HomeMy WebLinkAboutOrdinance 26340-08-2023ORDINANCE NO. 26340-08-2023 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SANITARY SEWER REPLACEMENT CONTRACT 2019 WSM-O, PART 1 PROJECT (CITY PROJECT NO. 103381) IN THE AMOUNT OF $576,867.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CONTRACT STREET MAINTENANCE PROGRAMMABLE PROJECT (CITY PROJECT NO. P00020) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the General Capital Projects Fund, by increasing estimated receipts and appropriations in the Water and Sanitary Sewer Replacement Contract 2019 WSM-O , Part I project (City Project No. 103381) in the amount of $576,867.00 and decreasing estimated receipts and appropriations in the Contract Street Maintenance programmable project (City Project No. P00020) by the same amount. SECTION 2. That should any portion, se ction or part of a section ofthis ordinance be declared invalid, inoperative or void for any reason by a cowt of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions , sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. D ISCUSSION: This Mayor & Council Communication (M&C) is to authorize execution of a construction contract for the replacement of deteriorated water and sanitary sewer mains on the following streets : From To I Scope of Work I n T. White !Anderson Boulevard II Water/Sewer I dy Lane Blue Carriage Lane Water/Sewer Additionally , asphalt pavement rehabilitation will be conducted on all streets subsequent to the water and sanitary sewer main rep lacement. The Water Department's share of this contract is $4 ,506 ,890 .00 , and the Transportation & Public Works Department's share of the contract is $490 ,533 .00 . The project was advertised for bids on April 27 , 2023 , and May 4, 2023 , in the Fort Worth Star-Telegram . On June 1, 2023 , the following bids were received : Bidder Amount Jackson Construction , Ltd . $4 ,997 ,423 .00 Reyes Group , Ltd $8 ,350 ,000 .00 In addition to the contract amount , $520 ,992 .00 (Water: $268 ,742 .00 ; Sewer: $190 ,443 .00 ; Paving: $61 ,807 .00) is required for project management, material testing and inspection , and $272 ,406.00 (Water: $146,050.00 ; Sewer: $101 ,829.00 ; Paving : $24 ,527 .00) is provided for project contingencies . The sanitary sewer component of this project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. Approximately 1 ,140 linear feet of cast iron water pipe will be removed and replaced as part of this project. This project wil l have no impact on the Transportation & Public Works' or the Water Department's operating budgets when completed . Business Equity: Jackson Construction , Ltd ., is in compl iance with the City's Business Equity Ordinance by committing to seven percent Business Equity participation and documenting good faith effort . Jackson Construction , Ltd. identified several subcontracting and supplier opportunities. However, the firms contacted in the areas identified did not respond or did not submit the lowest bids . The City's Business Equity goal on this project is 14 percent. The project is located in Council District 5 . FISCAL INFORMATION/ CERTIFICATION : The Director of Finance certifies that funds are available in the Contract Street Maintenance programmable project within the General Capital Projects Fund and in the Water & Sewer Fund , and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the W&S Capital Projects Fund and the General Capital Projects Fund for Part 1 of the W&SS Contract 2019 WSM-O project to support the above recommendations and execution of the contract.
