AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE WATER & SEWER
COMMERCIAL PAPER FUND, BY INCREASING APPROPRIATIONS IN THE US
287/HIGHWAY 81 AT HARMON ROAD WATER MAIN RELOCATIONS
PROJECT (CITY PROJECT NO. 104514) IN THE AMOUNT OF $400,300.00 AND
DECREASING APPROPRIATIONS IN THE W&S COMMERCIAL PAPER
PROJECT (CITY PROJECT NO. UCMLPR) BY THE SAME AMOUNT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
T hat in addition to tho se amounts allocated to the various City departments for F isc a l Year 2022-2023 in the
Budget of the City Manager, there shall also be adjusted appropriations in the Water & Sewer Commercial
Paper F und , by increasing appropriations in the US 287 /Highway 81 at Harmon Road Water Main Relocations
Project (City Project No. 104514) in the amount of$400,300.00 and decreasing appropriations in the W&S
Commercial Paper project (City Project No. UCMLPR) by the same amount.
SECTION 2.
That should any portion, section or part of a section of thi s ordinance be de clared invalid , inoperative or void
for any reason by a court of competent jurisdiction , such decision , opinion or judgment shall in no way imp ai r
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and
appropriations amending the same except in those in stances where the provi sions of thi s ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly rep eale d.
SECTION 4.
This ordinance shall take effect upon adoption.

Proceeds of Future Debt and Adopt Appropriation Ordinance to Effect a Portion of Water's Contribution to the Fiscal Years 2023-2027 Capital
Improvement Program
RECOMMENDATION:
It is recommended that the City Council :
1. Authorize execution of an engineering agreement with Kimley-Horn and Associates , Inc. in the amount of $320 ,300.00 for the US
287/Highway 81 at Harmon Road Water Main Relocations Project;
2 . Adopt the attached Resolution expressing official intent to reimburse expenditures with proceeds of future debt for the US 287/Highway 81 at
Harmon Road Water Main Relocations Project; and
3. Adopt the attached appropriation ordinance adjusting appropriations in the Water & Sewer Commercial Paper Fund by increasing
appropriations in the US 287/Highway 81 at Harmon Road Water Main Relocations Project (City Project No. 104514) in the amount of
$400,300.00 and decreasing appropriations in the W&S Commercial Paper project (City Project No. UCMLPR) by the same amount, to
effect a portion of Water's contribution to the Fiscal Yeqrs 2023-2027 Capital Improvement Program .
DISCUSSION:
The Texas Department ofTransportation (TXDOT) proposes to reconstruct and widen US287/Highway 81 from IH-35Wto Avondale Haslet Road .
Due to conflicts with the proposed roadway , bridge , and drainage construction at Harmon Road and North Tarrant Parkway, 48-inch water main
valve vaults , blow-off vaults, air release valves and manholes , cathodic protection replacements and adjustments , are necessary along the US
287/Highway 81 corridor.
This Mayor and Council Communication is to authorize execution of an engineering agreement with Kimley-Horn & Associates in the amount of
$320 ,300.00 for the US 287/Highway 81 at Harmon Road Water Main Relocations Project for the preparation of plans and specifications.
Kimley-Horn & Associates , Inc., proposes to prov ide all the necessary design services for a fee of $320 ,300 .00. Staff considers the proposed fee
to be fair and reasonable for the scope of services proposed .
In addition to the contract amount , $80,000 .00 is required for project management, material testing and inspection . This project will have no impact
on the Water Department operating budget when complete .
This project is anticipated to be included in a future revenue bond issue for the Water & Sewer Fund . Available cash within the Water and Sewer
portfolio and the City 's portfolio along with the appropriation authority authorized under the Callable Commercial Paper Program (CP) will be used
to provide interim financing for this project until debt is issued . Once debt associated with this project is sold , bond proceeds will be used to
reimburse the Water and Sewer portfolio and the City 's portfolio in accordance with the attached reimbursement resolution. Under federal law,
debt must be issued within approximately three years in order for these expenses to be reimbu rsable. Adoption of the attached resolution does not
obligate the City to sell bonds , but preserves the ability of the City to reimburse itself from tax-exempt bond proceeds .
It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance , as
projects commence , additional funding needs are identified , and to comply with bond covenants. The actions in the M&C will appropriate funds in
support of the Water's portion of the City of Fort Worth's Fiscal Years 2023-2027 Capital Improvement Program , as follows:

Funding will be available in Water Department's W&S Commercial Paper project within the W&S Commerical Paper Fund for the purpose of
funding the US 287/Highway 81 at Harmon Road Water Main Relocations project.
Business Equity: Kimley-Horn and Associates , Inc., is in compliance with the City 's Business Equity Ordinance by committing to 40
percent MWBE participation on this project. The City 's MWBE goal on this project is 10 percent.
This project is located in COUNCIL DISTRICT 7 .
FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that funds will be available after the sale of Water and Sewer bonds in the W&S Commercial Paper Fund and
upon approval of the above recommendations and adoption of the attached appropriation ordinance , funds will be available in the W&S
Commercial Paper Fund for the US 287/HW 81 Harmon Water Repl project to support the above recommendations and execution of the contract.
Prior to any expenditure being incurred, the Water Department has the responsibility to validate the availability of funds .
