HomeMy WebLinkAboutOrdinance 17272-11-2006Ordinance No. 17272-11-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STREET IMPROVEMENTS FUND IN THE AMOUNT OF $148,400 FROM A TRANSFER FROM THE FUTURE IMPROVEMENTS PROJECTS OF THE SPECIAL ASSESSMENTS FUND FOR THE PURPOSE OF EXECUTING A COMMUNITY FACILITIES AGREEMENT WITH GOLDEN TRIANGLE RETAIL PARTNERS, LIMITED FOR THE INSTALLATION OF A PORTION OF NORTH BEACH STREET BETWEEN GOLDEN TRIANGLE BOULEVARD AND HERITAGE TRACE PARKWAY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Street Improvements Fund in the amount of $148,400 from a transfer from the Future Improvements Projects of the Special Assessments Fund for the purpose of executing a Community Facilities Agreement with Golden Triangle Retail Partners, Limited for the installation of a portion of North Beach Street between Golden Triangle Boulevard and Heritage Trace Parkway SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Assessments Fund in the amount of $148,400.00 from prior developer contributions; 2. Authorize the transfer of $148,400.00 from the Special Assessments Fund to the Street improvements Fund; 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Sfreet Improvements Fund in the amount of $148,400.00 from developer contributions; and 4. Authorize the City Manager to execute a Community Facilities Agreement (CFA} with Golden Triangle Retail Partners, Limited, in the amount of $188,400.00 for the installation of a portion of North Beach Street between Golden Triangle Boulevard and Heritage Trace Parkway. DISCUSSION. North Beach Street is currently constructed as a rural, two-lane asphalt roadway north of Heritage Trace Parkway to Alta Vista Road, where it terminates entirely. Approximately 800' north of the terminus of the asphalt road, North Beach Street continues as a four-lane concrete arterial to Golden Triangle Boulevard. In order to improve traffic operations and site access in the vicinity of the gap, a group of business owners has, without any obligation to do so, executed a proposed contract for the installation of a two-lane concrete roadway through the western half of the existing gap. Heritage Addition, Phase 2E borders North Beach Street from Heritage Trace Parkway north 1500 feet, including a portion of the Beach Street Gap. The developer of Heritage Addition contributed $188,422.50 through a CFA for future improvements to North Beach Street adjacent to his development. The estimated cost of the gap construction adjacent to Heritage Addition is $948,400.00. The remaining $4D,022.50 in future improvement funds collected through the Heritage Addition CFA will be held in escrow for improvements that are adjacent to the development. After having pooled their resources with the future improvement funds from the Heritage Addition Logname: 20BEACHGAP Page 1 of 2 development, Golden Triangle Retail Partners, Ltd. has identified a remaining funding shortfall of approximately $4Q,000.00. Due to the significant benefit to the community represented by the project, staff recommends that the shortfall be funded through the remaining 1998 CIP program City-wide unspecified funds far new development.
