PARRIS SURVEY, ABSTRACT 1222, BLOCK 17, SOUTH FORT WORTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLATS THEREOF, RECORDED IN VOLUME 388-184, PAGE 17, VOLUME 388-144, PAGE 30, AND VOLUME 204, PAGE 15 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY .523 ACRES OF LAND FOR THE RIGHTS OF WAY AND APPROXIMATELY .069 ACRES OF LAND FOR THE ALLEY; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of those certain called streets known as Jennings Avenue & Butler Street, both sixty -foot -wide public rights of way, situated in the E. Parris Survey, Abstract No. 1222, City of Fort Worth, Tarrant County, Texas, Block 17, South Fort Worth Addition, an addition to the City of Fort Worth, Tarrant County, Texas, according to the plats thereof, recorded in Volume 388-184, Page 17 and Volume 388-144, Page 30 of the Plat Records of Tarrant County, Texas, and containing approximately 0.523 acres of land more or less, and as more specifically described in Exhibit "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. 2. That a twenty foot wide alley situated in the E. Parris Survey, Abstract Number 1222, City of Fort Worth, Tarrant County, Texas, Block 17, South Fort Worth Addition, an Portions of Jennings Avenue and Butler Street ROW and Alley Vacation (VA-22-012) Page 1 of 2 addition to the City of Fort Worth, according to the plat thereof, recorded in Volume 204, Page 15, Plat Records, Tarrant County, Texas, and containing approximately 0.069 acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easements to the land in the above -described vacated street and alley rights of way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating portions of Jennings Avenue, Butler Street and a portion of an alley in block 17, South Fort Worth Addition to be replatted with the adjoining property for an affordable housing multifamily development to be known as Tobias Place; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Spiars Engineering and Surveying, on behalf of Ojala Holdings, has requested vacation of these rights -of -way to be replatted with the adjoining property for an affordable housing multifamily development to be known as Tobias Place. The City Plan Commission recommended approval of this request at its meetings on June 8, 2022. An acceptable final plat (FS-23-121) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through plat dedication. The City does not own any fee interest in the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M8C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of- way easement for the streets or alley. This project is located in COUNCIL DISTRICT 11. A Form 1295 is not required because: This M8C does not request approval of a contract with a business entity.
