AN ORDINANCE VACATING AND EXTINGUISHING A 16 FOOT WIDE
ALLEY, LOCATED IN BLOCK 65, CHAMBERLAIN ARLINGTON
HEIGHTS SECOND FILING, AN ADDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS ACCORDING TO THE PLAT
RECORDED IN VOLUME 63, PAGE 40 OF THE DEED RECORDS OF
TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 7,967
SQUARE FEET OF LAND; PROVIDING FOR REVERSION OF FEE IN
SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL
EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a sixteen foot wide alley, located in Block 65, Chamberlin Arlington Heights Second
Filing, an addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof
recorded in Volume 63, Page 40 of the Plat Records of Tarrant County, Texas, and containing
approximately 2,390 square feet or 0.0549 acres of land and 5,577 square feet or 0.1280 acres of
land, respectively, and as more specifically described in Exhibits A and B attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above -described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

CITY OF FORT WORTH, TARRANT COUNTY, TEXAS
BEING a tract of land situated in the Hays Covington Survey, Abstract No. 256, City of Fort Worth,
Tarrant County, Texas, being all of the 16.00 foot wide Alley of Block 65, Chamberlin Arlington
Heights Second Filing, an addition to the City of Fort Worth, Tarrant County, Texas, according to
the plat recorded in Volume 63, Page 40, Plat Records, Tarrant County, Texas, and being more
particularly described by metes and bounds as follows:
COMMENCING at a point for the southwest corner of Lot 21, Block 65, at the intersection of the
north right-of-way line of Kilpatrick Avenue (formerly known as 231 Street), an 80.00 foot wide
right-of-way, and the east right-of-way line of Faron Street (formerly known as 151h Street), a 60.00
foot wide right-of-way, from which a 5/8" iron rod found bears South 05°06'47" East, a distance of
0.37 feet; THENCE North 00°01'10" East, with the west line of said Lot 21 and the east right-of-
way line of said Faron Street, a distance of 125.00 feet to a point for the northwest corner of said
Lot 21, the southwest corner of said Alley and the POINT OF BEGINNING;
THENCE North 0°01'10" East, with the east right-of-way line of said Faron Street, a distance of
16.00 feet to a point for the northwest corner of said Alley and the southwest corner of Lot 20 of
said Block 65;
THENCE South 89°58'37" East, departing the east right-of-way line of said Faron Street and with
the common line of Lots 20 through 15 of said Block 65 and said Alley, a distance of 149.39 feet
to a point for the southeast corner of said Lot 15 and the southwest corner of Lot 14 of said Block
65;
THENCE South 0'01'10" West, over and across said Alley, a distance of 16.00 feet to a point for
the northeast corner of Lot 26, the northwest corner of Lot 27 of said Block 65 and in the south
line of said Alley, from which a 1/2" iron rod found bears South 25°42'46" East, a distance of 1.04
feet;
THENCE North 89058'37" West, with the common line of Lots 26 through 21 of said Block 65 and
said Alley, a distance of 149.39 feet to the POINT OF BEGINNING and containing 2,390 Square
Feet or 0.0549 of an Acre of Land, more or less.

SUBJECT
(CD 3) Adopt Ordinance Vacating an Alley in Block 65, Chamberlin Arlington Heights 2nd Filing to be Replatted with the Adjoining Property for a
Private School for Rivertree Academy.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley in Block 65, Chamberlin Arlington Heights 2nd Filing to be replatted with the adjoining property
for a private school for Rivertree Academy; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
MMA, on behalf of Rivertree RE Holdings I, LLC, has requested vacation of this alley to be replatted with the adjoining property for a private school.
The City Plan Commission recommended approval of this request at its meetings on December 16, 2022 and February 8, 2023. An acceptable
final plat (FS-23-079) has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat dedication. The City does not own any fee interest in
the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
