HomeMy WebLinkAboutOrdinance 26348-08-2023ORDINANCE NO. 26348-08-2023 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER & SEWER BOND 2017A FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE VILLAGE CREEK WATER RECLAMATION FACILITY (VCWRF) THICKENER PROCESS IMPROVEMENTS PROJECT (CITY PROJECT NO . C02647) IN THE AMOUNT OF $138,242 .00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED-ALL FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manag er, there shall also be adjusted estimated receipts and appropriations in the Water & Sewer Bond 2017A Fund, by increasing estimated receipts and appropriations in the Village Creek Water Reclamation Facility (VCWRF) Thickener Process Improvements project (City Project No. C02647) in the amount of $138 ,242 .00 and decreasing estimated receipts and appropriations in the Unspecified-All Funds project (City Project No. UNSPE C) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a cowt of competent jurisdiction, such decision , opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance , which said remaining provi s ions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Water & Sewer Bond 2017 A Fund by increasing estimated receipts and appropriations in the Village Creek Water Reclamation Facility Thickener Process Improvements project (City Project No. C02647) in the amount of $138,242.00 and decreasing estimated receipts and appropriations in the Unspecified - All Funds project (City Project No . UNSPEC) by the same amount to effect a portion of Water's contribution to the Fiscal Years 2023-2027 Capital Improvement Program. DIS C USS ION: On August 25 , 2015 , Mayor and Council Communication (C-2 7433), the City Council authorized an engine ering agreement with Freese & Nichols , Inc. (City Secretary Contract No . 47018), in the amount of $295 ,113 .00 , for study , evaluation and conceptual design of th ickening processes at Village Creek Water Reclamat ion Facility (VCWRF). On August 1 , 2017 Mayor and Council Communication (C-2 8 317), the City Council authorized an engineering agreement with Freese & Nichols , Inc., (City Secretary Contract No . 49500), in the amount of $1 ,809 ,500 .00 for V illage Creek Wate r Reclamation Facility Sludge Thicken ing Improvements . The agreement was subsequently revised by Amendment No . 1, in th e amount of $738,000 .00 authorized by M&C 20-0464 , on June 23 , 2020 that provided for construction support services , Amendment No. 2 , in the amount of $99 ,500 .00 administratively authorized on September 29 , 2021 that provided recommendations for improvements to the sludge draw off box and other improvements related to the VCWRF excessive solids and Amendmen t No . 3 , in the amount of $99 ,427 .00 authorized by M&C 22-0408 on June 14 , 2022 that provided for blend tank rehabilitation design , blend tank bypass valve vault design and odor control bridge foundation design . Amendment No . 4 provi des for additional construction support services that are necessary on the project. In addition to the amendment amount , $20 ,000 .00 is necessary for additional proje ct management on the project. Business Equity: Freese & Nicho ls , Inc . is in compl iance w ith City Business Equity Ordinance by committing to six percent MWBE participation on this project. The City's MWBE goal on this Amendment is five percent. It is the practice of the Wate r Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance , as projects commence , add itional funding needs are identified , and to comply with bond covenants . FISCAL INFORMATION/ CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the Water & Sewer Bond 2017 A Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Water & Sewer Bond 2017 A Fund for the VCWRF Thickener Process Im prov project to support the approval of the above recommendations and execution of the amendment.
