HomeMy WebLinkAboutResolution 5766-06-2023A Resolution NO. 5766-06-2023 A RESOLUTION ACCEPTING THE FILING OF A PETITION TO CREATE A NEW PUBLIC IMPROVEMENT DISTRICT TO BE KNOWN AS FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO.22 (VEALE RANCH); SETTING A DATE FOR A PUBLIC HEARING; AUTHORIZING THE PUBLICATION OF NOTICE; AND ENACTING OTHER PROVISIONS RELATED THERETO WHEREAS, on June 5, 2023, the City Council of the City of Fort Worth, Texas ("City Council") received a petition ("Petition") requesting the creation of a public improvement district under Chapter 372, Texas Local Government Code ("Act") to be known as "Fort Worth Public Improvement District No. 22 (Veale Ranch)" ("District"); WHEREAS, the Petition, a copy of which is attached hereto as Exhibit A, has been examined, verified, and found by City staff to meet the requirements of Section 372.005 of the Acv and to be sufficient for consideration by City Council; WHEREAS, the Petition describes the improvements to be financed within the District; WHEREAS, the boundaries of the District are described in the attachments to the Petition and are within both the corporate limits and extraterritorial jurisdiction of the City; WHEREAS, pursuant to the Act, the City Council is required to conduct a public hearing concerning the creation of the District and to provide notice thereof, which notice must be provided in a manner and contain the requisite information specified in the Act; WHEREAS, the City Council finds and determines that, based on its receipt and review of the Petition, the City should proceed with conducting a public hearing concerning the creation of the District and giving notice of such public hearing in the time, form, and manner provided by law; and WHEREAS, the City Council finds and determines that these actions are in the best interest of the residents of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. The recitals set forth above in this Resolution are true and correct and are hereby adopted as findings of the City Council and are incorporated into the body of this Resolution as if fully set forth herein. 2. A public hearing is scheduled to begin at 6:00 pm on Tuesday, August 8, 2023 in the City Council Chamber, City Hall, 200 Texas Street, Fort Worth, Texas to receive public comment on the creation of the District in the area described in the Petition pursuant to the Act. 3. Notice of said public hearing, in the substantially final form presented herewith in Exhibit B, with such changes as may be approved by the City's legal counsel, will be published in a newspaper of general circulation in the City before the 151h day prior to the date of the hearing as required by the Act. 4. Written notice, in the substantially final form presented herewith in Exhibit B, with such changes as may be approved by the City's legal counsel, will be mailed to each property owner as reflected on the tax rolls, of property subject to assessment within the District, before the 151h day prior to the date set for the hearing. 5. The Petition is hereby accepted and approved for filing with the City Secretary for public inspection. 6. In considering the establishment of the District, the City Council reserves the right to set parameters for the District that are lesser in scope than what is requested by the Petition, including, but not limited to, setting an assessment area that is less than the proposed boundaries stated by the notice and in the Petition; limiting the types of improvements that may be financed by the District; and prescribing restrictions on obligations of indebtedness that may be issued for improvements. 7. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551 of the Texas Government Code. (collectively the "Petitioners"), the owners of certain taxable real property described in Exhibit "A" attached hereto and incorporated herein by reference, who hereby petition the City of Fort Worth, Texas ("City"), to conduct a public hearing on this Petition and to create a public improvement district pursuant to Section 3 72.005 of the Texas Local Government Code, as amended, to be known as "Veale Ranch Public Improvement District" (the "District"). In support of the same, Petitioners respectfully show the following: The boundaries of the proposed District are set forth in Exhibit "A" attached hereto. All of such land is located within the corporate limits of the City or its extraterritorial jurisdiction. II. The general nature of the proposed improvements (the "Improvements") are: (i) acquisition, construction, and improvement of water, wastewater, and drainage facilities and improvements; (ii) acquiring, constructing, improving, widening, narrowing, closing, and rerouting of sidewalks and of streets, any other roadways, and their rights -of -way; (iii) landscaping; (iv) the establishment and improvement of parks; (v) acquisition, construction, and improvement of off-street parking; (vi) erection of fountains, distinctive lighting, and signs; (vii) construction and improvement of pedestrian malls; (viii) acquisition and installation of pieces of art; (ix) acquisition, construction and improvement of libraries; (x) acquisition, construction, improvement, and rerouting of mass transportation facilities; (xi) projects similar to those listed in (i)-(x); (xii) acquisition, by purchase or otherwise, of real property in connection with an Improvement; (xiii) special supplemental services for improvement and promotion of the District, including services relating to advertising, promotion, health and sanitation, water and wastewater, public safety, security, business recruitment, development, recreation, and cultural enhancement; (xiv) payment of expenses incurred in the establishment, administration, and operation of the District, including the costs of financing the Improvements, and (xv) the development, rehabilitation and expansion of affordable housing. Notwithstanding anything to the contrary, the following will not be considered as Improvements: (a) water lines and sanitary sewer lines having a diameter of 8" or less located in and serving a for sale or rent single-family home, cottage home, and/or townhome residential subdivision; (b) oversizing of water and sanitary sewer lines in and serving residential areas without City approval; and (c) local residential streets, as defined by the Fort Worth Master Thoroughfare Plan. The estimated total cost of the proposed Improvements is $3,000,000,000. ►1/ The City shall levy assessments on each parcel within the District in a manner that results in imposing equal shares of the costs on property similarly benefited. Each assessment may be paid in part or in full at any time (including interest), and certain assessments may be paid in annual installments (including interest). If the City allows an assessment to be paid in installments, then the installments must be paid in amounts necessary to meet annual costs for those Improvements financed by the assessment and must continue for a period necessary to retire the indebtedness on those Improvements (including interest). a All of the costs of the proposed Improvements shall be apportioned to and paid by assessments levied against benefitted property within the District. The City will pay none of the costs of the proposed Improvements. Any remaining costs of the proposed Improvements will be paid from sources other than assessments levied against benefitted property within the District. VI. The Petitioners propose that the District be managed by the City with the assistance of a third - party administrator hired by the City and paid as part of the annual administrative cost of the District. VII. The Petitioners concur in the establishment of the District, are duly authorized, and have the corporate authority, to execute and deliver this Petition. The Petitioners propose that the District be established and managed without the creation of an advisory board; provided, however, that an advisory body may be established to develop and recommend an improvement plan to the City Council of the City. IX. The Petitioners (through authorized representatives) are the owners of taxable real property representing more than fifty percent (50%) of the appraised value of taxable real property liable for assessment under the proposal, as determined by the current roll of the appraisal district of the county in which the property is located; and the record owners of real property liable for assessment under the proposal who: (a) constitute more than fifty percent (50%) of all record owners of property that are liable for assessment under the proposal, and (b) own taxable real property that constitutes more than fifty percent (50°/a) of the area of all taxable real property that is liable for assessment under the proposal. The general nature of the proposed improvements and/or services to be provided in the Veale Ranch PID include the following ("Improvements"): • acquisition, construction, and improvement of water, wastewater, and drainage facilities and improvements; • acquiring, constructing, improving, widening, narrowing, closing, and rerouting of sidewalks and of streets, any other roadways, and their rights -of -way; • landscaping; • the establishment and improvement of parks; • acquisition, construction, and improvement of off-street parking; • erection of fountains, distinctive lighting, and signs; • construction and improvement of pedestrian malls; • acquisition and installation of pieces of art; • acquisition, construction and improvement of libraries; • acquisition, construction, improvement, and rerouting of mass transportation facilities; • projects similar to those listed above; • acquisition, by purchase or otherwise, of real property in connection with an Improvement; • special supplemental services for improvement and promotion of the District, including services relating to advertising, promotion, health and sanitation, water and wastewater, public safety, security, business recruitment, development, recreation, and cultural enhancement; • payment of expenses incurred in the establishment, administration, and operation of the District, including the costs of financing the Improvements, and • the development, rehabilitation and expansion of affordable housing. A preliminary estimate of the cost of the improvements and/or services to be provided in the District is Three Billion Dollars ($3,000,000,000.00). 3. The boundaries of the District are generally north of Bear Creek Drive, east of FM 1187, south of Aledo Road, and west of Hwy 377 S, as more particularly described by a metes and bounds description on file at Fort Worth City Hall and available for public inspection. 4. The City will not be obligated to provide any funds to finance the proposed improvements, other than from assessments levied on the District property. No City property will be assessed, and the City will not be obligated to pay any assessments levied against the property in the District or to pay debt service on any bonds issued by the City and secured by assessments levied against the property in the District in accordance with the assessment methodology approved by the City Council. 5. The City will levy assessments on each parcel within the District in a manner that results in imposing equal shares of the costs on property similarly benefited. Each assessment may be paid in part or in full at any time (including interest), and certain assessments may be paid in annual installments (including interest). If the City allows an assessment to be paid in installments, then the installments must be paid in amounts necessary to meet annual costs for those Improvements financed by the assessment and must continue for a period necessary to retire the indebtedness on those Improvements (including interest).
