Ordinance Nc.17314-12-200b AN ORDINANCE INCREASING APPROPRIATIONS 1N THE WATER AND SEWER OPERATING FUND IN THE AMOUNT OF $35,000 AND DECREASING THE UNRESERVED. UNDESIGNATED FUND BALANCE 13Y THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING AN INTERLOCAi_ AGREEMENT FOR THE USE AND MODIFICATION OF A RADIO TOWER OWNED AND OPERATED BY THI TARRANT REGIONAi_ WATER DISTRICT; PROVIDING FOR A SEVERABILITY CLAUSI ; MAKING TWIS ORDINANCE CUMIJLATIV>r OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2008- 2007 in the Budget of the City Manager, there shall also be increased appropriations in the Water and Sewer Operating Fund in the amount of $35,000 and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of funding an lnterlocal Agreement for the use and modification of a radio tower owned and operated by the Tarrant Regional Water Disfrict. SECTION 2. That should any pnrtinn, section or park of a section of this nrdinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3, That this ordinance shall be cumulative of Ordinance No. 17142 ail otL~er ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize Execution of an Interlacal Agreement far Use and Modifications of a Tarrant Regional Water District Radio Tower far the Water Department and Adapt Appropria#ian Ordinance _ . __ REC®MMENDATI®N: It is recommended that the City Council: 1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Water and Sewer 1=und by $35,000.00 and decreasing the unreserved, undesignated fund balance by the same, and 2. Authorize the City Manager to execute an interlocal agreement for use of and modification of a radio tower owned and operated by Tarrant Regional Water District not to exceed $35,000.00. ®ISCUSSI®N: The Tarrant Regional Water District (TRWD) intends to build a radio tower an the balancing reservoir tower located adjacent to the Westland Water tank and pump station. The proposed tower which will be located due west of downtown will be approximately 11.5 miles from the proposed site for the CFW Water Department's WestlNorthwest water treatment membrane plant. The Water Department is asking TRWD to modify the structure to accommodate communication equipment. The Water Department will derive substantial benefits with regards to the proposed radio tower since the location will allow the Department to gain a communication advantage by ensuring the availability of high speed communication at the proposed plant. Currently, our local phone carrier can not guarantee the ability to supply this necessary service to the anticipated facility. With the tower, the future plant will have the ability to have high speed communications capabilities which will allow for the use of security technology, monitoring of the plant for distribution purposes and the potential to provide personnel offices. In addition, the availability of high speed communications would allow this location to be designated as a backup location far mission critical applications. The tower also offers the department higher degrees of area coverage far future mobile technology implementations. The agreement will outline the terms and conditions to construct and maintain the radio tower. The cast to share the facility and tower shall not exceed $35,000. If the Water Department was to construct a tower, the cost would be ten times the shared cost at approximately $300,000. Lo~name: 60RADT0 TOWER page 1 a~2 FISCAL lNFORMATIONICERTIFICATION.
