HomeMy WebLinkAboutOrdinance 26235-06-2023ORDINANCE NO. 26235-06-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $830,554.00, TRANSFERRED FROM AVAILABLE FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE WATER AND SANITARY SEWER REPLACEMENTS CONTRACT 2022 WSM-H (CITY PROJECT NO. 104480); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $830,554.00, transferred from available funds in the Water and Sewer Fund, for the purpose of funding the Water and Sanitary Sewer Replacements Contract 2022 WSM-H (City Project No. 104480). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of an engineering agreement with Visintainer Engineering PLLC, in the amount of $534,179.00, for Water and Sanitary Sewer Replacement Contract 2022 WSM-H project; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $830,554.00, transferred from available funds within the Water and Sewer Fund, for the Water and Sanitary Sewer Replacements Contract 2022 WSM-H project (City Project No. 104480) to effect a portion of Water's contribution to Fiscal Years 2023-2027 Capital Improvement Program. This project will have no impact on the Water Department's operating budget when completed. The sewer component of the project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funds for the M&C will come from the Sewer Transfer to Water/Sewer account. Business Equity: Visintainer Engineering PLLC, is in compliance with the City's Business Equity Ordinance by committing to 64 percent MWBE participation on this project. The City's MWBE goal on this project is 10 percent. Additionally, Visintainer Engineering PLLC is a certified M/WBE firm. The project is located in COUNCIL DISTRICT 2. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Water and Sewer Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the W/SS Repl Contract 2022 WSM-H project to support the approval of the above recommendations and execution of the engineering agreement. Prior to any expenditure being incurred, the Water Department has the responsibility of verifying the availability of funds.
