CITY OF FORT WORTH, TEXAS
STANDARD AGREEMENT FOR GENERAL PROFESSIONAL SERVICES
This agreement ("Agreement") is between the City of Fort Worth, a Texas home -rule
municipality ("City"), and Stantec Consulting Services, Inc., authorized to do business in Texas
("Consultant"), for a project generally described as: Park, Recreation & Open Space Master
Plan ("Project") — Project No. 104861 .
Article I
Scope of Services
(1) Consultant hereby agrees to perform professional services as set forth in this
Agreement and the Scope of Services, attached hereto as Attachment "A"
("Services"). These Services shall be performed in connection with the Project.
(2) Additional services, if any, will be memorialized by an amendment to this Agreement.
(3) All reports, whether partial or complete, prepared under this Agreement, including
any original drawings or documents, whether furnished by City, its officers, agents,
employees, consultants, or contractors, or prepared by Consultant, shall be or
become the property of City, and shall be furnished to the City, prior to or at the time
such services are completed, or upon termination or expiration of Agreement.
Article II
Compensation
Consultant shall be compensated an amount up to $439,900.00 ("Contract Amount") in
accordance with the Fee Schedule shown in Attachment "B". Payment shall be considered
full compensation for all labor (including all benefits, overhead and markups), materials,
supplies, and equipment necessary to complete the Services.
Consultant shall provide monthly invoices to City. Payments for services rendered shall be
made in accordance with the Texas Prompt Payment Act (Texas Government Code Ch.
2251).
Acceptance by Consultant of said payment shall release City from all claims or liabilities
under this Agreement for anything related to, performed, or furnished in connection with the
Services for which payment is made, including any act or omission of City in connection with
such Services.
Article III
Term
Time is of the essence. The term of this Agreement shall commence on the Effective Date and
shall continue until the expiration of the funds or completion of the subject matter pursuant to

the schedule, whichever occurs first, unless terminated in accordance with the terms of this
Agreement. Unless specifically otherwise amended, the original term shall not exceed five
years from the original effective date.
Article IV
Independent Contractor
Consultant shall operate hereunder as an independent contractor and not as an officer, agent,
servant, or employee of City. Consultant shall have exclusive control of and the exclusive right
to control the details of the work to be performed hereunder and of all persons performing
same, and shall be solely responsible for the acts and omissions of its officers, agents,
employees, contractors and subcontractors. The doctrine of respondent superiorshall not
apply as between City and Consultant, its officers, agents, employees, contractors, and
subcontractors, and nothing herein shall be construed as creating a partnership orjoint venture
between City and Consultant.
Article V
Professional Competence
Work performed by Consultant shall comply in all aspects with all applicable local, state and
federal laws and with all applicable, standards, codes, rules and/or regulations promulgated
by local, state and national boards, bureaus and agencies. Approval to proceed by City of
Consultant's work or work product shall not constitute or be deemed to be a release of the
responsibility and liability of Consultant or its officers, agents, employees, contractors and
subcontractors for the accuracy and competency of its performance of the Services.
Article VI
Indemnification
CONSULTANT,ATNO COST TO THEC/TY, AGREES TO/NDEMN/FYANDHOLD CITY,
ITS OFFICERS, AGENTS, SERVANTSAND EMPLOYEES, HARMLESS AGAINSTANY
AND ALL CLAIMS, LAWSUITS, ACTIONS, COSTS AND EXPENSES OF ANY KIND,
INCLUDING, BUT NOT LIMITED TO, THOSE FOR PROPERTY DAMAGE OR LOSS
(INCLUDING ALLEGED DAMAGE OR LOSS TO CONSULTANT'S BUSINESS AND ANY
RESULTING LOST PROFI TS) AND/OR PERSONAL INJURY, INCLUDINGDEATH, THAT
MAYRELATETO, AR/SE OUT OF OR BE OCCASIONED BY CONSULTANT'S BREACH
OF (i) ANY OF THE TERMS OR PROVISIONS OF THIS AGREEMENT OR (ii) ANY
NEGLIGENT ACTOR OMISSION OR INTENTIONAL MISCONDUCT OF CONSULTANT,
ITS OFFICERS, AGENTS, ASSOCIATES, EMPLOYEES, CONTRACTORS (OTHER
THAN THE CITIq OR SUBCONTRACTORS RELATED TO THE PERFORMANCE OR
NON-PERFORMANCE OFTH/S AGREEMENT. THIS SECTION SHALL SURVIVE ANY
TERMINATION OR EXPIRATION OF THIS AGREEMENT.

Article VII
Insurance
Consultant shall not commence work under this Agreement until it has obtained all insurance
required under Attachment F and City has approved such insurance.
Article VIII
Force Majeure
City and Consultant shall exercise their best efforts to meet their respective duties and
obligations as set forth in this Agreement, but shall not be held liable for any delay or
omission in performance due to force majeure or other causes beyond their reasonable
control, including, but not limited to: acts of the public enemy, fires, strikes, lockouts, natural
disasters, epidemics/pandemics, wars, riots, material or labor restrictions by any
governmental authority and/or any other similar causes.
Article IX
Transfer or Assignment
Consultant, its lawful successors and assigns, shall not assign, sublet or transfer any interest
in this Agreement without priorwritten consent of City.
Article X
Termination of Contract
(1) City may terminate this Agreement for convenience by providing written notice to
Consultant at least 30-days prior to the date of termination, unless Consultant agrees
in writing to an earlier termination date.
(2) Either City or Consultant may terminate this Agreement for cause if either party fails
to substantially perform, through no fault of the other and the nonperforming party
does not commence correction of such nonperformance within 5 days after receipt of
written notice or thereafter fails to diligently pursue the correction to completion.
(3) If City chooses to terminate this Agreement, upon receipt of notice of termination by
Consultant, Consultant shall discontinue Services on the date such termination is
effective. City shall compensate Consultant for such services rendered based upon
Article II of this Agreement and in accordance with Exhibit "B".
Article XI
Right to Audit
(1) Consultant agrees that City shall, until the expiration of three (3) years after final
payment under Agreement, have access to and the right to examine any directly
pertinent books, documents, papers and records of Consultant involving transactions
relating to Agreement. Consultant agrees that City shall have access during normal

working hours to all necessary facilities and shall be provided adequate and appropriate
workspace in order to conduct audits in compliance with the provisions of this section.
City shall give Consultant reasonable advance notice of intended audits.
(2) Consultant further agrees to include in all its subcontracts hereunder, a provision to
the effect that the subcontractor agrees that City shall, until the expiration of three (3)
years after final payment under the subcontract, have access to and the right to
examine any directly pertinent books, documents, papers and records of such
subcontractor(s), involving transactions to the subcontract, and further, that City shall
have access during normal working hours to all subcontractor facilities, and shall be
provided adequate and appropriate work space in order to conduct audits in
compliance with the provisions of this article. City shall give Consultant and any
subcontractor reasonable advance notice of intended audit.
(3) Consultant and subcontractor(s) agree to photocopy such documents as may be
requested by City. Cityagreesto reimburse Consultant for the costofcopiesatthe rate
published inthe Texas Administrative Code in effect as ofthe time copying isperformed.
Article XII
Business Equity Participation
City has goals for the full and equitable participation of minority business and/or women
business enterprises in City contracts greater than $100,000. In accordance with City's
Business Equity Ordinance No. 25165-10-2021 (replacing Ordinance No. 24534-11-2020, as
codified in Chapter 20, Article X of the City's Code of Ordinances, as amended, and any
relevant policy or guidance documents), Consultant acknowledges the MBE and WBE goals
established for Agreement and its execution of this Agreement is Consultant's written
commitment to meet the prescribed MBE and WBE participation goals. Any misrepresentation
of facts (other than a negligent misrepresentation) and/or the commission of fraud by
Consultant may result in the termination of Agreement and debarmentfrom participating in City
contracts for a period of time of not less than three (3) years.
Article XIII
Observe and Comply
Consultant shall at all times observe and comply with all federal, state, and local laws and
regulations and with all City ordinances and regulations which in any way affect Agreement
and the work hereunder, and shall observe and comply with all orders, laws ordinances and
regulations which may exist or may be enacted later by governing bodies having jurisdiction or
authority for such enactment. No plea of misunderstanding or ignorance thereof shall be
considered. Consultant agrees to defend, indemnify and hold harmless City and all of its
officers, agents and employees from and against all claims or liability arising out of the violation
of any such order, law, ordinance, or regulation, whether it be by itself or its employees or its
subcontractor(s).

Article XIV
Immigration Nationality Act
Consultant shall verify the identity and employment eligibility of its employees and
employees of all subcontractor(s) who perform work under Agreement, including completing
the Employment Eligibility Verification Form (1-9). Upon request by City, Consultant shall
provide City with copies of all 1-9 forms and supporting eligibility documentation for each
employee who performs work under Agreement. Consultant shall adhere to all Federal and
State laws as well as establish appropriate procedures and controls so that no services will
be performed by any Consultant employee who is not legally eligible to perform such
services. CONSULTANT SHALL INDEMNIFY CITY AND HOLD CITY HARMLESS FROM
ANY PENALTIES, LIABILITIES, OR LOSSES DUE TO VIOLATIONS OF THIS
PARAGRAPH BY CONSULTANT, CONSULTANT'S EMPLOYEES,
SUBCONTRACTORS, AGENTS, OR LICENSEES. City, upon written notice to Consultant,
shall have the right to immediately terminate Agreement for violations of this provision by
Consultant.
Article XV
Venue and Jurisdiction
If any action, whether real or asserted, at law or in equity, arises on the basis of any provision
of Agreement, venue for such action shall lie in state courts located in Tarrant County, Texas
or the United States District Court for the Northern District of Texas — Fort Worth Division.
Agreement shall be construed in accordance with the laws of the State of Texas.
Article XVI
Contract Construction/No Waiver
The parties acknowledge that each Party and, if it so chooses, its counsel, have reviewed
and revised Agreement and that the normal rule of contract construction, to the effect that
any ambiguities are to be resolved against the drafting party, must not be employed in the
interpretation of Agreement or any amendments or exhibits hereto.
The failure of City or Consultant to insist upon the performance of any term or provision of
this Agreement or to exercise any right granted herein shall not constitute a waiver of City's
or Consultant's respective right to insist upon appropriate performance or to assert any such
right on any future occasion.
Article XVII
Severability
The provisions of Agreement are severable, and if any word, phrase, clause, sentence,
paragraph, section or other part of Agreement or the application thereof to any person or
circumstance shall ever be held by any court of competent jurisdiction to be invalid or

unconstitutional for any reason, the remainder of Agreement and the application of such
word, phrase, clause, sentence, paragraph, section, or other part of Agreement to other
persons or circumstances shall not be affected thereby and Agreement shall be construed
as if such invalid or unconstitutional portion had never been contained therein.

Notices regarding Articles V or X are to be provided to the other Party by hand -delivery or
via U.S. Postal Service certified mail return receipt requested, postage prepaid, to the

Article XIX
Prohibition On Contracts With Companies Boycotting Israel
Consultant, unless a sole proprietor, acknowledges that in accordance with Chapter 2271 of
the Texas Government Code, if Consultant has 10 or more full time -employees and the
contract value is $100,000 or more, the City is prohibited from entering into a contract with
a company for goods or services unless the contract contains a written verification from the
company that it: (1) does not boycott Israel; and (2) will not boycott Israel during the term of
the contract. The terms "boycott Israel" and "company' shall have the meanings ascribed
to those terms in Section 808.001 of the Texas Government Code. By signing this
contract, Consultant certifies that Consultant's signature provides written verification
to the City that if Chapter 2271, Texas Government Code applies, Consultant: (1) does
not boycott Israel; and (2) will not boycott Israel during the term of the contract.

Article XX
Prohibition on Boycotting Energy Companies
Consultant acknowledges that in accordance with Chapter 2274 of the Texas Government
Code -(as added by Acts 2021, 87th Leg., R.S., S.B. 13, § 2), the City is prohibited from
entering into a contract for goods or services that has a value of $100,000 or more, which
will be paid wholly or partly from public funds of the City, with a company (with 10 or more
full-time employees) unless the contract contains a written verification from the company
that it: (1) does not boycott energy companies; and (2) will not boycott energy companies
during the term of the contract. The terms "boycott energy company' and "company' have
the meaning ascribed to those terms by Chapter 2274 of the Texas Government Code (as
added by Acts 2021, 87th Leg., R.S., S.B. 13, § 2). To the extent that Chapter 2274 of the
Government Code is applicable to this Agreement, by signing this Agreement,
Consultant certifies that Consultant's signature provides written verification to the
City that Consultant: (1) does not boycott energy companies; and (2) will not boycott
energy companies during the term of this Agreement.
Article XXI
Prohibition on Discrimination Against Firearm and Ammunition Industries
Consultant acknowledges that except as otherwise provided by Chapter 2274 of the Texas
Government Code (as added by Acts 2021, 87th Leg., R.S., S.B. 19, § 1), the City is
prohibited from entering into a contract for goods or services that has a value of $100,000
or more which will be paid wholly or partly from public funds of the City, with a company (with
10 or more full-time employees) unless the contract contains a written verification from the
company that it: (1) does not have a practice, policy, guidance, or directive that discriminates
against a firearm entity or firearm trade association; and (2) will not discriminate during the
term of the contract against a firearm entity or firearm trade association. The terms
"discriminate," "firearm entity' and "firearm trade association" have the meaning ascribed to
those terms by Chapter 2274 of the Texas Government Code (as added by Acts 2021, 87th
Leg., R.S., S.B. 19, § 1). To the extent that Chapter 2274 of the Government Code is
applicable to this Agreement, by signing this Agreement, Consultant certifies that
Consultant's signature provides written verification to the City that Consultant: (1)
does not have a practice, policy, guidance, or directive that discriminates against a
firearm entity or firearm trade association; and (2) will not discriminate against a
firearm entity or firearm trade association during the term of this Agreement.

Article XXIII
Attachments, Schedules and Counterparts
This Agreement may be executed in one or more counterparts and each counterpart shall,
for all purposes, be deemed an original, but all such counterparts shall together constitute
but one and the same instrument.

Attachment A — Scope of Services
The City of Fort Worth Parks, Recreation and Open Space Master Plan (Fort Worth PROS Master Plan) will be
developed in three phases as described below:
PHASE 1: Discovery- Foundation Building
From the onset of this Project, we will work closely with the City's PM to establish appropriate communication
protocols, project management benchmarks, QA/QC process and branding for this effort to make it a success. We
will also work as a team to review all available existing information for the Study Area so that we can lay the
appropriate foundation for all subsequent planning activities to follow. Our approach to this phase includes the
following scope items, provided in greater detail.
Task 1.0: Staff Kick-off Meeting — The purpose of this meeting is to kick-off the Project between the Client and the
Stantec Team, to discuss the project work plan which will include the scope, schedule, and coordination related
items, including the request of data from the Client including all base file data in GIS format for completion of tasks
within Phase 1. Stantec team members will attend via phone conference. Stantec will supply a summary of the
kick-off meeting that outlines the discussion items, decisions made and follow up action items to be completed.
Task 1.0 Meetinas/Deliverables
• In -Person Project Kick-off Meeting & Meeting Minutes
• Document Request Form (To be completed by City)
Task 1.1: Project Management— Stantec's PM will meet with the City's PM on a monthly basis, once per month,
throughout the approximate 12 to 15-month duration of the project. These meetings will be attended virtually and
are anticipated to last approximately one (1) hour. The purpose of the monthly meetings is to review submittals and
keep both parties (Stantec and City) updated on the Project's progress. Project status update memos will be issued
monthly and shall summarize work completed, work scheduled to be completed for the upcoming month, and any
outstanding issues or decisions that must be resolved by City staff or the project team. Stantec will document these
staff check in meetings via e-mail to outline discussion points, decisions made, next steps and any follow up action
items needed. Should extra client review meetings be required to complete this task, consultant will review with the
Owner the required additional fees necessary to cover the increase in the scope of work.
Task 1.1 Meetinas/Deliverables

Task 1.2: Project Branding, Project Website and Project Awareness— Stantec will develop a design template
(according to City's branding standards) and logo to brand the Project. All project documents and materials will
follow the standards of the selected design template. Stantec will also provide the design of material for facilitation
aids for public outreach and citizen participation as well as marketing materials for increased project awareness.
The Stantec Team will also assist City Staff by providing content material for the project website. City Staff will
develop and maintain the project -specific website throughout the duration of the Project. The website should include
an overview of the project, project timeline, sign-up for project notifications, review of public documents, and stay
up-to-date on upcoming public engagement/outreach events. Stantec will work with the City to take advantage of
existing social media opportunities, such as existing Facebook, Instagram, and Twitter accounts owned by the City.
Our experience is that providing information for accounts with existing followers is more successful than setting up
new accounts for a project. Stantec will provide notifications of the public engagement/outreach events in both
English and Spanish for the City to upload to the website and various social media platforms. Project reports, public
documents, and the Parks Master Plan will be provided in English only.

Task 1.3: Reconnaissance/ Existing Conditions & Inventory Assessment — Stantec will review and summarize
existing plans, projects, and programs pertinent to the Fort Worth PROS Master Plan planning area. Stantec will
work with the Client staff to identify the list of plans and provide the resultant planning documents. Stantec staff will
reference the existing plans, projects, and programs as they pertain to the project boundary and incorporate findings
as best as possible into the PROS Master Plan. Stantec will conduct a desktop inventory of general park
improvements, as well as evaluate area influences and other conditions which have influenced and continue to
inform the growth, development patterns, and connectivity of the City. Stantec will also review relevant documents
including policies, regulating documents, and others to understand prevailing influences regarding the parks and
recreation system for the City of Fort Worth.
Task 1.3 Meetinas/Deliverables
• 2-Day Park & Facility Site Visit and Assessment Meeting with Design Team and City Staff
• Existing Park Inventory & Assessment Memo
Task 1.4: Base Mapping — Stantec will utilize City provided data, readily available GIS information and Lidar aerial
maps to create a base map for up to five (5) existing parks (pocket, neighborhood, or community classifications)
that will be master planned. *Note, if any of the Parks Master Plan move into the design development phase, then
a topographical survey will be needed in order to create a precise set of construction documents.
Task 1.4 Meetinas/Deliverables
• The deliverable for this task will be provided as part of Task 1.4 — Reconnaissance/Existing Conditions &
Inventory Assessment.
Task 1.5: Development of Vision and Goals—Stantec will work with City Staff and/or the Parks Advisory Board
and/or Steering Committee to produce a clear and concise Statement of Vision and Key Goals for the plan. The
vision statement and goals will be refined throughout the Project and serve as a guidepost for all future discussions.

Task 1.6: Current System Analysis, Needs Assessment, and Gap Analysis— Stantec will review the current
conditions, future needs, and existing gaps relevant to the City of Fort Worth's Park, Recreation and Open Space
system to include the following:
Demographic & Recreation Trends Analysis- We will utilize City of Ft. Worth projections, if available, and
supplement with census tract demographic data obtained from Environmental Systems Research Institute,
Inc. (ESRI), the largest research and development organization dedicated to Geographical Information
Systems (GIS) and specializing in population projections and market trends; for comparison purposes data
will also be obtained from the U.S. Census Bureau. We will complete a demographic and recreation trends
analysis for the City of Ft. Worth (if possible by park planning district). This analysis will provide an
understanding of the demographic environment for the following reasons:
To understand the market areas served by the park and recreation system and distinguish
customer groups.
To determine changes occurring in Ft. Worth and the surrounding area and assist in making
proactive decisions to accommodate those shifts.
Provide the basis for Equity Mapping and Service Area Analysis
The County's demographic analysis will be based on 2020 US Census information or 2021 updated
projections, and five (2028) and ten (2033) year projections. The following demographic characteristics
will be included:
Population density; Age Distribution; Households; Gender; Ethnicity; Household Income
• Benchmark Analysis- A benchmark analysis will be completed to compare Ft. Worth to five (5) other
relevant peer agencies. We will work with City Staff to identify five (5) key metrics to be surveyed and
analyzed, as well as the benchmarked communities.
Financial Analysis- We will perform a high-level analysis to document the financial situation of Ft.
Worth's PARD and compare against best practices nationwide. The financial analysis will look at the
budget, pricing policy, current and other revenue generating opportunities, grant opportunities, and the
revenue forecast. This analysis will identify the financial situation of Ft. Worth's PARD with three primary
goals:
Understand the financial dynamics to further advance the understanding of operations gained
through the work described above.
Review funding and accounting practices with an objective of accurate financial fund tracking and
the ability of the Ft. Worth's PARD to have more useful financial information for strategic decision -
making.
Seek opportunities to improve the financial sustainability of Ft. Worth's PARD including evaluating
expenditures and increasing current and new sources of revenue.
This review will include comparison of current policies with national standards of best practice agencies.
We will also recommend policies and adjustments to current policies where enhancements may be needed
or gaps are identified.
Park Classifications and Level of Service Standards- Using data provided by City Staff along with
data compiled by the Stantec team, we will utilize the Existing Conditions Analysis, in tandem with current
population estimates (2020 US Census or most recent American Community Survey), to compare the
existing park and recreational facilities within the City against National Recreation and Park Association
(NRPA) standards. We will also identify relevant park development trends along with benchmarking City
facilities with regional and national standards. Stantec will work with City staff to identify relevant
communities within the region or nation against which to compare and analyze level of service and parks
and recreation standards. These comparisons may be peer communities, in terms of location or size, or
may be aspirational communities, systems whose level of services or offering the City would like to
emulate.
Needs Assessment- The needs assessment is an objective method to determine whether the park
system effectively meets the locally established standards. The information being assessed is based
upon existing conditions, community input, community resources, existing and future level -of -service,
and growth trends. The assessments are then matched with available lands and future amenities to
determine current and future needs. The desires and deficiencies identified form the basis for
recommendations. This needs assessment relies also on public comments, staff knowledge and stated
desires. The needs assessment is part science and part art, having to balance data with community
desires. Park assessments rely heavily on national standards, but those are only a portion of the overall
calculations.
While many national standards appear difficult to apply, they are only a guideline; thus, this planning
effort finds them valuable as a benchmark, but will use additional methods of assessment to aid in
determining the community's needs. We will use three methods for assessing current and future park
needs, demand -based, standards -based and resource -based assessment methodologies.

Task 1.7: Stakeholder and Community Outreach/Engagement —The Stantec team will facilitate robust stakeholder
and community engagement and solicit the public's input on a vision and goals for the City of Fort Worth Parks,
Recreation and Open Space Master Plan Throughout the project, Stantec will develop, participate, and assist with
the following public engagement activities:
Management and Engagement Plan — Stantec will work with the City Staff and develop a stakeholder and
community engagement plan memorandum that identifies the details for each of the engagement strategies.
These details will include but are not limited to venues, key participants, engagement advertisements,
coordination, and plan and work product to be completed with each engagement strategy. This plan will be
developed with a medium to high level of detail that specifically denotes responsible parties to complete
specific engagement coordination tasks.

• Stakeholder and Community Engagement Plan Memo
Stakeholder and Ambassador Listening Sessions— We will identify five (5) stakeholder groups and up
to twenty (20) individuals across the City that will function as ambassadors for the planning process and the
PROS Master Plan, assist with public outreach and input gathering, and help us reach traditionally
underserved groups. We will lead 1.5-hour facilitation sessions with the stakeholder groups and half (0.5)
hour interviews with individual ambassadors to understand issues to be addressed, pitfalls to avoid, and
recommendations for best approaches to input and outreach. The purpose of this task is to meet with
individuals and groups with potential to influence/ impact future development and improvements of the parks
and open spaces in Fort Worth. Potential groups could include members of Youth Associations, Sport
Groups, City Staff, business and property owners, developers from the community and region, lenders, and
others.

and opportunities in the City. During this workshop, engagement activities are about eliciting conversations
about the vision and transforming that vision into specific action items. We have allocated 2 hours per
meeting (1 hour prep time and 1 hour presentation).
Community Workshop Meetings No. 6-10 are intended to take place in each park planning district and are
intended to gain community validation of what has been developed in response to their input and how to
accomplish those tasks. It is an opportunity for the overall community to tell us what they think of the ideas
and designs as well as the suggested action steps developed by the project team, and to validate them or
suggest final changes to them prior to developing the final document. We have allocated 2 hours per
meeting (1 hour prep time and 1 hour presentation).

Community Pop-up Events— The Stantec Team will attend and facilitate up to ten (10) community Pop-up
Events. The purpose of these events is to meet residents where they already are, rather than relying on
large public workshops and online engagement twice in this phase. Pop-up events will be welcoming, eye-
catching, informative and allow for conversation -based feedback. These events will focus on maximizing
public participation and dialogue, especially with communities that have not historically participated in
similar projects. The idea is to invite passers-by to join the space or at least participate in some of the
interactive activities we will have set up to gather key ideas and issues. These can include visual preference
surveys, thought bubbles that pose questions to participants, and video interviews. Stantec will prepare
materials and facilitate the activities to collect input and summarize the results at each pop-up event.

Task 1.8: Statistically Valid Research and Community Survey — Stantec, in collaboration with Andrea Thomas
with National Service Research (NSR), will work closely with the City staff to create one (1) statistically valid survey
and online programming for community engagement. The survey will be written in both Spanish and English. Provide
online link to City team for development of QR code and handouts, keep live for 30 days or as directed by City. The
purpose of this one (1) survey is to ascertain public needs for parks and recreation. Stantec and NSR will develop,
participate, and assist with the following public engagement activities:
• Strategy Meeting- Andrea Thomas, owner of NSR and Stantec team members, will meet with City staff
and stakeholders (stakeholders to be identified by City staff) to outline and discuss the community
engagement and survey process. Meetings could be in person and/or virtual.
• Community Engagement Meetings/Events- The purpose of the community engagement
events/meetings are to solicit public input on park and recreation needs to assist with the development of
the quantitative survey. It will be the responsibility of the City of Fort Worth to advertise and invite citizens
to the events/open houses via email, and in various print and social media formats.
NSR will develop a short set of questions (based upon the initial strategy meeting) to be used at all
community meetings (multiple choice and open-ended questions). Questions should be consistent at all
events to collect consistent data.
NSR will program the questions in English and Spanish in an online format. NSR will provide the QR
code for the online survey. Printed versions of the online survey could also be made available at
these community meetings.
Provide hand out cards at community meetings with a QR code so citizens can engage and answer the
questions about their park and recreation needs/wants. QR code handouts to be coordinated by NSR, City
staff or Stantec team.
Survey Instrument Design - The survey instrument will be designed with input from the community
meetings, Stantec as well as input from the PARD staff. After initial meetings/input from the City, NSR will
provide a draft of the survey for review by the PARD staff. Additional drafts will be prepared incorporating
changes, additions and/or deletions from the PARD staff. The final version submitted will include
information that is most beneficial and useful to the City. NSR recommends the survey include a brief
introductory paragraph from the Park Director that will explain survey, the process, the importance of
citizen participation and how the results will be utilized by the city.
Online Survey- NSR proposes a sampling procedure that provides opportunity for a majority of
residents to participate. NSR has utilized this two -pronged approach successfully for other municipalities
and it has provided not only statistically valid sample sizes but also yielded a representative sample of
residents that mirrors the City's population demographically and geographically. Since a majority of
citizens nationwide are dropping their telephone land lines, this sampling procedure provides
opportunities for residents to participate in the citizen survey process in a cost and time efficient manner.
PARD Online Survey-NSR will develop and program an online survey link for the Parks and Recreation
Department Needs Assessment Survey that will be posted on the City's home page of the website. The
survey instrument will be developed with significant input from the PARD staff as well as the community
engagement feedback. The survey will be programmed in English and Spanish. NSR will provide the
online survey link to the City.
• Fort Worth Online Panel Survey —As an optional approach, NSR proposes to conduct an online survey
with Fort Worth online panel members to augment the PARD survey. The panel member survey will be
available in English and Spanish and will be an exact duplicate of the PARD survey instrument.
Panel members are screened for being a resident of the City of Fort Worth before proceeding with the
survey. The screening process will ensure the panel members have not completed any other survey for
the Fort Worth Park System within the past year. The goal would be to complete up to 800 surveys with
Fort Worth panel members. (The goal of both online surveys is to yield a minimum sample size of 120
completed surveys within each of the five park planning districts which will provide a 95% confidence level
within a margin of error of +/ 4.1 %. A Fort Worth panel survey was utilized in the 2019 survey.)
• Merge PARD and Fort Worth online panel surveys — NSR will merge the data from both surveys (goal
is to complete a minimum of 1,600 surveys) for data analysis and final reporting. Crosstabulations will be
available in the data file to identify PARD online respondents as well as Fort Worth panel respondents.
• Analysis and Final Report- NSR will prepare an analysis of the survey data and will prepare and submit
a written report containing a detailed analysis of results utilizing text and color graphics. The final report
will provide a description of the sampling procedure methodology and confidence level of results. Citizen
input and service priorities will be detailed and summarized.
The study will include a report of all survey questions in Microsoft Word and PowerPoint format. The
report will be provided to the PARD staff in an electronic format.
Detailed survey data will be provided in an electronic format. Printed copies of either the report and/or
detailed survey data will be provided if requested.
A summary of community engagement feedback and presentation of the results to PARD staff.

Task 2.: Master Plan Development, Recommendations and Strategies- We will develop an overall Parks,
Recreation and Open Space Master Plan which will be based off the public input received throughout the project.
The Master Plan deliverable will include a graphic written report, with an executive summary, maps, and associated
graphics, photographs, tables, and charts. The report will document the planning process, input, and all previous
tasks. We will suggest preliminary recommendations for projects, programs, and policies that will assist in realizing
the community vision. This phase will include:
• General Recommendations for the overall park system
• Strategies for land acquisition for future parkland and facilities
• Recommendations for improving existing parks and recreational facilities
• Recommendations for the creation of new parks, park amenities and programming
• Strategies to expand and create additional recreational programming
• Recommendations for trail creation, improvements, and connectivity opportunities
• Strategies for economic development for the Ft. Worth's Parks and Recreation System.
• Financial strategies including possible funding/ revenue streams and possible grant opportunities
• Recommendations regarding policy and regulatory revisions and amendments necessary to protect the final
plan vision and concepts
Task 2.1: Action/Implementation Plan- With an understanding of the park and recreation gaps, this task will create
a categorized matrix of actions necessary to close the gaps identified in the City Parks and Recreation system. The
matrix will be organized into broad categories of interventions and/or corrective measures, likely to include Policy,
Programming, Maintenance, Renovations, and Capital Projects.

PHASE III: PLAN REVIEW AND DELIVERY
This final phase of the project will result in development of the final master plan report consisting of action steps and

projects, programs, and policies. The final document will be largely graphic and easy to understand for multiple and
diverse audiences and stakeholders. The technical data and information will be contained in the appendix. This
phase will include:

Kickoff meeting, we will prepare a first draft of the complete document for Citv staff review. In addition to being
comprehensive in scope the document will be visual in presentation, readable, concise, succinct, eye-catching,
engaging, and implementable. We will make one set of edits to the first draft based on review comments by the
City staff PM. All requested edits shall be in the form of one consolidated set as redlines, Adobe Acrobat notes, or
similar method.

A. The CONSULTANT shall be paid by the City based upon an invoice created on the basis of
statements prepared from the books and records of account of the CONSULTANT, based on the

B. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by
an officer of the CONSULTANT.

PROJECT SCHEDULE
A. CONSULTANT Project Schedule Development
CONSULTANT shall prepare a project schedule for the services to be provided in
fulfilling the requirements of the Agreement and encompassing the Scope of Work
defined in Attachment A to the Agreement.
CONSULTANT shall prepare and maintain project schedule throughout the life of the
project as defined in the Agreement in compliance with the City's Specification 00 31 15
entitled CONSULTANT Project Schedule.
CONSULTANT's project schedule will follow the Critical Path Methodology (CPM) for
planned sequencing of the work activity and timing of the work.
B. Schedule "Tier" Selection
City has identified three "Tier" levels for project schedules as defined in City's
Specification 00 31 15, to align with the size and complexity of the project as a basis for
schedule development. City's Project Manager will determine the "Tier" level for the
CONSULTANT's project schedule as part of the negotiation of the Agreement.
C. Project Baseline Schedule
CONSULTANT will produce an initial project schedule and submit as a "baseline" for
review and acceptance by City's Project Manager as defined in City's Specification 00
31 15 which will be referred to as the Project Baseline Schedule. Updates to the
baseline schedule follow the requirements of City's Specification 00 31 15.
D. Project Progress Schedule
CONSULTANT will provide to the City, monthly updates to their project schedule
indicating progress of the Work in compliance with the requirements of City's
Specification 00 31 15 and said schedule will be referred to as the Project Progress
Schedule.
E. Master Project Schedule
City will develop and maintain a master project schedule for the overall project.
CONSULTANT's project baseline and progress schedule submittals will be an integral

STANDARD INSURANCE REQUIREMENTS
(1) INSURANCE LIMITS
a. Commercial General Liability — Insured shall maintain commercial general
liability (CGL) and, if necessary, commercial umbrella insurance as follows:
$1,000,000 each occurrence
$2,000,000 aggregate
If such Commercial General Liability insurance contains a general aggregate
limit, it shall apply separately to this Project or location.
City shall be included as an additional insured with all rights of defense
under the CGL, using ISO additional insured endorsement or a
substitute providing equivalent coverage, and under the commercial
umbrella, if any. This insurance shall apply as primary insurance with
respect to any other insurance or self-insurance programs afforded to
City. The Commercial General Liability insurance policy shall have no
exclusions or endorsements that would alter or nullify:
premises/operations, products/completed operations, contractual,
personal injury, or advertising injury, which are normally contained
within the policy, unless City specifically approves such exclusions in
writing.
ii. Insured waives all rights against City and its agents, officers, directors
and employees for recovery of damages to the extent these damages
are covered by the commercial general liability or commercial umbrella
liability insurance maintained in accordance with Agreement.
b. Business Auto — Insured shall maintain business auto liability and, if
necessary, commercial umbrella liability insurance as follows:
$1,000,000 each accident (or reasonably equivalent limits
of coverage if written on a split limits basis).
Such insurance shall cover liability arising out of "any auto", including owned,
hired, and non -owned autos, when said vehicle is used in the course of Insured's
business and/or the Project. If Insured owns no vehicles, coverage for hired or
non -owned autos is acceptable.
Insured waives all rights against City and its agents, officers, directors and
employees for recovery of damages to the extent these damages are
covered by the business auto liability or commercial umbrella liability
insurance obtained by Insured pursuant to this Agreement or under any
applicable auto physical damage coverage.

c. Workers' Compensation — Insured shall maintain workers compensation and
employer's liability insurance and, if necessary, commercial umbrella liability
insurance as follows:
Coverage A: statutory limits
Coverage B: $100,000 each accident
$500,000 disease - policy limit
$100,000 disease - each employee
Insured waives all rights against City and its agents, officers, directors and
employees for recovery of damages to the extent these damages are
covered by workers compensation and employer's liability or commercial
umbrella insurance obtained by Insured pursuant to this Agreement.
d. Professional Liability (Errors & Omissions) — Insured shall maintain
professional liability insurance as follows:
$1,000,000 - Each Claim Limit
$2,000,000 - Aggregate Limit
Professional Liability coverage may be provided through an endorsement to
the Commercial General Liability policy, or a separate policy specific to
Professional E&O. Either is acceptable if coverage meets all other
requirements. Coverage shall be written on a claims -made basis, and
maintained for the duration of the contractual agreement and for five (5) years
following completion of services provided. The policy shall contain a retroactive
date prior or equal to the Effective Date of the Agreement or the first date of
services to be performed, whichever is earlier. An annual certificate of insurance
shall be submitted to City to evidence coverage.
(2) GENERAL INSURANCE REQUIREMENTS
a. Certificates of insurance evidencing that Insured has obtained all required
insurance shall be attached to Agreement concurrent with its execution. Any
failure to attach the required insurance documentation hereto shall not
constitute a waiver of the insurance requirements.
b. Applicable policies shall be endorsed to name City as an Additional Insured,
as its interests may appear, and must afford the City the benefit of any
defense provided by the policy. The term City shall include its employees,
officers, officials, and agents as respects the contracted services. Applicable
policies shall each be endorsed with a waiver of subrogation in favor of City
with respect to the Project.
c. Certificate(s) of insurance shall document that insurance coverage limits
specified in this Agreement are provided under applicable policies
documented thereon. Insured's insurance policy(s) shall be endorsed to
provide that said insurance is primary protection and any self -funded or

commercial coverage maintained by City shall not be called upon to
contribute to loss recovery. Insured's liability shall not be limited to the
specified amounts of insurance required herein.
d. Other than worker's compensation insurance, in lieu of traditional
insurance, City may consider alternative coverage or risk treatment
measures through insurance pools or risk retention groups. City must
approve in writing any alternative coverage for it to be accepted.
e. A minimum of thirty (30) days' notice of cancellation or material change in
coverage shall be provided to City. A ten (10) days' notice shall be acceptable
in the event of non-payment of premium.
f. Insurers must be authorized to do business in the State of Texas and have a
current A.M. Best rating of A:VII or equivalent measure of financial strength
and solvency as determined by the City's Risk Management division.
g. Any deductible or self -insured retention in excess of $25,000 that would
change or alter the requirements herein is subject to approval in writing by
City, if coverage is not provided on a first -dollar basis. City, at its sole
discretion, may consentto alternative coverage maintained through insurance
pools or risk retention groups. Dedicated financial resources or letters of credit
may also be acceptable to City.
h. In the course of the Agreement, Insured shall report, in a timely manner, to
City's Risk Management Department with additional notice to the Contract
Compliance Manager, any known loss or occurrence which could give rise
to a liability claim or lawsuit against City or which could result in a property
loss.
i. City shall be entitled, upon its request and without incurring expense, to
review Insured's insurance policies including endorsements thereto and, at
City's discretion, Insured may be required to provide proof of insurance
premium payments.
j. Lines of coverage, other than Professional Liability, underwritten on a claims -
made basis, shall contain a retroactive date coincidentwith or priorto the date
of this Agreement. The certificate of insurance shall state both the retroactive
date and that the coverage is claims -made.
k. Coverages, whether written on an occurrence or claims -made basis, shall be
maintained without interruption nor restrictive modification or changes from
date of commencement of the Project until final payment and termination of
any coverage required to be maintained after final payments.
I. City shall not be responsible for the direct payment of any insurance
premiums required by Agreement.
m. Subcontractors of Insured shall be required by Insured to maintain the same
or reasonably equivalent insurance coverage as required for Insured. Upon
City's request, Insured shall provide City with documentation thereof.

RECOMMENDATION:
It is recommended that the City Council:
Authorize the execution of a professional services agreement with Stantec Consulting
Services, Inc., in an amount not to exceed $440,000.00 for consultant services related to the
development of the 2025 Park, Recreation and Open Space Master Plan and Needs
Assessment Study for submission to the Texas Parks & Wildlife Department;
2. Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations in the PARD Dedication Fees Fund, in the amount of $141,543.00, from
available funds, for the purpose of funding the PARD Studies programmable project (City
Project No. P00119); and
3. Amend the Fiscal Years 2023-2027 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of a
professional services agreement for consultant services related to the development of the 2025
Park, Recreation and Open Space Master Plan and Needs Assessment Study for submission to
the Texas Parks & Wildlife Department.
A Request for Qualifications was advertised/issued for professional services related to Park &
Recreation development. Statements of Qualifications were received from nineteen firms which
were then evaluated and scored by Park & Recreation Department (PARD) staff. All professional
services submittals were included in the overall scoring, which was broken out into six specific
types of consulting services:
• Systemwide Plans
• Community Park Master Planning and Construction Documents
• Neighborhood Park Master Planning and Construction Documents
• Urban Park Master Planning and Construction Documents
• Trail System Design and Construction Documents
• Drainage/Erosion/Dredging/Pavement Design and Construction Documents
PARD staff evaluated the submittals received and recommends awarding a professional services
contract to Stantec Consulting Services, Inc., based on expertise and availability for delivery of the
specified scope of services.
Under the professional services agreement, Stantec Consulting Services, Inc., (Stantec) will
develop an overall Park, Recreation and Open Space Master Plan which will contain:
• General recommendations for the overall park system;
• Strategies for land acquisition for future parkland and facilities;
• Recommendations for improving existing parks and recreational facilities,
• Recommendations for the creation of new parks, park amenities, and programming,
• Strategies to expand and create additional recreational programming;
• Strategies for economic development for the Fort Worth park and recreation system,
• Financial strategies including possible funding / revenue streams and possible grant
opportunities; and
• Recommendations regarding policy and regulatory revisions and amendments necessary to
protect the final plan vision and concepts.
Stantec will develop, participate, and assist with stakeholder and community outreach /
engagement throughout the project that identifies venues, key participants, stakeholders, and
ambassador listening sessions with up to ten community workshops and ten pop-up events.
The Stantec Team will facilitate meetings to ensure input, review, and direction related to various
activities and deliverables of the planning process.
Stantec, in collaboration with National Service Research, will work with City staff to create a
statistically valid survey and online programming for community engagement. The survey, to be
written in both English and Spanish, is an objective method to determine whether the park system
effectively meets locally established standards.
Stantec Consulting Services, Inc. is in compliance with the City's Business Equity Ordinance by
committing to 12% MWBE participation on this project. The City's MWBE goal on this project is
10%.
City staff recommends awarding a contract to Stantec Consulting Services, Inc. This planning effort
will begin in the Summer of 2023 and will be completed by end of January 2025 or before.
Funding for this project was not included in the FY2023-2027 Capital Improvement Program due to
the pending status of the Request for Proposals. The action in this M&C will amend the FY2023-
2027 Capital Improvement Program as approved in connection with Ordinance No. 25773-09-
2022.
This plan and programs are available in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified -All Funds
project within the PARD Dedication Fees Fund and in the PARD Studies project within the General
Capital Projects Fund, and upon approval of the above recommendations, and adoption of the
attached appropriation ordinance, funds will be available in the PARD Dedication Fees Fund and
the General Capital Projects Fund for the 2025 PROS Master Plan project to support the approval
of the above recommendations and execution of the agreement. Prior to an expenditure being
incurred, the Park & Recreation Department has the responsibility of verifying the availability of
funds.
