HomeMy WebLinkAboutContract 55613-R2CSC No. 55613-R2 SECOND RENEWAL OF CITY SECRETARY CONTRACT NUMBER 55613 AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH AND TEXAS PARKS AND WILDLIFE DEPARTMENT This SECOND RENEWAL ("Second Renewal") is made and entered into by and between the CITY OF FORT WORTH ("City"), a home -rule municipal corporation and TEXAS PARKS AND WILDLIFE DEPARTMENT, a Department of the State of Texas acting by and through its duly authorized representative ("Licensee"). The City and Licensee are referred to herein individually as a ("Party") and collectively as the ("Parties"). WHEREAS, on April 1, 2021, the Parties entered into an Interlocal Agreement for Licensee to research, monitor, and protect urban -dwelling species by installing non-invasive cameras to trees found in various City -owned properties, as further described in Exhibit A attached hereto, the same being City Secretary Contract ("CSC") Number 55613 ("Agreement"); WHEREAS, the Agreement provides a primary term of one-year and four (4) one-year renewal periods (each a "Renewal Term"); WHEREAS, on March 23, 2022, the First Renewal option was exercised to extend the term of the Agreement for a one-year period ("Renewal Term"); WHEREAS, the First Renewal Term expired on March 31, 2023; WHEREAS, it is the collective desire of the Parties to exercise the Second Renewal Term; and NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the City and Licensee agree to renew and extend the Agreement as follows: I. The City and Licensee hereby agree to renew and extend the Agreement for a one-year period, effective beginning on April 1, 2023 and expiring on March 31, 2024 ("Second Renewal Term"); II. 1. All terms in this Second Renewal that are capitalized but not defined shall have the same meanings assigned to them in the Agreement; 2. All terms and conditions of the Agreement that are not expressly amended pursuant to this Second Renewal shall remain in full force and effect.
