PRE IREAT.WTrff SERVICES DIVISION CONTRACT OR leR ETRZATMENIF;SERVICES WHEREAS, the City of Fort Worth and the City of Saginaw ento*ed hito a contract for the treatment of wastewater, such contiact being City of Fart "MoM City Secretai Conanct avo. 15688,da ed May 14, 1987;and WHEREAS, the City of Saginaw is required by saaid c*%&wIz to adopt and enforce an industrial-retrea'.t;acot ordinmxz within ?s jurkdiction;and WHEREAS, the City of Saginaw has requested t�-' the City of Fort Worth perform sampling of industrial wastes within the jurisdic%on of tU: City of Saginaw, as vveD as performing the analysis of mach samples;and l diEAS,the City of Fort Worth is agreeable to performing the saampling and ana'."is on behalf of the City of Saginaw. ;r p a NOW, THEREFORE, the City of Fort Werth, laeaeinafter ieferaed to as "Fran Wort-h", and the City of Saginaw,hLninafter referred to "Saginaw",hereby agree as.follows: a. As of the date of this agreement, there are two Significant Industrial Users (SIU) within u the jurisdiction of Saagiaaw, such SIUs being Styrochem, Inc, and Veaattora Foods, LLC. This agreement and the charges � agree aarges aon!tained herein are for the two existing SIUs. Except as provided atherwise herein, if additionai SIUs locate, widda Scenaws jurisdiction, this agreement will be ; either amended to include the W-41itionaal SIUs or Fort Worth's obligations hereunder shall be limited to the existing SIUs. ` 2. k, Fort Worth agrees to perform the following basic s"wives which a-.c related to Industrial Connection and Monitoring, section 9 of City of Fort Wortl'i City of Fort Worth City Secretary Contract No. 1 5688(the Contract), for Sagina.-,-: aa) With Saginaw re resentaative(s), conduct an aranuaa! it,pection of the two 31U facilities wie,in the jurisdiction of Saginaw. b) Obtain two (2? Samples per year ,tom th,- BTUs for siralysis and compliance with the Lonuaact. Saam.pling w-id analysis shall be in accord with Exhibit ".N" tatac:hed. Saginaw,gees to,pay Fort Word for the tic services wired hereunder as follows: a) `l:'he sum of$439.41 rmndkdy for pretr.am-n�m ier ces described under Section 2. b) A wwnthly Customer;Service Charge in the amoutit of$25.00 TlaesN charges shall be included in the monthly wastewater statement submitted to Saginaw pursuant to the Q vitract and shall be raid at the time such statement is due and payable. 4. Saginaw agrees t y pay to port Worth for additional services as may be requested by Saginaw: a) Saginaw agree to pay port Worth an additional fee for services provided to support and assist Pretreatment related enforcement actions by Saginaw against noncompliant SIUs. A fee not to exceed $100.04 per employee per day for such services requiring Fort Worth attendance at show cause hearings, administrative hearings or meetings ;nvoivi-lg enforcement actions. b) Saginaw agrees to provide Fort Worth written notice 96 hours in advance to appear and testify in enforcement actions. These charges shall be included in the monthly wastewater statement submitted to Saginaw pursuant to the Contract and shall be paid at the time such statement is due and payable. c) Anyihing beyond the scope o,f contract for sampling will be of cost per sample for listed pvranmeters as listed on Exhibit A. 5. r:3.a3 agreement shall ter nrintae on October -11, 1999, 3, iless .'mewed as herein after ,r eci i;•l.
