DESCRIPTION OF DISTRIBUTION FACILITIES
Relocate 7 overhead spans of primary to underground conduits provided by customer, remove
7 poles, install 2 new poles, install PMS-7 and splice can on customer provided concrete
pads, install transformer on customer provided concrete pad, and pull new conductors in
customer provided conduit to complete loop to above. Customer will secure permission and
convert the overhead service to underground service for the Texas Gardens Club Building.
1. Texas Electric Service Company agrees to install, own, operate, and maintain distribution
facilities (electric lines and other equipment) necessary to provide electric service to
Customer at the above service address.
2. Upon execution of this agreement, Customer agrees to pay Company the amount specified
above in consideration of Company's making an investment in distribution facilities that is
in excess of the investment justified by the expected electric service revenue from the
facilities.
3. It is agreed that Company is entitled to and will retain for its use and benefit the amount
specified above in consideration of.its obligation to install the distribution facilities.
4. Company at all times has title to, and complete ownership and control of, the distribution
facilities installed under this agreement and has the right to use such facilities in serving
other customers.
5. Company is not liable for loss or injury caused by delay or failure to install the distribution
facilities necessary to serve Customer because of delay in receiving shipments of required
material, orders or formal requests of governmental agencies, acts of God or the public
enemy, inevitable accidents, fire, explosions, strikes, riots, war, or any other causes reas-
onably beyond control of Company. If Company is prevented from installing such distribu-
tion facilities by any of the above causes, Company agrees to return to Customer, without
interest, the entire amount of Customer's payment, thereby terminating this agreement antle

6. The Cost Estimate of $29,067.00 is quoted until 3-02-88.

Recommendation
It is recommended that the City Council :
1 ) Rescind approval of M&C C-10503 (September 8, 1987); and
2) Authorize the City Manager to enter into an agreement with TU Electric to
provide underground electric service in the Botanic Gardens for an amount
not to exceed $29,067.
Discussion
On September 8, 1987 (M&C C-10503) , the Council authorized the City Manager to
enter into an agreement with TU Electric to provide underground electric
service in the Botanic Gardens for an amount not to exceed $26,526. Before
that contract could be legally finalized, TU Electric' s costs for the project
increased to $29,067, resulting in a contract increase of $2,541. It is
recommended that the City Council authorize the City Manager to enter into an
agreement with TU Electric to provide the service for $29,067.
Overhead lines exist in the area of the new Botanic Gardens Center and
Conservatory. This condition is not compatible with the general theme of the
gardens. There are also conflicts with future improvements including the
Memorial Lecture Center which is under construction at this time, additional
parking areas, and proposed garden features.
Scope of Work
TU Electric will install approximately 2,500 linear feet of underground primary
cable, remove seven poles, install two new poles , and install three pad-mounted
transformers. The City will be responsible for trenching, installing new
conduit for underground cable, and connecting the new services to the Texas
Garden Club Building.
Financing
Sufficient funds are available for this project in Special Trust Fund 72,
Account No. 502101-01, Botanic Gardens. Work performed by TU Electric will
cost $29,067. Work performed by the City is estimated to cost $12,500. Total
funds necessary for the project will be $41,567. Expenditure will be made from
Index Code 600122.
