HomeMy WebLinkAboutOrdinance 17313-12-2006Ordinance No. 1 731 3-1 2-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS ANb APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF $85,545.19 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE CLEANING AND REPAIRING OF THE INTERIOR LINING OF BRENNAN SERVICE CENTER'S Al30VEGROUND STORAGE TANK WITH EAGLE CONSTRUCTION AND ENVIRONMENTAL SERVICES, LLP; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SI=CTION 1 That in addition to #hase amounts allocated to the various City departments for 1=iscaf Year 2005- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Management Project Fund in the amount of $85,545.19 from available funds Far the purpose of funding the cleaning and repairing of the inferior lining of Brennan Service Center's aboveground storage tank with Eagle Construction and Environmental Services, LLP. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Approve the transfer of $85,545.19 in undesignated funds from the Environmental Management Operating Fund to the Environmental Management Project Fund (R101}; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $85,545.19; and 3. Authorize the City Manager to amend the purchase agreement with Eagle Construction and Environmental Services, LLP for cleaning and repairing the interior lining of the Brennan Service Center Above Ground Storage Tank (AST) in the amount of $85,545.19. ©ISCUSSI®N: On January 31, 2006, City Council approved M&C Prv10309 authorizing the City Manager to issue a purchase order in the amount of $39,945.14 to pay Eagle Construction and Environmentai Services, LLP (Eagle) for remediation services including contaminated sail removal and disposal at the Brennan Service Center. Work nn this project began in Apri( 2006. The Environmental Management Department also contracted for the cleaning of all city owned tanks scheduled to receive ethanol-blended fuels. Eagle Construction and Environmental Services, LLP (Eagle) was awarded the purchase order far the tank cleaning. Fallowing completion of remedial activities and piping repair, the 128,000-gallon above ground storage tank at the Brennan Service Center was drained. During tank cleaning operations, the integrity of the interior composite liner was evaluated by professional staff and determined to be in poor condition. The exterior roof surface also exhibited areas of concern including oxidation. Further deterioration of the roof area could compromise the quality of the ethanol-blended fuel if water leakage from the roof occurred. To avoid risking additional damage to the environment, it was determined by Environmental Management that these emergency repairs were necessary. Therefore, Section 252.022(a)(2) of the Texas Local Government Code exempts such service from the competitive bidding procurement. Eagle was instructed as items were identified to ultimately broaden their scope of work to include removing existing interior composite liner, preparing the interior areas far application of a new liner, and installing a new composite liner on the interior including the floor, sidewalls, and ceiling. Eagle was also directed to apply a new eiastomeric coating on the tank roof to control water intrusion into the new ethanol-based fuel. Lagnatxre: 52BRENNANAST Pale 1 0~2 With the addition of $85,545.19 for cleaning and repairing the lining of the Brennan Service Center aboveground storage tank, the total purchase with Eagle will be $125,490.33. A waiver of the goal for MNVBE subcontracting requirements was requested by Environmental Management and approved by the M/WBE Office. FISCAL INFORMATIONICERTIFICATION; The Finance Director certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Environmental Management Project Fund.
