The Encroachment Amendment Agreement PN23-00001, contract number 58160-Al was executed by the City Secretary and not recorded in Tarrant County. Upon review of the Amendment, the developer now wishes to cancel the encroachment amendment attached herein as "Exhibit A", recorded on the day 7tn day of July, 2023 with the City Secretary, The monument sign is not located on the property shown in "Exhibit A". The monument sign is located on the property in Encroachment Amendment PN22-00207. The developer wishes to continue with Amendment agreement PN22-00207 and cancel PN23-00001. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 58160 on the 91h of September (the "Agreement"), to authorize the use of the City's easement for the pn roses of a private water line, berms, landscaping and irrigation; and WHEREAS, the parties wish to amend the Agreement to add a monument sign; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise "Exhibit A" in the Agreement to depict the revised encroachment area. NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. "Exhibit All in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as "Revised Exhibit A." Revised 12/2022 The effective date of this Amendment shall be the date of its execution by the City. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
