Purpose of Agreement " �s ,: To serve as an agreement between the Tarrant County Fort Worth. Workforce Development Board U (Board) and City of Fort Worth (City), describing tl; : transition, of Grant Recipient status to the Board from the City,and the ad=ministration of Job Training Partnership Act(JTPA)Programs in the City ofFott Worth service Delivery Area1Substate Area(SDA)during Program Year 1997(PY97). r`9 It is expressly understood and agreed that enforcement of the terms and conditions of this agreement, N' and all rights of action relating to such enforcement, shall be strictly reserved to the Board and the City, and nothing contained in this agreement shall give or allow any claim or right of action whatsoever by any person other than the Board and the City, It is the express intention of the Hoard and the City that any entity,other than the Board or'he City receiving services or benefits tender this " a,reenient, shall be deerned an incidental beneficiary only. This agreement is not intended to create r r_y rights, liberty interests or entitlemems n favor of any person. The agreement is intended only to set forth the contractual rights and responsibilities of the signatory parties. B. Period of Agreement This Agreement_ shall become effective on July 1, 1997 and shall remain in effect until ,tune 30, 1998. C. Definitions Grant Recipient - the local fiscal agent "responsible and accountable. for the management of all workforce development fonds available to the Board", as provided by Section 2308.303 of the Texas Government Code. This definition includes JTPA Binds. AdministratiN e Entity-the entity, designated to administc `he JTPA job training plan. (Section-t(2), JTPA) Board _Furct�OYIS - includes the functions nd responsibilities dc.:,crihcd for local workforce deg-eloprrent boards in Section 2308.302 cf the Texas Government Code. A partial but representative list of these functions and responsibilities includes: planning and oversight of ail r workforce training and services in the Tarrant County Workforce Development Area (tit'D, evaluation of all workforce development programs in the WD_%; operational planning and administratio , of all workforce training and senliccs 1 Meted through the Texas Workfor-e { { Commission (TWC); ser.=ing as a single point of contact for local business to cooimn ,?nicate their skill needs and influence the direction of all workforce development programs; development of the local plan for addressing workforce development needs in the WDA; assumption of the functions and rrssponsibilities of local workforce development advisory boards, councils, and committees authorized by federal or state laws (including Private Industry Courelk. under the JTPA); and monitoring and evaluation of the effectiveness of the career development centers, state agencies, and contractors providing workforce training and services. ,i D. Compliance With Law Pad ."Iegulatiao The City will operate programs addressed by this Agreement in evnplzance with a applicable 1e federal and State of Texas legislation and regulations;grant agreements and contract provisions; the provisions of this agreement; and amendments to any of the above. 3 E. Acknowledgment of Funding Source The City will acknowledge the Board,by including a printed notice that program funding is received from the Board, in all material:,related to programs governed by this Agreement that are produced for distribution to other entities or to the general public. j F'. Communication The City and Board will act in good faith to inform each other in a timely manner of events and information relevant to programs addressed by this Agreement. On the last Wednesday of each month preceding a meeting of the Board, unless an alternative date is °stablished by the Executive Director of the Board,staff of the City and Board will meet to discuss items to be considered by the Board at its next meeting and other related issues. The City will provide material in support of ite ns to be considered by the Board to the Board staff on or before the last Friday of the month preceding the Board meeting at which the item will be considered. G. Job Training Plans The City has developed and published public notice of the Calendar Yea,, 1997 (C-R' ) I; T: 713 Summer Youth Program Job Training Plan. This plan has been approved by t: Board artd the Mayer of the City of Fort Worth, and has been approved by the T`VC. The City will administer the CY97 Title I113 Summer Youth Program, and will be responsi' ,modifications to the � fle II' Plans through Oc!ober 31, 1997. PY97 Title IIA, IIC, and III Job Training Plans for the SDA, in, e. n 123 Edi cation Coordination Plan Amendments, have been developed jointly ' j ?card, ha,%e beer approved by the Board and Mayor of the City of Fort Worth, anu nm tted ,o TWC for approval for implementation of programs in the SDA beginning 997, The City w", administer PY97 Title IIA, IIC and III Programs, including the Section 11- _ducation Coordination Progi ems, and ivill be responsible for modifications and amen ii-cots to the.lob Training Plans for those programs through October 31, 1.997. IEI. Staff The City will continue to administer and to operate the JTPA prcgrams without disruption of client services. .As the Board hires staff,hiring preference will consistently be granted to applicants that are c,.-xently working within the system, including employees of the TWC, JTPA administrative entities/grant �. recipients, Child Care Manageineiit Services (CCIN1S)/Child Care'Training (CCT)contractors, ai,d temporary employees or contractors that have worked or are working or the Board. This practice will conform with the provisions of Chapter 2308 of the Texas Government Codc and appropriately value current knowledge of the programs with which the Board inust work, in the context of an open job posting and hiring process. Applicants currently employed by the employment and training departments of the City oT Fort Worth and Tarrant County will receive this h .:nb preference. 1. Unexpended Funds From Current Contracts Unexpended JTPA funds from contracts currently in effect between the TWO and the City will Le passed through in their entirety to the City by the Board for use in delivering these programs. .I, Close out of Current Grants The City will be responsible for ail reports, including Close Out Reports, on the City's PY94, PY95, and PY96 contras°.s with the I WC for programs under Titles IIA, IIB, 'IC, III, Section 123 Education :Coordination Programs, and any Rapid Response co-tracts. Copies of all reports will be provided to the Board at the time of submission to TWC. K. Expenditure Reports/Close Out Reportq/Requests for Funds/Other Reporting Requirements The fol'owing provision ap lies to P L 97 Contracts effective July 1, 1997, and to PY94, PY 9ti, and PY96 contracts on the effective date of their reissue to the Board. Other Administrative Costs In the event that the City, in its current capacity as administrative entity or in the future as previous administrative entity or as subcontractor to the Board, is involved in audit resolutions, preparation of final close out repc_,ts, or other actvities related thereto, then the cost of personnel working on audit resolution, preparation of final close out reports, or other activities related thereto are valid costs chargeable to JTPA aY -- th.- Board agrees that such -Prsonnel and other costs will be- reimbursed by the Board,subject to the availability of funds during the contract period in which costs are incurred. S. Amendments This Inter-local Agreement shall be subject to amendment after its approval by the parties hereto. Such amendment must be approl-ad by a majority vcte of the Boarcl and by the Mayor of the City of Fort Worth. In addition, prior to consideration of any amendm-,nt, the amending party shall provide: two weeks written notice to the other parties. This notice shall include proposed amendments(s) an(! the date, time, -nd place when it is proposed tha4 the Board will consider the proposed amendments. After this condition has been satisfied, the Board and City will negotiate the proportion of administrative funds associated with an., additional funding to be passed through to the City. This preportion may vary if the variance is acceptable to both parties. Authorize the C'ity Manager to enter into an Interlocal Agreement with the Tarrant County Workforce Development Board to receive $3,406,896.00 to operate Workforce Career Centers for a period beginining July 1 , 1997, and ending June 30, 1998, and 2. Adopt the attached appropriation ordir.ancp increasing estimated rec•aipts and appropriations ir, the Grant Fund by $3,406,896.00,sub,jaCt to eceipt of the grant. DIS0*USSION: On February 20, 1996, the City Council approved M&C C-115298, w1hich authorized an Interlocal Agreement with the City of Arlh,gton and Tarrant County. The agreement established a Workforce Development System covering all of Tarrant County and the cities thereir. The agreement also provided for the creation of the Workforce Development Board and Workforce Governing Board to implement the agreement. The City of Fort Worth has been the grant recipient -ind administrative entity for the Job Training Partnership Act QTPA) program funds since its inception in 1984. As provided 4 ,r in state law, the Workforce Development Board t,came the grant recipient for all JTPA iunds on July 1 , 1997. The Citv wild continue to be the administrative entity until June 30, 1998., Under the new arrargement, the board will receive JTPA funds that are appropriated for Tarrant County an(! will in turn pass through appropriate amounts to the City and Tarrant County to continue the operation of 9 network of Workforce Career Centers. The pr�,nary functions of the board consists of policy development, resource rri"nagement/aliocation, development of a comprehensive workforce plan and providing for program evaluation an oversight.
