HomeMy WebLinkAboutContract 23724 03-19-98PO4 :35 RCVD AMENDMENT NO 4 CITY SECRETARY ' CONTRACT NO. �ru" CONTRACT FOR ANIMAL CONTROL KENNELING SERVICES WHEREAS, the City of Fort Worth, Texas (City) and the Humane Society of North Texas, Inc. (Society) made and entered into City Secretary Contract No. 18739, which was authorized by the City Council by M&C– 13059 on the 17"'day of September, 1991 and which was amended by City Secretary Contract No. 20498, which was authorized by the City Council by M&C -- 14123, on the 21" day of December, 1993 and which was amended by City Secretary Contract No. 20628, which was authorized by the City Council by M&C –14504 on the 4"' day of October, 1994; and which was amended by City Secretary Contract No. 23143, which was authorized by the City Council by M&C-16298, and WHEREAS, said contract expires on March 31,1998, and City and Society each desire to extend said contract for an additional of four months; and WHEREAS on the l IVZ day of _ tr�� 1998 the City Council of the City of Fort Worth adopted M&6 6 authorizing the City Manager to execute this contract amendment; NOW THEREFORE, City and Society, acting herein by and through their duly authorized representatives, enter into the following contract amendment: 1. Article IV, Section 4.01 of the contract is amended to read as follows "4.01. During City's fiscal year 1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50)'per day per nonquarantined animal up to a maximum of three (3) days, exclusive of the date of delivery of the animal to Society by City. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75). During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00). During City's fiscal year 1997-1998, said fee shall be seven dollars and twenty-five cents ($7.25)." 2. Article IV, Section 4.02 of the contract is amended to read as follows: "4.02. During City's fiscal year 1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50) per day per each nonowned animal quarantined for rabies or other such observation at the insistence of the City. During City's fiscal year 19964997, said fee shall be six dollars ($6.00). During City's fiscal year 1997-1998, said fee shall be seven dollars and twenty-five cents($7.25)." 3. Article IV, Section 4.03 of the contract is amended to read as follows: "4.03. Society agrees to charge a kenneling fee of no more than twelve dollars ($12.00) per day to the owner of any animal delivered to Society by City for quarantine. If the animal's owner fails or refuses to take possession of the animal and pay Society the kenneling fee at the conclusion of the quarantine period, City shall pay Society five dollars and fifty cents ($5.50) for each day that the animal was required to be in quarantine, up to a maximum of 10 days, during City's fiscal year 1994-1995. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75). During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00). During City's fiscal year 1997-1998, said fee shall be seven dollars and twenty-five cents ($7.25)." 4. Article IV, Section 4.04 of the contract is amended to read as follows: "4.04. Animals picked up by City for delivery to Society at the request of an owner will become the property of Society upon delivery. Society may euthanize such animal upon delivery. No daily charge shall be made to the City; however, during City's fiscal year 1994-1995, City agrees to pay Society five dollars and fifty cents ($5.50) per animal euthanized. During City's fiscal year 1995-1996, said fee shall be five dollars and seventy-five cents ($5.75). During City's fiscal year 1996-1997, said fee shall be six dollars ($6.00). During City's fiscal year 1997-1998, said fee shall be seven dollars and twenty-five cents ($7.25). Written documentation shall be provided by City prior to euthanization." 5. Article IV, Section 4.04a of the contract is amended to read as follows: "4.04a. Wild animals picked up the City and delivered to Society shall become the property of Society upon delivery. Society may euthanize or relocate such animals. City shall pay to Society seven dollars and twenty-five cents ($7.25) per wild animal delivered. City agrees, however, to make every attempt to re-locate or euthanize the wildlife before bringing the wild animal to Society. However, City agrees that any wildlife it picks up after 4:00 p.m. will be euthanized or re-located. 6. Amendment No.4 Contract for Animal Control Kenneling Services Page 2 Article IV, Section 4.04b. of the contract is amended to read as follows: "4.04b. Society agrees to charge a recovery fee of no more than seven dollars and twenty-five cents ($7.25)to an owner who reclaims his or her animal on the same day the animal was delivered to Society." 7. Article VI Section 6.01 of the contract is amended to read as follows: "6.01 The term of this contract shall be from October 1, 1994, through July 31, 1998, dependent upon annual appropriation by City during said term. City's Animal Care and Control Facility should be completed and operational by the end of June 1998, however, an extra month has been included in this contract for any unforeseen delays." Execute an amendment to City Secretary Contract No. 18739 to extend the Animal Control kenneling contract with the Humane Society of North Texas for four (4) months beginning April 1, 1998, and ending July 31, 1998, and 2. Amend the fee agreement for the kenneling of wild animals impounded by the Animal Control Division to $7.25. DISCUSSION: On September 25, 1996, the Board of Directors of the Humane Society of North Texas (Society) informed the City that the Society intends to terminate its contractual arrangement with the City effective October 1, 1997. Under Section 6.24 of the contract with the Society, the Society may terminate the contractual agreement with the City by giving one year's notice in writing to the City. On May 13, 1997, Ms. Modean Barry, President of the Board of Directors of the Humane Society of North Texas, informed Dr. James Agyemang, Animal Control Manager, that the Board of Directors had agreed to extend the kenneling contract until March 31, 1998, while the City builds the Animal Care and Control' Center. The Board also required an increase in fees from $6.00 per animal per day to $7.25 per animal per day, effective October 1, 1997. On September 16, 1997 (M&C C-16298), the City Council authorized the City Manager to execute an amendment to City Secretary Contract No. 18739 to extend the kenneling contract with the Humane Society of North Texas for six (6) months beginning October 1, 1997 and ending March 31, 1998. The City Council also approved an increase in fees from $6.00 per animal per day to $7.25 per animal per day. On August 19, 1997, the City Council adopted an appropriation ordinance and awarded the construction of the new Animal Care and Control Center to S. Hakim Construction, Inc. The City Council is being asked to extend the kenneling agreement to enable S. Hakim Construction, Inc. to complete the Animal Care and Control Center facility. Completion is scheduled for early June, 1998. An extra month has been included in this contract in the event that any unforeseen delays occurs. City of Fort Worth, Texas clod Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 3/17/98 **C-16673 50HUMANE] 2 of 2 SUBJECT CONTRACT FOR ANIMAL CONTROL KENNELING SERVICES WITH THE HUMANE SOCIETY OF NORTH TEXAS On February 11, 1998, Mr. Jay Sabatucci, Executive Director of the Humane Society of North Texas, informed Dr. Agyemang that the Humane Society would require payment of $7.25 for relocating or euthanizing a wild animal. The current fee is $2.00 per wild animal. The City will make every attempt to relocate or euthanize all impounded wild animals. The Society is also requesting that the Society be paid at least one day's kenneling fee for any animal that is delivered by the City. Currently, the City does not pay the kenneling fees for animal reclaimed on the day of impoundment. The Society will be asked to collect such fees from pet owners reclaiming their pets on the day of impoundment. FISCAL INFORMATION/CERTIFICATION- The Director of Fiscal Services certifies that funds are available in the current operating budget, as appropriated, of the General Fund.
