefighting assistance on greater alarm fires; E) Fort Worth shall provide training pro- grams for the parties to this agree- ment so that uniform fire-ground oper- ations can be developed thereby increasing the efficiency of joint firefighting efforts. The Fort Worth Fire Department will be responsible for developing the programs and noti- fying Euless of dates, times, and lo- cations of said training programs. Each city will be required to pay its own proportional costs incurred while attending the training programs. Fort Worth, however, will not charge Euless for the use of its training academy, its instructors, or its training aids. This shall not be interpreted to mean that Euless fire personnel are required to attend all Fort Worth training sessions. Mutual training programs will be developed to meet both cities' training capabilities, to establish better working relationships, and to provide efficient fire ground operations. F) Additional backup functions to be performed by Fort Worth Fire Department shall include, but not be limited to, provision of lighting and breathing air equipment, firefighting tools and equipment, and dispatch operators, to supplement those support functions already in operation in Euless. The fireground command shall be set up by the highest rank- ing officer of the company which makes the initial response to the fire. Said officer shall be referred to herein as the com- mand officer. If a second company provides assistance at the scene, its units and personnel shall be subordinate to the command officer unless the second company's highest ranking officer outranks the command officer. If the command officer is outranked, the second company's highest ranking company officer at the scene shall be in command of the firefighting activi- ties. The first arriving chief officer from either Euless or Fort Worth will assume command upon his arrival and subsequent -9- arriving chief officers will be subordinate to that command with the provision that the Fort Worth Fire Chief or Deputy Chief may, at their option, assume command of any fire located within the city limits of Fort Worth. XIII. All equipment required hereunder shall be equipped with two-way radios capable of operating on frequency 46.140 Mhz and designated as "Channel Euless 1." Each Fire Alarm Dispatch Office shall have a ring down phone to provide direct telephone communications between the parties to this agreement. Fort Worth shall pay all costs incurred in providing this capability. XTV. Each city shall bear responsibility for any .loss, damage, personal injury or death which may occur as a result of the actions of its employees, while either city's employees are performing training functions outlined in Paragraph XI (E) of this agreement, provided, however, that pursuant to Article 4413(32c) , Section 4(g) , Vernon's Texas Civil Statutes, each city agrees that the act of any person or persons while fighting fires, traveling to or from fires, or in any manner furnishing fire protection services to areas ordinarily served by the other contracting jurisdiction, shall be considered an agent of the requesting city in all respects, notwithstanding such person or persons may be regular employees or firefighters of the responding city, and any liability relating to the fur- nishing of the services is the responsibility of the requesting city. Xv. The term of this agreement shall be for a period of one ( 1) year with an option to renew this contract upon the mutual con- _10- sent of the parties hereto for one more consecutive one (1) year term. The primary term shall commence on the 1st day of October, 19B2, and shall terminate on the 30th day of September, 1983. It is further agreed by and between the parties hereto that either party shall have the right to terminate this agree- ment by giving the other party written notice of its intent to terminate, no later than six (6) months prior to the date of such termination. XVI. It is understood and agreed by and between the parties hereto that for and in consideration of the services to be pro- vided by Euless in accordance with this agreement, Fort Worth shall pay Euless $233,114.00 per annum. Said amount shall be paid to Euless in twelve equal monthly installments. The pay- ments shall be made at City Hall, 201 N. Ector Drive, Euless, Texas 76039. XVII. This agreement shall not be assigned in whole or part by any party without the prior written consent of the other party, and any attempted assignment without such prior written consent shall be void. XVIII. Venue of any action brought on this contract shall lie in Tarrant County, Texas. XIV. This writing constitutes the entire agreement between the parties, and no written or oral contract exists to modify same. -11- IN WITNESS WHER F, Executed in Tarrant County, Texas this � 0 day of �• 1982.
