CONTRACT NO,
COUNTY OF TARRANT
WHEREAS, on the 11th day of August, 1986, the City of Fort
Worth and Leonard's Technical Services, Inc. , made and entered into
City Secretary Contract No. 15187, which was duly authorized by the
City Council by M&C C-9779 on July 29, 1986; and
WHEREAS, it has become necessary to expand the design services
contract covering the widening of Bryant Irvin Road from Camp Bowie
Boulevard to Calmont Avenue; and
WHEREAS, the City of Fort Worth and Leonard's Technical
Services, Inc., desire to amend said City Secretary Contract
No. 15187, so as to include therein the necessary realignment of
Bryant Irvin Road and other design changes;
NOW, THEREFORE, KNOW
ALL MEN BY THESE PRESENTS:
That the City of Fort Worth, a municipal corporation situated
in Tarrant County, Texas, acting herein by and through Douglas
Harman, its duly authorized City Manager, hereinafter called "CITY",
and Leonard's Technical Services, Inc., acting herein by and through
Willie C. Leonard, its duly authorized President, hereinafter called
"Consultant", hereby make and enter into the following agreement:

City Secretary Contract No. 15187, on file in the office of the
City Secretary of the City of Fort Worth, is hereby amended by
substituting the following in lieu of Section 1 of Article I, of
15187, and after such amendment, Section 1 of Article I, of said
City Secretary Contract No. 15187 shall read as follows, to wit:
"ARTICLE I
"SERVICES
"Section 1. For and in consideration of the covenants herein
contained, Consultant hereby covenants and agrees as an independent
contractor, to perform the services hereinafter described with
diligence and in accordance with the highest professional standards
customarily obtained for such services in the State of Texas. The
services to be performed by Consultant hereunder shall include all
necessary design and engineering work for improvements in connection
with the following projects and locations:
"Widening and repaving of Bryant Irvin Road (North) from Camp
Bowie Boulevard to Calmont Avenue in the City of Fort Worth,
Texas. The Consultant shall develop the City's preliminary
drawing, File No. K-1015, to widen the street from 301 to 44'
with k left-turn lane on the approach to Camp Bowie Boulevard,
and to replace the existing HMAC pavement and concrete curb and
gutter with a 7" reinforced concrete pavement, stabilized
subgrade and 7" concrete curb. The Consultant shall include, in
the design, adjustments to driveways, sidewalks, intersecting
streets and such other features as set forth below. The
Consultant's work shall be performed by, or under the direct
supervision o , a Professional Engineer licensed in the State
of Texas who will affix his seal to each drawing originating in
the Consultant's offices.
"The Consultant shall provide designs to modify the traffic
island at the southwest corner of Camp Bowie Boulevard and
Bryant Irvin Road and thi special curb inlet at the northeast
corner of the same intersection. The Consultant shall also
prepare a set of drawings showing a comparison of the alignment
of the original plan (File-No. K-1015) with the alignment o an
alternative plan proposed by the West Side Neighborhood
Association.

"After review of the alternative plan, the Consultant shall
revise the drawings to align the proposed centerline and
proposed curb lines of the widened Bryant Irvin Road two feet
eastward. The Consultant shall modify the proposed drainage
facilities, as necessary, and shall recess all new inlets on
Bryant Irvin Road. The Consultant shall provide a 5-foot wide
sidewalk along the east side of Bryant Irvin for its entire
length except between Camp Bowie and Lovell Avenue where the
sidewalk shall be the full width of the parkway. The Consultant
shall check the grades of all driveways to ensure that they are
workable; where the driveways are too steep to be workable, the
Consultant shall change the vertical alignment of the street to
correct the situation. The Consultant shall ensure proper
surface drainage of cross streets at locations where the
vertical alignment of Bryant Irvin Road is changed. The
Consultant will revise the specifications and bidding documents
as required, and will provide descriptions for the additional
right-of-way and easements on the approach to Camp Bowie
Boulevard."

City Secretary Contract too. 15187, on file in the office of the
City Secretary of the City of Fort Worth is hereby amended by
substituting the following in lieu of Article II thereof, and after
such amendment, Article II of said City Secretary Contract No. 15187
shall read as follows, to wit:
"ARTICLE II
"COMPENSATION
"For all engineering services performed hereunder, local
travel, supplies and incidentals the City agrees to pay the Engineer
a fee in the amount equal to 1.91 times the salary cost of its
employees engaged on the project. Salary Cost shall be equal to the
cost of salaries of employees' time directly chargeable to the
project, plus 31.01 for social security contributions, unemployment,
excise and payroll taxes, unemployment compensation insurance,
retirement benefits, medical and insurance benefits, sick leave,
vacation, and holiday pay applicable thereto.
°The following hourly salary rates shall apply to this
contract:

Project Manager $18.00/Hour
Engineer $18.00/Hour
Senior Technical Designer $14.00/flour
Design Draftsperson $ 9.50/Hour
Draftsperson $ 7.00/Hour
Clerical $ 6.50/Hour
"The City shall pay the Engineer for all subcontract work
authorized by the City at the actual invoice cost talus ten percent
( 10%). The City shall pay the Engineer for reproduction work at the
current commercial rates.
"In no event shall the payment by the City for all work and
services performed hereunder exceed the total sum of $$19,945.00.
"Method of Payment
"Partial payment shall be made monthly upon receipt of an
invoice from the Engineer outlining the amount of hours worked
by each employee and the employee's salary rate along with
itemized charges for any reproduction and survey work performed
during the period covered by said invoice.

"The aggregate of such monthly partial payments shall not
exceed the following.
"Until satisfactory completion of Phase 1 hereunder, a suns not
to exceed 2514 of the maximum fee.
"Until satisfactory completion of Phase 2 hereunder, a sum not
to exceed 55% of the maximum fee, less previous payments.
"Until satisfactory completion of Phase 3 hereunder, a sum not
to exceed 70% of the maximum fee, less previous payments.
"Until satisfactory completion of Phase 4 hereunder, a sum not
to exceed 95% of the maximum fee, less previous payments.
"Balance of earnings to be due and payable upon satisfactory
completion of Phase 4."

All other provisions, covenants, recitals, terms and conditions
of City Secretary Contract No. 15187, on file in the office of the
City Secretary of the City of Fort Worth, which are not expressly
amended herein, shall remain in full force and effect.
IN ITNESS WHEREOF, the parties hereby have exe this

RECOMMENDATION
It is recommended that the City Council :
1. authorize the following bond fund transfer:

2. authorize the City Manager to execute an amendment to City Secretary
Contract No. 15187 with Leonard' s Technical Services,--Inc. for additional
drafting and design services in connection the widening and repaving
of Bryant Irvin Road (N) from Camp Bowie Boulevard to Calmont Street, in-
creasing the maximum allowable fee by $4,945, from $15,000 to $19,945.
BACKGROUND
The 1986-1988 Capital Improvement Program included a project to widen and

repave Bryant Irvin Road (N) between Camp Bowie Boulevard and Calmont Street.
The City's staff completed the conceptual study and preliminary layout phases
of the proposed work. On July 29, 1986 (M&C C-9779) , the City Council
authorized the City Manager to execute a contract with Leonard's Technical
Services, Inc. (LTS) to develop the City' s preliminary plan into final plans
and specifications suitable for requesting bids.
Owners of properties abutting Bryant Irvin Road (N) were invited to review the
plan and to offer suggestions and comments. The plan was favorably received and
right-of-way acquisition along the west side of the road was initiated.
However, when Council approval was sought for the acquisition of the first
parcels, the Westside Neighborhood Association, on behalf of the property
owners on the west side of the street, interposed objections. The Association
suggested an alternative plan which would require right-of-way only for the
turn 'lane at the Camp Bowie end of the project.
DISCUSSION
The City's staff has reviewed the alternative plan suggested by the Westside
Neighborhood Association and has verified that it is feasible. The owners of
the abutting properties were again invited to review the new plan, but the
results were inconclusive. After careful consideration, staff believes that the
alternative plan which would widen the street equally on each side but which
would provide for narrower-than-no , al parkways should be developed.

LTS has agreed to revise the drawings so as to provide a new horizontal align-
ment, change the vertical alignment so that all driveways are workable, and
modify the storm drainage facilities as required for a contract price increase
of $4,945. The staff considers this price increase to be fair and reasonable
for the work involved.
PROJECT FINANCING
A bond fund transfer in the amount of $4,945 will be necessary from Street
Improvements Fund 30, Account No. 095901-00, Engineering Unspecified, (in which
sufficient funds are available) to Account No. 023188-00, Bryant-Irvin Road to
finance the work. The expenditure will be made from Index Code 680397.
