HomeMy WebLinkAboutContract 26589 CITY SECRET NT T ARY, CORAC NO .11 we:, FOURTH AMENDMENT TO CITY OF FORT WORTH CITY SECRETARY CONTRACT NUMBER 24692 STATE OF TEXAS § COUNTY OF TARRANT § THIS AMENDMENT to City of Fort Worth City Secretary Contract Number 24692 is executed on the 29th day of January, 2001 by and between the City of Fort Worth, a municipal corporation of Tarrant and Denton Counties, Texas (hereinafter called "Owner"), acting by and through Mike Groomer, its duly authorized assistant city manager, and Austin Commercial, Inc. (hereinafter called "Construction Manager", "Project Manager" or "Manager") acting by and through its Vice President Steve Warnick. WITNESSETH: WHEREAS, the Owner intends to construct the Fort Worth Convention Center Phase I Expansion, (the "Project"), in the City of Fort Worth.. Texas, to be built according to the Plans and Specifications prepared and/or assembled by Construction Manager through Carter and Burgess, Inc.; and WHEREAS, the City Council of the City of Fort Worth, Texas, authorized the City Manager to enter into an agreement (City Secretary Contract Number 24692 as amended by City Secretary Contract Number 25295, City Secretary Contract No. 25954 1 hereinafter referred to as "PM Agreement") and City Secretary Contract No. 26062 {hereinafter referred to as the Construction Management Agreement}) with Manager for Project Management Services and Design Services for the Project; and WHEREAS, pursuant to such PM Agreement, Construction Manager has heretofore been providing professional services to Owner in development of plans, specifications, schedules and budgets for the Project; and WHEREAS, pursuant to such Construction Management Agreement, Construction Manager has been providing professional services to the Owner in executing contracts with the general contractors as authorized by City Council; and WHEREAS, on November 14, 2000, the City Council approved the redistribution of the Project Budget by M&C G-13073. NOW, THEREFORE, Owner and Manager, in consideration of the foregoing, and the terms and conditions herein contained, do hereby amend City of Fort Worth City Secretary Contract Number 24692, as amended by City Secretary Contract Nos, 225295, 25954, and 26062, as follows: AUSTIN COMMERCIAL,INC, FORT WORTH CONVENTION CENTER FOURTH AMENDMIE"N'T Page I of 3 t Section 1. The fifth"Whereas" is amended by substituting "March 15, 2002" with"April 1, 2002", The sixth"Whereas" is amended by substituting "$425,000" for"$990,000". Section 2. Paragraph 4.7 of City Secretary Contract No. 26062 is amended to be and read as follows: "The Project Budget as stated in City Secretary Contract No. 25295 is amended to be $46,750,000, as contained in Attachment I hereto". Section 3. Attachment I to City Secretary Contract No. 26062 is replaced in its entirety with Attachment I attached hereto. Section 4. Attachment 2 to City Secretary Contract No. 26062 is replaced in its entirety with Attachment 2 attached hereto. All other terms, conditions, and covenants contained in City Secretary Contract Numbers 24692, as amended by City Secretary Contract Nos. 25295, 25954, and 26062 not amended herein continue in full force and affect. Accept the bid from the low bidder Walker Building Corporation; and 2. Authorize the Project Manager, Austin Commercial, Inc. to execute a construction contract with Walker Building Corporation for the construction of the shell and core of the Phase 1 Expansion and Renovation of the Fort Worth Convention Center, including the base bid and Alternates 3 and 5 for a total contract in the amount of$22,062,000 and a duration of 475 calendar days; and 3. Authorize an adjustment in the Phase 1 budget and scope in the amount of$2,750,000; and 4. Authorize the payment of funds to Austin Commercial, Inc. for the payment to the construction contractor under the contract, as work progresses. DISCUSSION: The Shell and Core Package was advertised for bid in the Commercial Recorder on August 31 and September 7, 2000. On September 28, 2000, the following bids were received from four contractors: a. Walker Building Corporation b. Coronado Builders, Inc. C. Sedalco, Inc. d. Satterfield & Pontikes Construction, Inc. Their bids are summarized on the attached bid tabulation. The Shell and Core Package is the third construction contract to be awl arded for Phase 1 of the renovation and expansion of the Fort Worth Convention Center. the"work consists of construction for the roof and curtain walls, the interior floors, walls and stair Gases, the installation of basic mechanical, i electrical and plumbing systems, and site improvements for the new ballroom and grand entrance. Recommended alternatives are ##3 Star Tower {$77,000} and ##5 Chiller {$375,000 . The recommended adjustment in the Phase 1 scope and budget is necessary to allow a portion of Phase 2 work to be included within Phase 1 of the project. Phase 2 work included in this bid is the 1 j Southeast meeting rooms, 2) Southwest corner facade/entry, and 3 'mechanical equipment. With these changes in scope of budget, the Phase 1 budget will increase to $46,750,000. The j estimated total project budget will increase from $70,000,000 to $72,893,000. Austin Commercial, Inc. reviewed the bids and qualifications of the low bidder and recommends award to Walker Building Corporation. Walker Building Corporation is in compliance with the City's M1WBE Ordinance by committing to 33% MIWBE participation and subcontracting with MIWBEs for each subcontracting opportunity identified. The City's goal on this project is 30%. Under the terms of the Project Management Agreement, Austin Commercial, Inc. will execute a construction contract with the contractor and manage the construction. Progress payments will be reviewed and approved by Austin Commercial, Inc. who will be paid by the City for payment to the contractor. The Fort Worth Convention Center is located in COUNCIL DISTRICT 9.
