TIE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Throckmorton Street, between West Weatherford Street and West 3rd Street, located adjacent to Block 18R, Fort Worth Original Town Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 388-110, Page 97 of the Plat Records of Tarrant County, Texas, containing 41,280 square feet, or 0.9477 acres of land more or less, and as more speciFically described in Exhibit "1 ", " 2" and " 3" attached hereto a~ad incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon the filing and recording of plat FS-06-135, as described in Exhibit 3 or by December 31, 2006, whichever is sooner. PZ-2704 SUBJECT: Adapt an Ordinance Vacating a Portion of Throckmorton Street between West Weatherford and West 3rd Street, Adjacent to Block 18R; Fart Worfh Original Tawn Addition, Fart Worth, Texas RECOMMEN®ATION: 1. Adapt an ordinance vacating a portion of Thrackmarton Street between West Weatherford and West 3rd Street, located in Blocks 17 and 18R, Fort Worth Original Town Addition, Fort Worth, Texas, as recorded in Volume 388-110, Page 97, of the P.R.T.C.T., containing approximately 41,280 square feet, or 0.948 acres of land. 2. Waive the purchase fee of $3,016,370.00. DISCUSSION: Piburn and Partners, LLC., an behalf of PNL Fort Worth LP, Fort Worth, Texas, has requested the above referenced vacation in order to reuse it as a street easement. Reviewing City departments and public utility companies hairs raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on June 28, 2006. Any existing utilities will be relocated at the applicant's expense. An acceptable replat (FS-06-135) has been received. The Engineering Department, Real Property Services Division, states that the purchase fee of $3,01&,370.00 has not been received and the Development staff Administrator's office has requested waiver of this fee as the right-of-way was originally acquired by plat dedication. City staff recommends waiver of the purchase price. The right-of-way was dedicated and there is no evidence that public funds were expended for the acquisition. This request is in COUNCIL DISTRICT 9.
