HomeMy WebLinkAboutOrdinance 18674-06-2009Ordinance No. 18674-06-2049 AN ORDINANCE fNCREASCNG ESTIMATED RECEIPTS AND APPROPRIATIONS !N THE GRANTS FUND IN THE AMOUNT OF 813,710,235.OD, SUBJECT TO RECEIPT OF WEATHER1ZATiON ASSISTANCE PROGRAM GRANT FUNDS, FOR THE PURPOSE OF PROVIDING WEATHEREZATION SERVICES TO FORT WORTH HOME OWNERS; PROVIDING FOR A SEVERABILITY CLAUSE: MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES IN CONFLECT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. TEXAS: SECTION 1 That in addition to those amounts aliacated to the various City departments for Fiscal Year 2008-2009, there sha(I also be increased estimated receipts and appropriations in the Grants Fund in the amount of 813,710,235.00, subject to receipt of Weatherization Assistance Program Grant Funds, for the purpose of providing weatherization services to Fart Worth home owners. SECTION 2. That should any pardon, section or part at a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision: opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No, 18283 and all other ordinances and appropriations amending the same except in those instances where thia provisions of this ordinance are in direct conflict with suctr other ordinances and appropriations; in which insfance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repeated. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, Weatherization Assistance Program Grant funds in an amount not to exceed $13,710,235.00 from the Texas Department of Housing and Community Affairs as part of the American Recovery and Reinvestment Act of 2009; 2. Authorize the City Manager to execute two contracts with TDHCA, as follows: Existing Sub-recipient Network Poal $8,026,248A0 Criteria-Based Awards far Entities with Populations Exceeding 75,040 $5.,653,987..00 TC1TA~ $13,710,235.00 3. Authorize the City Manager, or his designee, to amend, extend or renew the contracts in accordance with City policies and regulations upon mutual agreement with the Texas Department of Housing and Community Affairs; 4. Apply indirect cost rates as applicable, far the Grants Fund, in accordance with the Citys Administrative Regulations; 5. The City has operated the WAP for low-income residents since 1982 with grants from the TDHCA .The City is eligible to participate in this new program based on both its population and as an existing sub- recipient. It is applying for both grants in order to maximize weatherizatian services to home owners. Weatherization measures include attic insulation, weather-stripping, caulking, window and door repairs andlar replacement, and other minor repairs. This program allows the expenditure of up to $6,50fl.00 per house. Housing and Economic Development Department staff wiN target 1,500 houses. Contractors will not tae paid until their work is inspected by Housing and Economic Development Department inspectors. Administrative costs are restricted to f+ve percent of the grants based on the total aI(owabie expenditures for the WAP. Interim financing from the General Fund is requested in order to meet the staff costs from the date of award of grants till the execution of the contracts. The program is available in ALt. COtJNCIt. DISTRICTS. FISCAL. INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund. Upon execution of the grant contracts, interim funding w1I be returned to the General Fund.
