HomeMy WebLinkAboutOrdinance 26382-08-2023ORDINANCE NO.26382-08-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND, IN AN AMOUNT UP TO (1) $4,720,000.00, SUBJECT TO RECEIPT OF THE GRANT, AND (2) $1,482,000.00 AS A TRANSFER FROM THE TXDOT GRANT MATCH PROJECT (CITY PROJECT NO. 104859) TO SATISFY THE CITY'S MATCH REQUIREMENT, TOTALING $6,202,000.00, FOR THE PURPOSE OF FUNDING THE BOMBER SPUR TRAIL PH 1 PROJECT (CITY PROJECT NO. 104345); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in an amount up to (1) $4,720,000.00, subject to the receipt of the grant, and (2) $1,482,000.00 as a transfer from the TxDOT Grant Match Project (City Project No. 104859) Fund to satisfy the City's match requirement, totaling $6,202,000.00, for the purpose of funding Bomber Spur Trail PH I Project (City Project No.104345). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached Resolution authorizing the execution of an Advanced Funding Agreement with the Texas Department of Transportation for a Congestion Mitigation and Air Quality Improvement project, Bomber Spur Trail Phase I (City Project No. 104345) in the amount of $6,476,198.00 with Federal participation in the amount of $4,720,000.00, indirect State participation in the amount of $274,198.00 and City participation in the amount of $1,482,000.00; 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the 2022 Bond Program Fund in an amount totaling $1,482,000.00, by increasing estimated receipts and appropriations for the Bomber Spur TXDOT Grant Match project (City Project No. 104859) and by decreasing the Trail Gap Connections programmable project (City Project No. PB0010) by the same amount; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund in the amount up to (1), $4,720,000.00 subject to receipt of the grant and, (2), transfer of $1,482,000.00 from the TxDOT Grant Match project (City Project No. 104859) to satisfy the City's match requirement, totaling $6,202,000.00, for the purpose of funding the Bomber Spur Trail Phase I project (City Project No. 104345); and 4. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a Resolution authorizing the execution of an Advanced Funding Agreement (AFA) with Texas Department of Transportation (TxDOT) in the total amount of $6,476,198.00 for a Congestion Mitigation and Air Quality (CMAQ) improvement project, Bomber Spur Trail Phase I with Federal participation in the amount of $4,720,000.00, indirect State participation in the amount of $274,198.00, and City participation in the amount of $1,482,000.00. In order to administratively track the spending of all funding sources in one project, appropriation ordinances are needed to move appropriations from the programmable project to the static project. This action will amend the 2023-2027 Capital Improvement Program. The trail alignment will be located within the abandoned Bomber Spur rail right-of-way and North Z. Boaz Park. This new trail will provide a significant link in the Fort Worth Metroplex Veloweb system. Anticipated improvements include a 12-foot wide concrete paved trail, 3-foot wide shoulders on both sides of the trail, trail structures (pedestrian bridge, retaining walls, drainage structures, etc.), traffic control, interpretive signs and 911 location signs. Kimley-Horn and Associates, Inc., is currently under contract with the City to perform the engineering services for Bomber Spur Phase I. The Trail Gap Connections is a voter approved $5,500,000.00 project approved in the 2022 Bond Program, Proposition B, Trail Gap Connections. Trail Gap Connections Project Description: design and construction of trails citywide to address gaps between trail sections within the trail system, including locations where city funds can be leveraged through grants and partnerships with other organizations and agencies, including, but not limited to, Bomber Spur Trail, Mistletoe Bridge to Forest Park Trail Connection, and Sycamore Creek Trail. To date, the City has released $2,523,046.00 of the approved 2022 Bond Program funds. The city will release additional funding for this project each spring. Federal grant funds will cover 80% of construction costs. City's matching funds will cover the expenditures of engineering design, environmental study and 20% of construction costs. City's available funds amount of $2,500,000.00 for this project exceeds the estimated AFA City's matching funds amount of $1,482,000.00. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official intent to reimburse what was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for this project was not included in the Fiscal Years 2023-2027 Capital Improvement Program (CIP) since Grant funds are not included in the CIP. The action in this M&C will amend the Fiscal Years 2023-2027 CIP as approved in connection with Ordinance 25773-09-2022. The Bomber Spur Trail Phase I project is located in COUNCIL DISTRICT 3. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Texas Department of Transportation FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Grants Cap Projects Federal Fund for the Trail Gap Bomber Spur Phase I project. The Park & Recreation Department (and Financial Management Services) is responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Park & Recreation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
