INTERLOCAL AGREEMENT FOR PUBLIC MASS TRANSPORTATION
IMPROVEMENT
MODIFICATIONS AND ALTERATIONS
BETWEEN
THE CITY OF FORT WORTH
AND
THE FORT WORTH TRANSPORTATION AUTHORITY
This Interlocal Agreement is made by and between the CITY OF FORT WORTH,Texas hereinafter
referred to as"CITY",and the FORT WORTH TRANSPORTATION AUTHORITY,dlbla the T,hereinafter
referred to as"the T". It is made between two governmental subdivisions of the State of Texas pursuant to
the Interlocal Cooperation Act, Article 791.001, et seq., of the Texas Government Code.
1. The purpose of this Interlocal Agreement is to enhance the quality of transportation services
and certain public thoroughfares within the boundaries of CITY for the benefit of the citizens of the CITY
and the riders of the transportation system operated by the T, and to do so in an efficient and economical
manner.
2. The CITY and the T both recognize that each, individually, has the legal authority to modify
and alter public streets and thoroughfares within the boundaries of CITY in carrying out their respective
purposes,and that such actions are a governmental function. Further,each party,individually,has the legal
authority to carry out the street modifications and alterations within the boundaries of CITY which are of
the type described in section 3 of this Contract.
3. Effective May 1,2002, and for the twelve month period from that date through April 30,2003
(hereinafter referred to as the"Year"), CITY and the T agree to implement a street modification on Public
Mass Transportation Improvements and Modifications consistent with and limited by the powers of the T
to provide public transportation and general transportation services as set out in Chapter 452 Texas
Transportation Code(hereinafter referred to as the"Program"). The T hereby agrees to provide funds for
the specified Public Mass Transportation Improvement Modifications and Alterations to compensate CITY
for partial costs of carrying out the Program as set out in section 4 of this Contract. CITY and the T further
agree that the project included in the Program will be related to,and necessary or useful in carrying out the
purposes for which the T was created or within the powers of the T under state law. CITY will develop the
Program and provide a copy of it to the T prior to beginning its implementation.
A, The Program will include installation a traffic control and pedestrian signal system at the
intersections agreed to by the T and City staffs to handle increased traffic in the immediate
proximity of the Trinity Railway Express including but not limited to the Intermodal
Transportation Center, and/or certain bus transfer centers and routes.

B. As subsequently identified and mutually agreed\oio writing hv the I and the City,the City
will remove those parking meters in the vicinity of the Intcnnodal Transportation Center
("ITC")to provide for safe traffic patterns,and will establish and enforce such area asuno
parking.
C. The Program will provide for other such public street and improvements
including safe traffic improvements us may be determined in accordance with applicable
statutes,rules, and regulations.
4. The T shall pay CITY$400,000 from its current revenues during the Year for activities which
are of the nature described io Section 3of this Agreement. The T's portion will hc paid within 30 days of
the CITY'S submission of the Program detailing the work accomplished and to be accomplished and paid
for by the CITY.
5. CITY agrees that the projects io the Program shall ho constructed in such manner uo to
accommodate, withstand and hold up under regular use by the T's buses and/ or Trinity Railway Express

7. Both parties agree and acknowledge that the amounts to be paid by the T will be such as to

Dear Mr. Bartosiewicz:
Pursuant to the Interlocal Agreement (ILA) between the City and the T dated May 1, 2002. the
City of Fort Worth has initiated the Public Mass Transportation Improvements and Modifications
Program ("Program") defined in the agreement as follows:
I A traffic control signal system has been installed at the intersection of Ninth and
Jones Street. The City will maintain this system.
2. Three (3) parking meters will be removed from the north side of Ninth St.
immediately west of the Jones St. intersection.
3. The City will establish and enforce a no parking, zone on the east side of Jones St.
from the comer of Eight St. south to the taxi cab turnout immediately north of the
front door of the ITC.
The ILA now requires the T to remit payment for the Program. As mutually agreed the specifics
above and payment of the T represent completion of the Program referenced in the ILA.

SUBJECT AUTHORIZE THE EXECUTION OF AN INTERLOCAL AGREEMENT WITH THE FORT
WORTH TRANSPORTATION AUTHORITY FOR PUBLIC AND GENERAL
TRANSPORTATION - RELATED STREET IMPROVEMENTS
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute an Interlocal Agreement with the Fort Worth Transportation
Authority (the T) under which the T will fund $400,000 for public and general transportation-related
street improvements undertaken by the City of Fort Worth; and
2. Accept and increase estimated receipts in the Contract Street Maintenance Fund by $400,000 from
funds received from the T for public and general transportation-related street improvements; and
3. Authorize the transfer of $400,000 in previously appropriated City street maintenance funds from
the General Fund to the Special Assessments District Fund for improvements to the Fort Worth Rail
Market.
DISCUSSION:
Under City Secretary Contract (CSC) No. 19689, the T annually gives the City 15% of the amount of the
T's sales tax revenues attributed to covered sales within the City for the previous calendar year. These
funds are used by the City solely for making public and general transportation-related street repairs.
The T was recently notified that an additional $400,000 in federaf funding has become available for the
same purposes. The proposed Interlocal Agreement with the T will allow the City to accept this one-
time funding and will provide that the City will use the funds for the same limited purposes as provided
under CSC No. 19689.
Because of the unexpected $400,000 in federal funds that the City will receive from the T for public and
general transportation-related street improvements, City staff recommends that City funds previously
appropriated for the same purpose be used instead for the public purpose of making final improvements
to the Fort Worth Rail Market (the Market).
The Market, a project of the Downtown Tax Increment Financing District, will be located in the Santa Fe
Northern Warehouse on Jones Street and will provide over 40,000 square feet of space for merchants
selling food, flowers and an assortment of specialty items. In addition, a weekend farmers' market will
showcase locally grown produce, crafts and entertainment. This City funding is required in order for the
Market to open in time for its scheduled debut on May 10, 2002.
