AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS FOR THE OPEN SPACE PRE -ACQUISITION PROJECT
(CITY PROEJCT NO. 103511) WITHIN THE GENERAL GAS LEASE CAPITAL
PROJECTS FUND BY S200,000.00, AND DECREASING ESTIMATED RECEIPTS
AND APPROPRIATIONS FOR THE OPEN SPACE APPROPRIATIONS PROJECT
(CITY PROJECT NO. PA0001) BY THE SAME AMOUNT, HEREBY
AUTHORIZING THE USE OF OPEN SPACE FUNDS FOR PRE-ACQUSITION
COSTS IN ADVANCE OF LAND ACQUSITION; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in Open Space
Pre -Acquisition Project (City Project No. 103511) of the General Gas Lease Capital Projects Fund, by
$200,000.00, and decreased estimated receipts and appropriations for the Open Space Appropriations Project
(City Project No. PA0001) by the same amount, hereby authorizing the use of Open Space funds for pre -
acquisition costs in advance of land acquisition.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance adjusting receipts and appropriations in the General Gas Lease Capital Projects Fund
by increasing estimated receipts and appropriations in the Open Space Pre -Acquisition Project (City Project No. 103511) in the amount of
$200,000.00 and decreasing estimated receipts and appropriations in the Open Space Appropriations Project (City Project No. PA0001)
by the same amount for the purpose of funding pre -acquisition costs related to Open Space Land Acquisitions; and
2. Amend the Fiscal Years 2023-2027 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the appropriation and use of funding related to pre -acquisition of
open space costs anticipated this fiscal year and in future years (City Project No. 103511).
This M&C authorizes additional funding for pre -acquisition costs spent prior to taking proposed property to Council for acquisition approval (City
Project No. 103511). On August 10, 2021, M&C 21-0551 approved an initial $50,000.00 for pre -acquisition costs. Due to increased properties
under review and pre -acquisition investigation needs, it is estimated that an additional $200,000.00 of Open Space Appropriations project funding
is needed for initial site investigation activities such as appraisal, survey, environmental investigations, staff time, earnest money, and other
applicable costs associated with evaluating a site to determine whether acquisition should be pursued.

Open Space funding was not included in the FY2023-2027 Capital Improvement Program. Open Space will continue to be appropriated via
M&C's as funding becomes available and each acquisition or use of funds is identified and requested for approval by Mayor and Council. The
action on this M&C will also update the FY2023-2027 Capital Improvement Program.
This project impacts ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Open Space Acquisition project within the General Gas Lease Capital
Prj Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the
General Gas Lease Captial Prj Fund for the Open Space Pre -Acquisition project. Prior to an expenditure being incurred, the Property
Management and the Transportation & Public Works Departments have the responsibility to validate the availability of funds.
