HomeMy WebLinkAboutContract 26922-T1 CITY SECRETARY CONTRACT NO LICENSE TERMINATION AGREEMENT (CITY SECRETARY CONTRACT NO.26922) This LICENSE TERMINATION AGREEMENT ("Agreement") is hereby made and entered into by and between the CITY OF FORT WORTH (the "City"), a home rule municipal corporation organized under the laws of the State of Texas and acting by and through, its duly authorized Assistant City Manager, and UNITED STATES OF AMERICA,acting by and through General Services Administration. WHEREAS, on or about July 18, 2001 the City and GSA entered into a License Agreement, on file as a public document with the City Secretary as City Secretary Contract No. 26922 (the "Agreement"), under which the City agreed to allow the use, operation and improvement of Federal Plaza Park; and WHEREAS, pursuant to the letter attached hereto as Exhibit "A", which is hereby made a part of this Agreement for all purposes, GSA has requested that the Agreement be terminated by mutual agreement; and WHEREAS,the City is not opposed to a termination of the Agreement; NOW,THEREFORE,the City and GSA agree as follows: The City and GSA hereby mutually agree to terminate the License Agreement, to be effective as of 4C r. WORTH; TX General Services Administration-Federal Plaza Park CSC No.26922 GSA Greater Southwest Region March 21, 2011 Susan Alanis Planning Director City of Fort Worth 1000 Throckmorton Street Fort Worth, Texas 76102 Re: Extinguishment of license over Lanham Plaza Dear Ms. Alanis: The General Services Administration(GSA) owns the Fritz G. Lanham Federal Building. Just to the East of our building is a small City owned park known as Lanham (Federal) Plaza. Currently there is a license in place for GSA's control of the Plaza. GSA desires to have the license extinguished, thereby returning control of Lanham Plaza back to the City. Within the Plaza are a number of important improvements that GSA desires to preserve: security bollards, planters, memorial trees and plaques, flag pole, and a time capsule (see Encroachment Exhibit). GSA requests that the City grant an Encroachment Agreement for these improvements as a substitute for the license agreement. Please let me know if you are agreeable to these terms.
