UEEREAS, the City of For, Worth has developed an Emergency
Management Plan pursuant to the 'texas Disaster Act of 075, Texas
Government Code, Chapter 419 (the "Act" ) ; and
WHEREAS, the member jurisdictions have, bly action of the
governing bodies of each, agreed to become an inter•jurisda;ct anal
agency- for emergency management and disaster relief planning
according to the terms of said Act; and
WHEREAS, the City of Fort: Worth and Tarrant County are
responsible for emergency management and disaster zeli.ef planni
and education within the corporate limits of Fort Worth and in.
the unincorporated areas of the County, respectively; and
WHEREAS, it is the desire of bath parties to agree to the
terms under Mich Fort Worth will provide services relati.vV'ttr

As payment for services rex-, Iered under the terInS Of.' �hAXS-
agreement, the County shall pay 'the City. Out of current
available the s= equal to 17-1/3 percent ol: the approved bud-ge..
for the Office of Emergency Management , with 33-2/3 p---4rce-vt
provided Jay City Funds and the remaining 49 percent provided by
federal/state matching funds. Payment by the County of the above
sum shall be made, in four equal quarterly payments followkaq
receipt of a quarterly report submitted by the City specifVYine-I
all activities and services delivered to Ccunty during the
quarter.
3.
This agreement shall remain in effect until terminated by
either party by giving to the other party ninety ( 9.0) days '
written notice of its intent so to terminate. The City will

z epare and submit annually to County a proposed budget as
documentation of antIcipated exr,.ienditures by July 1st of each
year.

Each jurisdiction waives all claims against the other, f or
property damage, personal injury or death occurring as. A
consequence of -C.-he performance of this agreement.

organization, public or private, located in the county..

county during the quarter.

RECOMMENDATION:

. � It is recoinmended that the City Council adopt an amended agreement for the
l provision of emergency management and disaster relief planning services to
Tarrant County.
DISCUSSION:
ZION:
The Tenas Disaster Act of 1976 (Texas Government Code, Chapter 418) allows
county and municipal governments to enter into interjurisdictional agreements
for the provision of emergency management and disaster relief planning. On
September 9, 1986, City Council adopted a joint resolution and authorized the
execution of an interjurisdictional agreement establishing the Fart Worth-
Tarrant County Interjurisdictional Agency for Emergency Management QC C-
�a 9848) . The September 9, 1986, resolution was superseded by one signed June 1,,
k r. 1989, by Mayor Bolen on behalf of the City as authorized by Ordinance 9692
r N � (Code § 13-'40) passed August 12, 1986. Exhibit "A" of the attached agreement
specifies the services to be provided the County by the Office of Emergency
Management.

The original terms of the agreement specified that it be renewed annually. Due
aa; to the nature of the services provided, it is felt by the Office of Emergency
I Management and the County that the annual renewal clause be amended so that the
agreement may remain in effect until terminat=.-d by either party by ;diving 90
I ` days written notice. Additionally, the amended contract: changes the date the
City is required to submit a proposed budget for Emergency Management to the
- County frog May to July.
The amended agreement retains the original formula for payment of services

with ,the County Paying the City the suns equal to 17 - 1/3 percent of the
approved budget of the Office of Emergency Management. Federal and State
' matching "funds reimburse 49 percent of eligible operations, and the remaining
