RECOMMENDAFION:
n.
K t> iecufnmende; ti hat the City C:iuncil autharize the City Manager to execute an amendme I
to C=ty Secretary Contract No. 18523 with C'ne Fort Worth Convention and Visitors Bureau as
discusse d below,
V,T.C.A. Tax Code §351.101(a)(5) authorizes a City to use revenue derived from the hotel
occupancy tax for historic restoration and preservation projects. On February 25, 1997, by its
I adoption of M&C C-15915, the City Councii has .,pproved a Facilities and Maintenance
I Agreement v-iiith Blackstone Hotel Partnera, L.P. (Owner), under which the Owner is required,
-ig -e historic facade and interior of the Blackstone
am,ii other things, to re-tare and maintain t1k
Hotel end convey a facade easement t1r b nonprcfiit corporation. In return, the City will pay to
the Owrier over a period of ter, years an annual arnount equal to the !esser of 75% of the hotel
I occupancy tax generatr-L, by the Blackstone and collected by the City (except for the first annual
payment in ojhich t'Oe percentage is 100%), or the arnount of the incremental ad valorem
I property tax due t)e Fort Wor-Lh 1 "or the corresponding year.
The City'P current agreement with the Convention, and Visitors Sureau provides for payment of
certain hotel occupancy tax revenues to the Bureau in return for services rendered, and runs
through September 30, 1998. Since the first annbal payment to the Owner under the Facilities
and Maintenance Agreement is based t_jpon hotei occupancy tax revenues generated by and
collected from the Blackstone in 1997 and 1998, a is necessary to revise the City's agreemen-,
withr the Bureau in order to fund that payment.
IFISICAL.,'INFO RMATIONXERTIFICATION:
The Diremo-of Fiscal Services certifies that execution of the contract amendment will not require
tihe 2,<.-:.:?nditure of City funds.
