HomeMy WebLinkAboutContract 56195-A3CSC No. 56195-A3 AMENDMENT No.3 TO CITY SECRETARY CONTRACT No.56195 WHEREAS, the City of Fort Worth (CITY) and Burns & McDonnell Engineering Company, Inc., (ENGINEER) made and entered into City Secretary Contract No. 56195, (the CONTRACT) which was administratively authorized on the 19 day of August, 2021 in the amount of $98,870.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $2,288,958.00 which was authorized by M&C 22-0530 on June 28, 2022, Amendment Number 2 in the amount of $210,301.00 which was authorized by M&C 22-0873 on October 25, 2022; and WHEREAS, the CONTRACT involves engineering services for the following project: Ray White Road, CPN 103270; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $8,000.00. (See Attached Funding Breakdown Sheet, Page -4-) 0 Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $2,606,129.00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Peer review will be conducted for two milestone submittals (30% and 60%) with reviewable plans and files being provided by the Consultant. Peer review services will be conducted within ten (10) business days of the Subconsultant's full receipt of applicable files and documents at each milestone review. 2.2 The Subconsultant will review the following roundabout performance checks to validate the proposed roundabout follows current industry standard modern roundabout geometrics. These roundabout performance checks are assumed to be initially performed by the Consultant and peer reviewed by the Subconsultant. 2.2.1 Theoretical maximum fastest path speed (NCHRP Report 6.7.1) 2.2.2 Design and accommodation vehicle. Subconsultants' preparation of traffic projection, operations analyses, or independent preparation of a roundabout capacity model. It is also understood that a separate Subconsultant Agreement will be executed at the appropriate time once the City of Fort Worth has fully authorized these services with the Consultant, using the Consultant's EC-1 form. Kimley-Horn will perform only those tasks specifically stated in our scope of services. This peer review may be relied upon only by Kimley-Horn's Client. It is not intended for use by any other party. Kimley-Horn will perform peer review in accordance with the scope, budget, and schedule agreed to with the Consultant. This peer review is based on our knowledge as of the day the corresponding files are sent to Kimley-Horn by the Subconsultant and is based solely on the documents provided to us by the Consultant. Our review may not disclose all errors or defects that might be in the documents. By conducting this limited evaluation, Kimley-Horn is not assuming responsibility for the content and accuracy of the construction drawings, which remain the sole responsibility of the Engineer of Record. Additional services we can provide include, but are not limited to, the following: Meetings beyond those identified in this scope of services Subconsultant's preparation of independent performance checks Subconsultant's preparation of traffic projections, operational analyses, or independent preparation of a roundabout capacity model Information Provided By Client We shall be entitled to rely on the completeness and accuracy of all information provided by the Client or the Client's consultants or representatives. The Client shall provide all information requested by Kimley-Horn during the project, including but not limited to the following: • Traffic projections, lane configuration analysis, and/or roundabout capacity analysis • City -approved roundabout design parameters • CAD files containing the proposed roundabout geometry, horizontal alignments, pavement markings, and jointing line work Schedule We will provide our services as expeditiously as practicable with the goal of meeting a mutually agreed - upon schedule. Fee and Expenses Kimley-Horn will perform the services in Tasks 1 - 2 for the total lump sum fee below. Individual task amounts are informational only. All permitting, application, and similar project fees will be paid directly by the Client.
