HomeMy WebLinkAboutOrdinance 17269-11-2006ORDINANCE NO. 17269-11-2005 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF TAYLOR STREET BETWEEN BELKNAP STREET AND WEST 3~° STREET, LOCATED ADJACENT TO BLOCK 17, ORIGINAL TOWN OF FORT WORTH AND BLOCK 18R, FORT WORTH ORIGINAL TOWN ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS AS RECORDED IN VOLUME 38~-110 PAGE 97 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS CONTAINING APPROXIMATELY 53,400 SQUARE FEET, OR 1.2259 ACRES OF LAND; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITI~I; AND PROVIDING AN EFFECTIVE DATE. IIE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTI®N 1. That a portion of Taylor Street, between Belknap Street and West 3rd Street, located adjacent to Block 17, Original Town of Fort Worth, and Block 1$R, Fort Worth Original Town Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 3$$-110, Page 97 of the Plat Records of Tarrant County, Texas, containing 53,400 square feet, or 1.2259 acres of land more or less, and as more specifically described in Exhibit "1 ", " 2" and " 3" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTI®N ~. That this ordinance shall take effect upon the frling and recording of plat FS-06-135, as described in Exhibit 3 or by December 31, 2006, whichever is sooner. Adopt an ordinance vacating a portion of Taylor Street between Belknap Street and West 3rd Street, located in Block 17 Original Town of Fort Worth and Black 18R ,Fort Worth Original Town Addition, Fort Worth, Texas, as recorded in Volume 3$8-110, Page 97, of the P.R.T.C.T., containing approximately 53,400 square feet, or 1.2259 acres of land. 2. Waive the purchase fee of $3,778,557.30. DISCUSSION: Piburn and Partners, LLC., on behalf of PNL Fart Worth LP, Fart Werth, Texas, has requested the above referenced vacation in order to reuse it as a street easement. Reviewing City departments and public utilify companies have raised nn objections to this request. The City Plan Commission recommended approval of this request at its meeting an June 28, 2006. Any existing utilities will be relocated at the applicant's expense. An acceptable replat (FS-06-135) has been received. The Engineering Department, Real Property Services Division, states that the purchase fee of $3,778,557.30 has not been received and the Development staff Administrator's office has requested waiver of this fee as the right-af-way was originally acquired by plat dedication. City staff recommends waiver of the purchase price. The right-af-way was dedicated and there is no evidence that public funds were expended for the acquisition. This request is in COUNCIL DISTRICT 9. FISCAI- INFORMATIONICERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
