i ti` s ;o t `2 THE STATE OF TEXAS 5 (J 5 CITY SECRETARY 5 CONTRACT NO.: �O COUNTY OF TARRANT 5 AMENDMENT NO. 2 CONTRACT FOR ANIMAL CONTROL KENNELING SERVICES WHEREAS, the City of Fort Worth, Texas (City) and the Humane Society of North Texas, Inc. (Society) made and entered into City Secretary Contract No. 18739, which was authorized by the City Council by M&C - 13059 on the 17th day of September, 1991, and which was amended by City Secretary Contract No. 2p4qZ , which was authorized by the City Council by M&C - 14123, on .the 21st day of December, 1993; and WHEREAS, said contract expires this year, and City and Society each desire to renew said contract for a period of three years, and to amend said contract. regarding services and kenneling fees; and WHEREAS, on the 23A day of �, 1994, the City Council of the City of Fort Worth adopted M&C 54 authorizing the City Manager to execute this contract amendment; NOW THEREFORE, City and Society, acting herein by and through their duly authorized representatives, enter into the following contract amendment: 1. Article II, section E of the contract is amended to read as follows: "E. Society shall house all live animals brought to the Facility by City personnel for a period of three days, exclusive of the day that the animal is delivered to the Facility ( "holding period" ) . Any animal not claimed and redeemed by the owner prior to the expiration of the holding period shall become the sole and exclusive property of the Society. Except for injured animals and animals in rabies quarantine, all animals brought to Facility by City personnel shall be housed in the same area at Facility. Use sequentially numbered control cards provided by the Society to keep track of such animals. The control numbers will be reflected on the monthly invoices to be submitted hereunder. Control numbers will not be issued to nursing animals. " 3. Article II, Section 1. (4) of the contract is amended to read as follows: 111. (4) . Charge fees in accordance with the fee schedule attached hereto as Exhibit "A, " which is made a part hereof for all purposes. Society acknowledges that the fee schedule is subject to the control of the City Council and subject to amendment at any time during the existence of this agreement.; Because the Rabies Control Act mandates that an animal's owner pay all impound and boarding fees before the animal may be released, the Animal Control Division has no authority to reduce fees on a case by case basis, and Society's employees shall not suggest to owners redeeming their pets that they may contact City's Animal Control Division to request a reduction in fees. However, this shall not preclude Society from contributing its own funds to cover such fees for an owner, neither shall it preclude Society employees from referring citizens to the appropriate City department or official in order to. voice suggestions or complaints about any matter concerning animal control. " 4. Article II, Section L of the contract is amended to read as follows: "L. Society shall provide licensed veterinary services to oversee the operation of the Facility. At a minimum, a veterinarian licensed to practice in the State of Texas will be located at the Facility seven. and one half (7.5) hours per week for the purpose of overseeing Society activities provided under this contract. " Amendment No. 2 Page 2 Contract for Animal Control Kenneling Services 5. Article II, Section N of the contract is amended to read as follows: "N. Society shall provide adequate phone lines and sufficient staff to operate the Facility during normal business hours. In addition, Society shall provide an after-hours telephone message service so as to advise owners of operating hours for purposes of redeeming animals. Society shall provide a rollover telephone line that will enable a citizen calling from a rotary phone to reach a Society employee. " 6. Article II, Section T of the contract is amended to read as follows: "T. Society shall provide to City complete and accurate records which track the disposition of every animal delivered to Society by City. " 7 . Article IV, Section 4 .01 of the contract is amended to read as follows: 114.01. During City's fiscal year 1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50) per day per non- quarantined animal animal up to a maximum of three (3) days, exclusive of the date of delivery of the animal to Society by City. 'During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75) . During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00.) . " 8. Article IV, Section 4.02 of the contract is amended. to read as follows: 114.02. During City's fiscal year 1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50) per day per each nonowned animal quarantined for rabies or other such observation at the insistence of the City. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75) . During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00) . 11 Amendment No. 2 Page 3 Contract for Animal Control Kenneling services 9. Article IV, Section 4 .03 of the contract is amended to read as follows: 114 .03. Society agrees to charge a kenneling fee of no more than twelve dollars ($12.00) per day to the owner of any animal d,elivered to Society by City for quarantine. If the animal's owner fails or refuses to take possession of the animal and pay Society the kenneling fee at the conclusion of the quarantine period, City shall pay Society five dollars and fifty cents ($5.50) for each day that the animal was required to be in quarantine, up to a maximum of 10 days, during City's fiscal year 1994-1995. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy- five cents ($5.75) . During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00) . " 10. Article IV, Section 4 .04 of the contract is amended to read as follows: 114 .04. Animals picked up by City for delivery to Society at the request of an owner will become the property of Society upon delivery. Society may euthanize such animal upon delivery. No daily charge shall be made to City; however, during City's fiscal year -1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50) per animal euthanized. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75) . During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00) . Written documentation shall be provided by City prior to euthanization. " Article IV of the contract is amended by the addition of Section 4 .04a which shall read as follows: ' I 114.04a. Wild animals picked up by City and delivered to Society shall become the property of Society upon delivery. Society may euthanize or relocate such animals. City shall pay to Society two dollars ($2.00)per wild animal delivered. " Amendment No. 2 Page 4 Contract for Animal Control Kenneling berv3.ces- 12. Article IV, Section 4.06 of the contract is amended to read as follows: 114 .06. Society shall invoice City on or about the 10th day of each month for amounts owed to Society, such invoice to be due and payable within thirty (30) days after delivery. Each invoice. will reflect the following for each animal delivered by City: a. collar identification number and impoundment form number; b. the date of delivery and, if applicable, the date the animal was reclaimed; C. the date the animal was eutfianized, if applicable; d. the sums of money collected by the Society from an owner reclaiming his/her animal; e all other sums of money collected pursuant to this agreement; and f. the balance, if any, due the Society. " 13. Article VI, Section 6.01 of the contract is amended to read as follows: 116.01. The term of this contract shall be from October lr 1994, through September 30, 1997, dependent upon annual appropriation by City during said term. 14. Article VI, Section 6.02 of the contract is deleted in its entirety. 15. Article X of this contract is deleted in its entirety. Authorize the City Manager to execute a contract amendment to City Secretary Contract No. 18739 with the Humane Society of North Texas, Inc. providing the following fee schedule for kenneling services; (1) $5.50 per animal per day effective October 1, 1994 - September 30, 1995 (2) $5.75 per animal per day effective October 1, 1995 - September 30, 1996 (3) $6.00 per animal per day effective October 1, 1996 - September 30, 1997 2. Authorize the City Manager to execute a contract amendment to City Secretary Contract No. 18739 (see attached) by amending Article Il, Sections E, I.(2) and I.(4), L, N, T; Article IV, Sections 4.01, 4.02, 4.03, 4.04, 4.06; by adding Section 4.04a; by amending Article VI, Section 6.01, by deleting Section 6.02 and Article X in its entirety; and by amending Exhibit "A", Fee Schedule. The contract will be in effect for three years, beginning October 1, 1994 and ending September 30, 1997. DISCUSSION: On September 17, 1991 City Council approved M&C C-13059 authorizing a three year contract with the Humane Society of North Texas for animal kenneling services at the rate of $3.00 per day per animal. On December 21, 1993 City Council approved M&C C-14123 authorizing the City Manager to execute an amended contract with the Humane Society, increasing the kenneling fees from $3.00/day/animal to $4.32/day/animal. This increase became retroactive to October 1, 1993. On June 29, 1994 the Health Department received a written request from the Humane Society to increase kenneling fees from $4.32/day/animal to $5.50/day/animal. On July 21, 1994 both the Humane Society budget and the Animal Control Division budget were reviewed by members of the Animal Shelter Advisory Committee.
