HomeMy WebLinkAboutContract 56388-A1CSC No. 56388-A1 AMENDMENT No .1 TO CITY SECRETARY CONTRACT No. 56388 WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 56388, (the CONTRACT) which was authorized on the 24u' day of August, 2021 by M&C 20- 0622 in the amount of $316,680.00; and WHEREAS, the CONTRACT involves engineering services for the following project: Village Creek Water Reclamation Additional Gas Line for Biosolids Drying Facility; and WHEREAS, it has become necessary to execute Amendment No. I to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $248,775.00. 9 Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $565,455.00. 3. The additional SUE efforts will be performed by The Rios Group, which were already contracted to perform the subsurface utility investigation for the project. CONCEPTUAL DESIGN (30 PERCENT). Conceptual design shall be submitted to CITY for the increase in footage (-2,200LF) to take the proposed gas line inside Village Creek and connect to the City owned biogas line in lieu of MAS Energy gas line as part of the overall project package, per the approved Project Schedule. ENGINEER will develop the conceptual design of the infrastructure as follows. 2.1. Additional Data Collection and Site Visits Due to Chanae in Alignment DELIVERABLES A. Conceptual Design Package including the additional footage added to the project. TASK 3. PRELIMINARY DESIGN (60 PERCENT). Preliminary plans and specifications shall be submitted to CITY per the approved Project Schedule. ENGINEER will develop the preliminary design of the infrastructure as follows. 3A , Development of Preliminary Design Drawings and Specifications shall include the following: • Plan and profile sheets which show the followina: additional pas line olanlorofile to extend the alignment (-2,200LF) inside the Viliaae Creek facility. DELIVERABLES A. Preliminary Design drawings and specifications for the proposed gas line including the additional - 2,200 LF needed to extend inside VCWRF facility will be included with the overall Preliminary Design package B. Additional Storm Water Pollution Prevention Plan sheets C. Engineer's Opinion Probable Construction Cost (EOPCC) TASK 4. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT). Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as described in the original Engineering Agreement, and will include drawings and specifications follows: • Electrical, Instrumentation, and Control Pre -final design Following a 90% construction plan review meeting with the CITY, the ENGINEER shall submit Construction Documents (100%) to the CITY per the approved Project Schedule. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in State of Texas. The ENGINEER shall submit a final design estimate of probable construction cost with both the 90% and 100% design packages. This estimate shall use ONLY standard CITY bid items unless standard items do not cover proposed construction and installation. DELIVERABLES A. 90% E&I construction plans and specifications will be included with the overall Design Packaae. BID PHASE SERVICES. ENGINEER will support the bid phase of the project as follows: 5.1 Bid Support for the electrical and instrumentation components will be included for the rp oJect. TASK 6. CONSTRUCTION PHASE SERVICES. ENGINEER wiii support the construction phase of the project as described in the original Engineering Agreement and as follows: 6.1.3. Site visits and oroaress meetinas 6.1.3.1. Make up to 12 site visits, aenerallv monthly, durina the construction of the Proposed pas line. The length of the proposed aas line construction is anticipated to be a period of up to 12 months. Throughout the construction phase of the PROJECT, the ENGINEER will attend monthly progress meetinas, provide suDoort for the CITY, observe the progress and the auality of work, and attempt to determine if the work is proceeding in accordance with the construction Contract Documents. The ENGINEER will provide meetina minutes, field notes, and supplemental instructions through BIM 360. Additional site visits may be considered as a SPECIAL SERVICE. 6.1.5. Electrical and Instrumentation Construction Phase Services 6.1.5.1. Respond to Contractor's requests for information (RFIs), review shot) drawing submittals, and provide record documents based upon red -line markups from the Contractor; 6.1.5.2. Visit the Droiect site once as construction proceeds to resolve discrepancies, observe and report on the Drogress/quality of the executed work as reauired by the oroaress of the work, and 6.1.5.3. Participate in one substantial completion inspection. 6.1.6. Review of Contractor's Submittals and Preparation of Field/Chance Orders 6.1.6.1. Review samples, catalog data, schedules, shop drawinos, modification reauests, and other submittals in accordance with the requirements of the construction Contract Documents for the PROJECT via BIM 360. Monitor the progress of the Contractor in sending and orocessino submittals to see that documentation is being processed in accordance with schedules. Produce monthly reports indicating the status of all submittals in the review Process. It is anticipated that the ENGINEER will review and respond to up to a total of 30 submittals. Documents received and filed as record data are not considered shop drawing submittals. Additional authorized shop drawing submittals may be considered as a SPECIAL SERVICE. 6.1.6.2. Review auality related documents provided by the Contractor such as laboratory, shop and mill tests of material and test equipment, equipment installation reports, and other data and documentation as required by the construction Contract Documents', 6.1.6.3. Maintain a document control system using BIM 360 to track the Contractor's Requests for Information (RR. Review the Contractor's RFIs and prepare a response in accordance with the construction Contract Documents. Provide interpretation and communicate intent if information is not addressed in the construction Contract Documents. It is anticipated that the ENGINEER will review and respond to up to a total of 15 RFls. Review of RFIs in excess of the specified number may be considered as a SPECIAL SERVICE: 6.1.6.4. Investigations, analvses, and studies reauested by the Contractor and approved by the Citv, for substitutions of equipment and/or materials or deviations from the plans and specifications may be considered as a SPECIAL SERVICE. and 6.1.6.5. Establish procedures for administering changes to the construction Contract Documents through BIM 360. Assist City in processing contract modifications and in the negotiations with the Contractor to determine the cost and time impacts of these chanaes. Review up to three Contract Modification Requests. Prepare up to three Change Orders for execution by the Citv. Additional authorized Contract Modification Requests review or Chance Order preparation in excess of the specified number may be considered as a SPECIAL SERVICE. Construction inspection and weld testing services are bevond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY'S written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Proiect shall be agreed upon in writing by both parties before the services are performed. TASK 8. SURVEY AND SUBSURFACE UTILITY ENGINEERING SERVICES. ENGINEER will provide additional Subsurface Utility Engineering services as described in the original Engineering Agreement and as follows: 8.2 Subsurface Utilitv Ennineerina Services fSUEI: SUE Qualitv Level B. This involves obtaining information throutah the application of aDDroDriate surface Qeophvsical methods to determine the existence and aDDroximate horizontal position of subsurface utilities. Qualitv Level B data should be reproducible by surface aeoDhvsics at anv Doint ❑f their depiction. This information is surveved t❑ aDDlicable tolerances defined by the Droiect and reduced onto Dian documents. It will also include elevations ❑f sanitary and adiacent storm sewers with rim/invert elevations. It is assumed aDDroximateiv 2,200 LF of Level B SUE will be Derformed for utilities. Adopt the attached appropriation ordinance adjusting appropriations in the W&S Commercial Paper Fund by increasing appropriations in the Village Creek Water Reclamation Additional Gas line for Biosolids Drying Facility project (City Project No. 103011) in the amount of $5,619,233.00 and decreasing appropriations in the W&S Commercial Paper project (City Project No. UCMLPR) by the same amount to effect a portion of Water's Contribution to the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of a contract with R Construction Civil, LLC in the amount of $4,828,791.50 for the Village Creek Water Reclamation (VCWRF) Additional Gas Line for Biosolids Drying Facility project (City Project No. 103011 ) and authorize execution of Amendment No. 1 to City Secretary Contract No. 56388, an engineering agreement with Halff Associates, Inc., in the amount of $248,775.00 for construction support services for the VCWRF Additional Gas Line far Biosolids ❑rying Facility project (City Project No. 103011) for a revised contract amount of $565,455.00. On August 24, 2021, M&C 20-0622, the City Council authorized an engineering agreement with Halff Associates, Inc., (City Secretary Contract No, 56388), in the amount of $316,680.00 for the design of a biogas pipeline. The biogas pipeline will convey digester gas from VCWRF to the biosolids drying facility for use as a supplemental fuel source for the new biosolids dryer. Amendment No. 1, will provide compensation for additional design on the project as well as construction phase services consisting of contractor submittal review, technical assistance, and site visits. The project was advertised for bid on January 12, 2022 and January 19, 2022, in the Fort Worth Star - Telegram. In addition to the contract cost, $348,514,00 is required for project management, inspection, and materials testing, and $193,152.00 is provided for project contingency. This project will have no impact on the Water Department's operating budget when complete, It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Callable Commercial Paper Program (CP) will be used to provide interim financing for this project until the debt is issued. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the attached reimbursement resolution. Under federal law, debt must be issued within approximately three years in order for these expenses to be reimbursable. Adoption of the attached resolution does not obligate the City to sell bonds but preserves the ability of the City to reimburse itself from tax-exempt bond proceeds. Business Equity — R Construction Civil, LLC - R Construction Civil LLC is in compliance with the City's Business Equity Ordinance by committing to 5 percent participation on this project. The City's goal on this project is 5 percent. Business Equity — Haiff Associates, Inc, agrees to maintain its initial MIWBE commitment of 10 percent that it made on the original agreement and extend and maintain that same MIWBE commitment of 10 percent to all prior amendments up to and inclusive of this Amendment No, 1. Therefore Halff Associates, Inc. remains in compliance with the City's MIWBE ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company The project is located in COUNCIL DISTRICT 5 and FUTURE COUNCIL DISTRICT 5.
