CL (_u 1,308 City of Fort Worth, Texas Mayor and Council t i r DATE REFERENCE Acquisition of Property- PAGIF SUBJECT: Ac NUMBR 3/19/85 **L-E8406 Southeast Landfill Site j 2 Name and Description of PE2.JeSt Southeast Landfill Expansion. On February 3, 1981 (M&C C-5519), the City Council authorized the City Manager to contract with the firm of Freese-Nichols to perform an engineering study on the southeast landfill site. The study was completed in April 1981, and it was recommended in the report that additional land situated immediately south of the present site be acquired for expansion. On May 11, 1982 (M&C C-6292), the City Council authorized a contract for the design of facilities. These contracts were funded from general fund accounts subject to the successful passing of Proposition No. 3 in the May 22, 1982, Bond Issue. In Executive Session on February 8, 1983, the Council authorized the acquisition of additional land area. Required for this project is a 6.5 acre tract of land out of the southeast cor- ner of Block 44, Shelby County School Land Survey, Abstract No. 1373. The south line of this parcel of land extends west from the southeast corner of said Block 44 a distance of 890 feet, the northerly line follows the meanderings of Village Creek in a northeasterly direction to a point in the east line of Block 44, said point being approximately 326-02 feet north of the southeast corner of Block 44. Also required are two construction easements: CE-3 being a strip of land out of Block 44 of varying widths, lying north of Village Creek, the southerly line of which is common with the northerly line of the above described tract of land, and is 200 feet wide on the east end and 130 feet wide on the west end. CE-2 is a triangular shaped parcel of land out of Block s44, the south line being common with the north line of the above described CE-3 for a distance of 338-02 feet, beginning in the east line of Block 44; and the hypotenuse is 355-15 feet in length, and the east line is 113-78 feet in length. The Real Property Division has negotiated a proposed exchange With Esco Elevators, Inc. , the owners of the above described property, whereby they will convey fee simple title to the City to the 6.5 acre tract of land, and they will grant easement rights to CE-2 and CE-3, and they will pay to the City $18,000-00 cash boot. In exchange the City will convey fee simple title to a 12-acre tract of City-owned land to Esco Elevators, Inc. This tract of !-Pnd adjons their property to the north, designated as Tract 1-A, Block 44, Shelby County School Land Survey, Abstract No. 1375, and was originally purchased for the landfill site; however, the State would not approve the site location for landfill use, therefore, it is now surplus to the City's needs. Pursuant to the requirements of Article 5421c-12, Texas Revised Civil Statutes, notice must be published in the City's official newspaper that the City-owned land is in offered for sale or exchange to the general public, its description, its loca- tion and the procedures under which sealed bids to purchase the land or offers to trade for the land may be submitted. Such an advertisement has been drafted by the Department of Law for appropriate publication. City Council approve the advertisement of the exchange of Tract 1-A, Block 44, Shelby County School Land Surrey, Abstract no. 1375, consisting of 12 acres of land, in return for the required 6.5-acre tract of land to be conveyed to the City, easement rights to CE-2 and CE-3 plus $18,000 cash boot. 2. Tract 1-A, Block 44, Shelby County School Land Survey, Abstract No. 1375, be declared surplus to the City's needs. 3. Upon the acceptance of an appropriate sealed bid for the exchange of land on terms most favorable to the City of Fort Worth for this project, the Mayor be authorized to execute the appropriate deed conveying the City's surplus land in exchange for the required Southeast Landfill expansion property. 4. The City of Fort Worth accept the property required for such expansion of its landfill. 5.
