ordinance Na. 1732x-12-zaas AN ORDINANCE INCREASING )=STIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUNb IN THE AMOUNT OF $28~,a31 FROM AVAILABLE FUNDS FOR THE PURPOSE OF TRANSFERRWG SAID FUNDS TO THE STREET LIGHT AND SIGNAL IMPROVEMENTS FUND TO ADDRESS CAPITAL NEEDS; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts aliocated to the various City departments for Fiscal Year 2a06- 2ao7 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessments Fund in the amount of $285,031 from available funds for the purpose of transferring said funds to the Street Light and Signal Improvements Fund to address capital needs. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, imperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shah in no way impair the remaining portions, sections, or parts of sections of this ardinance, which said eemaining provisions shall be and remain in foil force and efFect. SECTION 3. That this ardinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take efFect upon adoption. RECOMMENDATIOTI: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Assessments Fund in the amount of $285,031 from available funds; 2. Authorize the transfer of $285,031 from the Special Assessments Fund to the Street Light and Signal Improvements Fund for the purpose of addressing capital needs; 3. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Light and Signal Improvements Fund in the amount of $285,031 from available funds; and 4. Authorize the City Manager to execute a contract with McClendon Construction Ca., lnc., in the amount of $334,913.50 for pavement construction on Sedona Street from Yuma Street to Dead-End {2004 C1P Project No. 00248). ©fSCUSSION: The 2004 Capital Improvement Program (CIP) includes funds in the amount of $9,000,000 for Traffic Signals of which $600,000 was designated for the Railroad Safety Program. A portion of the 2004 CIP Railroad Safety Program funds, as well as funds in the amount of $286,031 from the Specia! Assessments Fund will be used for the construction of Sedona Street, Yuma Street to Dead End. Sedona Street is to be constructed as a result of a settlement with the Fort Worth & Western Railroad {FWWRR) (M&C G-14611). The settlement required the city to close two street crossings over the FWWRR at other locations. One of these street crossing locations was the Mississippi Avenue underpass and as a result of the closure, a parcel of private property lost access to a public street. The construction of Sedona Street is required to provide access for the private property to a public street. This project was advertised on July 27, 2006 and August 3, 2005. The following bids were received on August 31, 2005: BIDDERS McClendon Construction Co., Inc. $334,913.50 Advanced Paving $341,882.35 Stabile & Winn, Inc. $512,277.50 Logname: 305192 AWARDMC Page 1 of 2 TIME OF COMPLETION: 65 Working Days Specified City staff is recommending award to McClendon Construction Co., Inc. McClendon Construction Co., Inc., is in compliance with the City's MlWBE Ordinance by committing to 24 percent MIWBE participation. The City"s gaal on this project is 19 percent. Funding in the amount of $34,161.18 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close nut. The contingency fund for possible change orders for paving and drainage improvements is $16,746.00. The project is located in COUNCIL DISTRICT 5, MAPSCO 91 C. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Street Light and Signal Empravements Fund.
