HomeMy WebLinkAboutContract 59347-A1CSC No. 59347-A1 TEXAS DEPARTMENT OF TRANSPORTATION AIRPORT PROJECT PARTICIPATION AGREEMENT (Federally Assisted Airport Development) TxDOT Project No.: 2302SPINK Commission Approval: April 27, 2023 NPE Funds Applied: FY 23 UEI: ENS6MKS1ZL18 ALN: 20.106 Amendment No. 01 to the Agreement Part I - Identification of the Project TO: City of Fort Worth, Texas FROM: The State of Texas, acting through the Texas Department of Transportation City of Fort Worth, Texas, hereinafter referred to as the "Sponsor," and the Texas Department of Transportation, hereinafter referred to as the "State," have entered into an Airport Project Participation Agreement TxDOT CSJ Number 2302SPINK, executed by the Sponsor on April 4, 2023, and by the State on May 1, 2023, for the development of Fort Worth Spinks Airport, hereinafter referred to as the "Airport". The project is described as construction services to: construct hangar access taxilanes northeast side of the airport at Fort Worth Spinks Airport. It is in the mutual interest of the Sponsor and the State to increase the agreement by $404,780 based on bids. $403,260 of the total project cost will be for additive alternate 1. This will be funded at 75/25. Part II - Offer of Financial Assistance, estimates total project costs to be $1,387,400; and financial assistance is currently limited to $1,248,660 in federal funds and $138,740 in local sponsor funds. The following amendment to the Airport Project Participation Agreement shall become effective upon execution of this Amendment by the Sponsor and the State. The Airport Project Participation Agreement is amended as follows: 1. On Part II, Item No. 2 of the Agreement, change Amount A, estimated total construction costs, and any further references in the Agreement to Amount A, to $1,792,180. On Part II, Item No. 2 of the Agreement, change Amount B, estimated construction costs eligible for federal financial assistance, and any further references in the Agreement to Amount B, to $1,792,180. 3. On Part II, Item 3 of the Agreement, change Amount C, the maximum obligation of the United States payable under this offer, and any further references in the Agreement to Amount C, to $1,552,473. 4. On Part II, Item 4 of the Agreement, change Amount D, Sponsor's share of the estimated construction costs, and any further references in the Agreement to Amount D, to $239,707. All other terms and conditions of the agreement are unchanged and remain in full force and effect. This Amendment to the Airport Project Participation Agreement between City of Fort Worth, Texas, and the Texas Department of Transportation is mutually agreed to and accepted. Authorize execution of Amendment No. 1 to the Grant Agreement with Texas Department of Transportation for the East Side Hangar Access Taxilane project in an amount up to $404,780.00 at Fort Worth Spinks Airport; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Muni Airport Grants Federal Fund in an amount up to (1) $303,813.00 subject to receipt of the grant, and (2) $100,967.00 as a transfer from the Municipal Airport Capital Projects Fund to satisfy the City's match requirement, totaling $404,780.00 for the purpose of funding the East Side Hangar Access Taxilane project (City Project No.104902). DISCUSSION: On August 3, 2021, Mayor and Council Communication (M&C) 21-0536, City Council authorized the application for and acceptance of a grant from the Federal Aviation Administration (FAA), passed through the State of Texas, being represented by the Texas Department of Transportation, Aviation Division (TxDOT), for development of taxilanes (Project) at Fort Worth Spinks Airport (Airport). This M&C also adopted Resolution No. 5431-08-2021, which allowed for the execution of grant related agreements for the Project. On April 4, 2023, City Secretary Contract 59347 (Contract) was executed with TxDOT accepting grant funds for the construction of the Project. On June 6, 2023, TxDOT informed the Aviation Department that additional funding was necessary for construction and construction services of the Project, and that execution of an amendment will be needed. Amendment No. 1 (Amendment) will increase the construction total of the grant by $404,780.00, bringing the grant total amount for construction and construction services of the Project from $1,387,400.00 to $1,792,180.00. The City's match requirement and total share for the construction and construction services of the Project will be $239,707.00. The original $138,740.00 for the City's match requirement was at a 90/10 cost split, and the City's match requirement for the Amendment amount of $100,967.00 is at a 75/25 cost split. This Project was advertised with the first two taxilanes as the Base Bid, and the third taxilane as Additive Alternate 1. Both the Base Bid and Additive Alternate 1 will be awarded. Funding is budgeted in the Municipal Airport Capital Proj Fund for the transfer into the Muni Airport Grants Federal Fund for the purpose of funding the FWS 2302SPINK NE Side Hangar project, as appropriated. Fort Worth Spinks Airport is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Muni Airport Grants Federal Fund. The Aviation Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Aviation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
