FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO, 55565
WHEREAS, the City of Fort Worth ("City") and Trinity Habitat for Humanity (hereafter
"Agency"), made and entered into City Secretary Contract No. 55565 ("Contract") effective February 1,
2021;
WHEREAS, the Contract provides funding to Agency pursuant to a grant received by City frorn
the United States Department of Housing and Urban Development ("HUD") through the Community
Development Block Grant Program ("CDBG"), Program No. B-20-MW-48-0010, Catalog of Federal
Domestic Assistance No. 14.218;
WHEREAS, the Contract was set to expire on April 30, 2023;
WHEREAS, the City Council authorized the City Manager or his Designee to amend the contract
if necessary to achieve project goals (M&C 20-0940) and section 3 of the Agreement provides for an
extension of the contract terms for completion of the program goals;
WHEREAS, the Agency requested an extension of the Term of the Contract to expend remaining
CDBG-CV3 funds for a home Repair program on behalf of elderly homeowners 62 years of age or older,
100% of whom are low and moderate income, and the City agreed to such extension and to amend Exhibit
A to reflect the change;
WHEREAS, the City is amending Exhibit A to communicate changes to the Health Homes for
Seniors Program Summary;
WHEREAS, the City is amending Exhibit A-1 to reflect the most updated HUD income limitations;
WHEREAS, the City is amending Exhibit B to reflect a revised budget for the Healthy Homes for
Seniors project that includes additional Technical Assistance funds;
WHEREAS, the Agency requested an amendment to add a Technical Assistance line item to the
budget in Exhibit B to cover the costs associated with enhanced software that will allow seniors to submit
applications electronically;
WHEREAS, the City approved this adjustment because it believes that the requested amendment
will help Agency meet the program's goals and further the interests of both Agency and City and such
funding will come from unprogrammed CDBG-CV funds; and
WHEREAS, it is the mutual desire of City and Agency to amend the Contract to complete the
Program and meet Contract objectives.
NOW, THEREFORE, City and Agency hereby enter into this Amendment to memorialize the
Parties' agreement to arnend the Contract as follows:

The first sentence of Section 3 TERM is hereby deleted and replaced with the following language:
3. TERM,
The term of this Contract begins on the Effective Date and terminates on December 31, 2024
("Expiration Date"), unless earlier terminated as proved in this contract.

All terms and conditions of the Contract not amended herein remain unaffected and in full force
and effect, are binding on the Parties and are hereby ratified by the Parties. Capitalized terms not defined
herein shall have the meanings assigned to them in the Contract.

This Amendment is effective immediately upon execution.

TRINITY HABITAT FOR HUMANITY — HEALTHY HOMES FOR SENIORS
February 1, 2021 to December 31, 2024

Capitalized terms not defined herein shall have meanings assigned them in the contract.
PROGRAM:
The Healthy Homes for Seniors Program (Program) provides exterior home repairs for low to
moderate (low -mod) income homeowners 62 years and older living in Fort Worth, Texas. Eligible
repairs and/or replacement of systems include HVAC, electrical, natural gas, plumbing, roof, grab
bars, lever hardware for doors, and one year of homeowner's insurance on properties where
coverage is lacking.
Clients must be income eligible households, occupy the home as their principal residence and must
lack the financial means or physical ability to renovate their homes. For the purposes of this
Program, all clients served shall have a household income at or below 80% of Area Median
Income, as defined and published annually by the United States Department of Housing and Urban
Development. Participants are required to provide appraisal district recognition of ownership,
driver's license or ID, income verification to confirm eligibility. The goal of the program is to
help seniors who own their homes to age in place successfully. The Program responds to the
COVID-19 Pandemic by reducing the exposure senior citizens face when they are required to leave
their home and move into an attendant care facility. These facilities have demonstrated a higher
risk of exposure to the pandemic for vulnerable clients.
Agency must coordinate with the City to ensure compliance with the Lead Safe Housing Rule.
Per -Unit Cap:
CDBG-CV3 funding for each Unit will be limited to $25,000, unless one or more of the following
circumstances exists:
• Increased construction costs due to required Lead Hazard Reduction services;
• Increased construction costs due to City of Fort Worth Historic & Cultural Landmarks
Commission requirements;
In the event that Lead -based Paint costs or Historic Preservation costs are a required element of
the project, total CDBG-CV3 funding will be limited to $40,000.00. Agency is responsible for
prioritizing work items in order to stay within funding caps while addressing the most urgent items
that are most essential to preserving the housing unit's structural integrity over the long term.
Agency or homeowner is responsible for submitting any applications for, and obtaining, applicable
City permits or approvals. These approvals may include but are not limited to Historic & Cultural
Landmarks Commission, Board of Adjustment, Zoning approvals, and building inspections. Cost
for permits or approvals are reimbursable under this contract.
Agency is responsible for referring all properties considered for Program assistance to the City of
Fort Worth LeadSafe program to determine eligibility for that program, and for complying with
the Lead Safe Housing Rule (24 CFR Part 35). Agency will maintain a list of such referrals for
review by City upon request. If a Referral property is determined to be eligible for the LeadSafe
Program, Agency will coordinate with the City to ensure that all City -administered Lead Hazard
Reduction activities are completed prior to completion of Preserve A Home activities. If a Referral
property is determined to be ineligible for the LeadSafe Program, Agency may take one of the
following actions:
• Contract for a Lead Risk Assessment to determine the extent of Lead Hazard Reduction
services required by HUD's Lead Safe Housing Rule, incorporate such Lead Hazard
Reduction into the Program scope of work for that property, and perform both exterior
repairs and Lead Hazard Reduction services using no more than $20,000.00 in funds from
this Contract.
• Contract for a Lead Risk Assessment, incorporate Lead Hazard Reduction into the
Program scope of work, and use Agency's Leveraged funds for any costs in excess of
$20,000.00.
• Contract for a Lead Risk Assessment, incorporate Lead Hazard Reduction into the
Program Scope of Work for the unit, and reduce the extent of Preserve A Horne exterior
repair items performed in order to stay within the $20,000.00 CDBG-CV3 cost limit.
• Deny services to the potential client based on cost infeasibility.
If the Lead Risk Assessment performed by the City's or Agency's contractor identified lead
hazards in the interior of the home, and the property has been determined to be ineligible for
participation in the City's LeadSafe Program, Agency may take one of the following actions:
• Use Contract funds to perform the interior lead hazard reduction activities / interim
controls in addition to the exterior Program repairs, prioritizing work items to be
performed in order to stay within the $20,000.00 cost limitation.
• Use Agency leveraged funds to supplement Contract CDBG-CV3 funds and perform all
HUD- required interior lead hazard reduction activities in addition to all needed exterior
repair items to ensure the ongoing physical and structural integrity of the housing unit.
• Deny services to the potential client based on cost infeasibility.
CDBG-CV3 funds will be used to pay for materials, building permits, contractor labor for the
home repairs and project delivery costs in the form of salaries and FICA insurance for staff
directly dealing with clients. The costs of Lead Risk Assessments and lead hazard reduction
interim controls to ensure compliance with HUD regulations are also eligible. The costs of Lead
Risk Assessments at homes which are later denied Program services due to cost infeasibility or
other reasons, are eligible under this Contract as a project delivery expense. CDBG-CV3 funds
will also be used to pay for technical assistance to update application software to help track client
project progress.
Agency is responsible for preparing and submitting to City all necessary information, photographs,
work item descriptions, etc. for completion of the HUD required 24 CFR Part 58 environmental
review process. Agency shall not commence work on any property prior to receipt of verification
from City that the environmental review process had been completed and the property is approved
for work.
Agency's office and Program services will be available at 9333 North N o r m a n d a l e
Street, Fort Worth, Texas 76116.
Agency shall not change any locations without prior City approval. Costs incurred at any
locations that have not been approved by City shall not be reimbursed.

Substantial Amendment to the City's 2019-2020 Annual Action Plan for the use of the
Grant Funds, Authorize Execution of Related Contracts, Adopt Appropriation Ordinance,
and Authorize Waiver of Indirect Costs
RECOMMENDATION:
It is recommended that City Council:
1. Authorize acceptance of Coronavirus Aid, Relief, and Economic Security (CARES) Act Community
Development Block Grant (CDBG-CV3) to be awarded by the United States Department of Housing
and Urban Development in an amount up to $5,468,206.00 (CDBG-CV3 funds);
2. Approve a substantial amendment to the City's 2019-2020 Annual Action Plan for submission to the
United States Department of Housing and Urban Development for the use of CDBG-CV3 funds in
the amount of $5,468,206.00 and acceptance of this award of the City's second allocation of CARES
Act Community Development Block Grant funds, including allocations of grant funds to particular
programs and activities as detailed below;
3. Authorize City Manager or his designee to execute contracts for up to eighteen -month terms with
the agencies listed in Table 1 below for CARES Act CDBG-CV3 funds, contingent upon receipt of
funding and satisfactory completion of all regulatory requirements;
4. Authorize the City Manager or his designee to extend contracts if an agency requests an extension
and such extension is necessary for completion of the program, or to amend contracts if necessary
to achieve program goals, provided any amendment is within the scope of the program and
complies with City policies and all applicable laws and regulations governing the use of federal
grant funds;
5. Adopt the attached appropriation ordinance increasing the receipts and appropriations in the Grants
Operating Federal Fund in the amount of $5,468,206.00 subject to receipt of the grant, for the
purpose of funding Community Development Block Grant (CDBG-CV3) programs, services, and
activities; and
6. Authorize a waiver of the Neighborhood Services Department indirect cost rate of 18.73\%,
estimated total of $204,839,00.
DISCUSSION:
The CARES Act was signed into law on March 27, 2020, to respond to the many impacts of the COV1D-19
public health emergency. The CARES Act includes provisions to help local governments prevent, prepare
for and respond to the Coronavirus, including providing for additional allocations of forumula grant funds
under the Community Development Block Grant (CDBG) program. The City was notified by United States
Department of Housing and Urban Development (HUD) on April 9, 2020, of its initial award of $4,360,291.00
in CDBG-CV funds. These funds were subsequently awarded to eligible activities and programs through
M&C 20-0330 and M&C 20-0471 in May and June of this year. The City was notified on September 11,
2020, of the award of its second allocation of CDBG funds, known as CDBG-CV3, in the amount of
$5,468,206.00. All funds must be used to prevent, prepare for, and respond to the Coronavirus.
On October 14, 2020, the Community Development Council (CDC) as the City's advisory body for the use of
CDBG-CV3 funds approved a funding recommendation for the award of these funds. Four key activities
were approved by the CDC for CARES Act funds; emergency rental assistance, employment -related
services, childcare related to employment, and youth education/tutoring services. In addition, a Healthy
Homes for Seniors program, providing home repairs for seniors ages 62 and older, was recommended for
funding. Emergency rental assistance activities address the Consolidated Plan goal for affordable housing.
Services for the elderly address the Consolidated Plan goal for aging in place. Employment -related services
address the Consolidated Plan goal for poverty reduction and household stabilization.
The CDC also approved a two-tier process for allocation of the CARES Act funds. Tier one funds totaling
$4,093,641.20 are recommended to be awarded directly to agencies for the activities listed in the table
below. Tier two funds totaling $1,374,564.80 will be awarded for the four above -listed priority activities
through a competitive Request for Proposal process that identifies additional service -delivery partners by the
end of Decmber, for CDC review and approval in early January, and subsequent City Council approval.
A 5-day public comment period was held from November 22, 2020 to November 28, 2020. Notice of this
public comment period was published in the Fort Worth Star -Telegram, posted on the City's website, and
distributed through the City News and other ongoing communications activities of the City Community
Engagement Office. Any comments received are maintained by the Neighborhood Services Department in
accordance with federal regulations,
A summary of funding recommendations approved by the CDC is provided below. A spreadsheet of funding
recommendations is also attached. This Substantial Amendment Action Plan for use of CARES Act funds
under the CDBG-CV3 program will be submitted to HUD following City Council approval.
Indirect costs totaling approximately $204,839.00 could be charged to this grant, as the Neighborhood
Services Department Indirect Cost rate is 18.731% in the City's most recent Cost Allocation Plan. A waiver
of these costs is requested to allow allocation of these funds to further support the programs and services to
assist low -to -moderate income citizens impacted by the coronavirus.

The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, in
the Grants Operating Federal Fund. The Neighborhood Services Department (and Financial Management
Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure
being incurred, the Neighborhood Services Department has the responsibility to validate the availability of
funds. This is a reimbursement grant.

Aid, Relief, and Economic Security Act Community Development Block Grant funds, contingent upon receipt of funding and satisfactory
completion of all regulatory requirements; and
3. Authorize the City Manager or his designee to extend contracts for up to one year If an agency or department requests an extension and such
extension is necessary for completion of the program, or to amend contracts if necessary to achieve program goals, provided any amendment
is within the scope of the program and complies with City policies and all applicable laws and regulations governing the use of the federal
grant funds.
DISCUSSION:
The Coronavirus Aid, Relief, and Economic Security (CARES) Act was signed into law on March 27, 2020, to respond to the many impacts of the

Coronavirus, including providing allocations of formula grant funds under the Community Development Block Grant (CDBG) program. The City was

funds. These funds were subsequently awarded to eligible activities and programs through Mayor and Council Communication (M&C) 20-330 and 20-

CV3, in the amount of $5,468,206.00. These funds were accepted and partially awarded to eligible activities and programs through Mayor and Council
Communication (M&C) 20-0940 on December 15, 2020, including the adoption of the appropriation ordinance and waiver of Indirect costs. All funds
must be used to prevent, prepare for, and respond to Coronavirus.
On December 9, 2020, the Community Development Council (CDC) as the City's advisory body for the use of CDBG-CV3 funds approved a funding
recommendation for the award of these funds. Four key activities were approved by the CDC for CARES Act funds; emergency rental assistance,
employment -related services, childcare related to employment, and youth education/tutoring services. Emergency rental assistance activities address
the consolidated plan goal for affordable housing. Childcare and employment -related services address the consolidated plan goal for poverty reduction
and household stabilization. Youth educatlon/tutoring services address the consolidated plan goal for childcare/youth tutoring and mentoring.
A five-day public comment period was held from December 22, 2020 to December 29, 2020. Notice of this public comment period was published in
the Fort Worth Star -Telegram, posted on the City's website, and distributed through the City News and other ongoing communications activities of the
City Community Engagement Office, Any comments received are maintained by the Neighborhood Services Department in accordance with federal
regulations.
A summary of funding recommendations approved by the CDC is provided below. A spreadsheet of funding recommendations is also attached.

appropriated, in the Grants Operating Federal Fund. The Neighborhood Services Department (and Financial Management Services) will be responsible
for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Neighborhood Services Department has the
responsibility to validate the availability of funds. This is a reimbursement grant.
