HomeMy WebLinkAboutOrdinance 26415-09-2023ORDINANCE NO.26415-09-2023 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER / SEWER BOND 2016 FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE BENBROOK WATER AUTHORITY BENBROOK ALIGNMENT STUDY (CITY PROJECT NO. 105030) IN THE AMOUNT OF $164,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED — ALL FUNDS PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Water / Sewer Bond 2016 Fund, by increasing estimated receipts and appropriations in the Benbrook Water Authority Benbrook Alignment Study (City Project No. 105030) in the amount of $164,000.00 and decreasing estimated receipts and appropriations in the Unspecified — All Funds Project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of an Interlocal Agreement with the Benbrook Water Authority with City Participation in the expected amount of $163,957.00 to conduct a sewer alignment study; and 2. Adopt the attached appropriation ordinance adjusting appropriations in the Water / Sewer Bond 2016 Fund by increasing appropriations in the amount of $163,957.00. Project (City Project No. 105030 in the amount of $164,000.00 and decreasing appropriations in the Unspecified — All Funds Project (City Project No. UNSPEC) by the same amount, to effect a part of Water's contribution to the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The Benbrook Water Authority (BWA), an existing wastewater wholesale customer, (City Sectary Contract No.49267) and the City of Fort Worth desire to plan for future increased growth and demand for additional wastewater flows. The entities have agreed to share the costs of a sewer alignment study for a sewer interceptor that will serve their respective needs. This Interlocal agreement will provide for BWA to conduct the alignment study of the sewer interceptor system currently comprised of the City of Fort Worth's 30" and 36" M-513* sanitary sewer main that runs through the City of Benbrook to which is tied BWA's 18" sewer main. The sewer alignment cost sharing formula is based on future estimated flows from the City of Fort Worth not to exceed 6.5 Millions of Gallons per Day (MGD). The combined peak flows from both Fort Worth and Benbrook Water Authority is a total of 12.2 MGD upstream of the existing 30" segment of M-513. The 30" segment has an existing capacity of 13.0 MGD. Table 1, below, describes the anticipated cost share based on weighted average and Table 2 describes peak wet weather flows used to calculate the weighted average. It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.
