WTTNESSETH WHE�LEAS, Texas Governr�ent Code, Chapter 791,authorizes the formulation af interlocai coaperai�on �greements bet�we�en and amang local governm�nts; and WHEREAS, Texas Gavernment Code, §'�9f.011 provi.des that a local ga�ennment may cont�a�t with anofher to perf�rm governme�tal fi�nations and services, and §791.003(3j(H) defines waste disposal as a. gover�mental function and serv�ice; �nnd WHL�REAS, Texas Gaver,r�ne�t Code, §'�91 A25 pra�vides that a local gover�rn��t may agree with another lacal ga�erainent ta purchase services; gnd WHEREAS, Fart Worth and Participating City desire to e�ter into an int,�rlocal agreeineut whereby �'ort Worth will p�rchase the services of a r�raste disposallrecyc3ing firm or firms gnd will adminis#er a hausehald hazardous wast� collection prc�gram; aud WHEREAS, �on Warth an�. The Fort Worth Mobile Collection LTnit is de�igaed to hold the hazardous waste af apprvxi�nnately 50 ta 75 households. Particinati�� Cities, when used in the plural, means �ort Worih, Participating C�€jr, aud a11 other entities which have �ntered int� interlocal agreements with Fort Wvrth for the ECC hausehoid hazai-db�s waste callection pxagram. Persan means a� i�tdividu€x1, corporatinn, organizati.on, gove�en�, or gavern��z�tal subdivision or age�cy, business hust, parinership, association, ar any other legal e�tity. Waste has the sat�xe mEanin� as "solid wsst� " as tl�at term is defined in T�xas He�lth and Safe�.y Code §361,�03, and including hazardous substances. B. '�]LuJ f �� 'TERM Tl�is Agr�ent shal� be e#�ective fro� the date th� last party has signed this agreement tluough Segtember 30, 20Q3. 4, SERVICES f)F FORT WORTH Fart Worth agrees to perform the %llawing s�rvices for �articipatiu�g City in coxmectian witb the ECC hous�hold hazardous waste collectavn program: A. Fort Warth wili administer a xegianal hauseho�d haz�rdous waste coilection program. This program wi11 inciude the operatian o£the Fn�ironmental Collectaoa� Center, wluch wil� accept for disposal ancllor recycl'uig housvl�old hazardous waste fram hot�sehalds loeated within Participatin.g City. Fort Worth �b.all not accept��compressed flammable gas containers; radioactive �.terials; v�plasives or po�tially shvc� se�sitive matexia�s; biological, etialogic, and infec�iaus �naterials; wastes from lausinesses; and any other wastes that Fart Wortl� has determined are unacceptable. B. �'ort Warth will emp�oy or retain persormel to provide t�he servie�s necessary tc� perform k'ort Worth's abligations ia this Agreement. C. Fort Warth will e�ter into a contraetts) with waste dispasaUrecycling firm(s)for the handling, collecbion, transporta�ioz�, starage, d.isposal, treatrae�xt, recavery, and/ar reuse ofbousebold hazardous waste, which is callected at the ECC. D. Fort Wnrth will, if requesterl in writing by Participati.ng City, provide Participatia�g City with copies of waste nn�nifests far shi�nents of waste frorn tha ECC. E, Fort Wo�. will, i£ requested �n writing by Particip�g City, provide Par�icipating Ciry a ana�ly report of the Parbicipating City 's households wb.o disposed of househa�d haza�edous wasie at xhe Envira�ne3nta1 Callec�ion Center or a Mnb�le Coll�cfion Event. F. F'ort Worth will issae a repnrt anci a bill at ehe e�d of each quarter detailing the n�ber o� Participat�ng Ci#y 's �touseholds that di�posed of hanschold hazardaus waste at the Enviro;nmentai Callect�an Center or at a mobile coll�ction ev�nt in a� annount nat to exceed EIGHT THOUSAND AND NO/1aQD�LLARS {$8,000.00). G. Fort Worth will act ra�nder this Agr�ement in accordance with all applicable s�ate and federal Iaws. H. Tite waiver shal] be in the form of E�ibit B Di S11T1118Y fpi1T1 appraved by Fort Worth. The sxgned waiver must be sent to Fort Worth 1 week before ti�e Mobile Col�ection Event. If the sxgned waiver is not sent to Fart Worth I waek before the Mo�ile Collec#ion Event, Fart Worth will not send die Fart �Vorth Moi�i�e Collection Unst to the event and Participating City witl, in na evenfi, be entitled ta any daznages of recoveiy of any costs, except as pzavided herein. (6) Available Dates Participating City aalrnowlscige� that Fort Warth cantracts with other munici�aliHes and tliat Fort Worth will be accommodating eac� Participating City's request on a first coxne first serv�d basis, There�ore, Participating Cif�r ac�Cnowledges that its chosen date to schedule a�nat�ile collection even� may be �reserved by a�►other City and Parti.cipating City vvill have ta choase another date. Participating Cify will, in no event, be entit�ed to any damages ox recovery a£atiy costs, except as provided h�rain. 2. At the Mobile Collection Event, Participating City acknawledges and agrees that Fort Worth s�all accept fiouseha�d hazarda�s waste fram the first 50 hausehalds that shaw proaf af tesidency at th� Mc�bi�e Ca11ec1ion E�vent. After the first 50 households, Fort 't�V'nrth wil� deterinr�ne in its sols discreiion how much mors wasfie it can accept and stc>re proper�y. If more housshalds arrive at th€ ev�nt t1�an �'ort Worth can accep� Participating City will in no event �e entitled �o any ciamaga of recovery of �y costs, exc�pt as provided herein. 3. Due to the Iac3c af storage �pace at the ECC, Farticipatian� Ciiy ac�Cnawle�ges and agirees that if it requ�sts the Fart Worth Mobile Collecti�n Unit at a mobile collection e�+erit, a Participating City's Nan Fort Worth Mobile Collectian Unit shall not aLso be at the e�ent. 4. City, in its svle disctetion, will determine whether to send the Fart Worth Mahile Collectian Unit to P�rticipating City "s Collectian Event during ad.verse weath�r or the tlu�eat ofr adverse weather including but no# 3�i#ed to sl�et, snavv, rain, mist or l�ail, I�, the event Fart Worth deterinines not ta send the �'ar� Wartt� Mnbile Colleetion Uni�, Fort Worth st�all. nntify persons listed in Section 5, Paragraph A ar�d shall ��d a Fort Worth employee ta �e Participating City's event to tell any residents tha� come to dispose of household hazardous waste; ]) that t�e �ort Wortb Mob�le Co�lec�on Unit will not be coming to the event, and,2} that the resi�ient �an go to the ECC to dispose of the w�aste and prc�vide a�ag to the ECC, 5. DUTIES OF PART�CIl'ATING CITY Participating Gity �grees �o perform Yhe following duties in connechon with the household hazardous waste Col�ection progra�rn: A. Pariicipating City wilX coordinate and fimd all program advertising tar��ed to its avu� citizens, as it deexns necessary. Such advertising shall include the type of wastes t�at wi11 he accepted at the ECC, th� requirem��t of proof of residency and weather cancellatian infarmation. C. Part�cipatiug City shall riotify its residents af t�e ECC hours af opera�ion and dates it is clased as pro�ided in Sectian 9`"The En�ironm�mtal Collection Cent�r Haurs af Operatia�." D. Participating City m�y choase fo utilize a voucher syste�n for its residents in order for them to bri�ng HH�V tv th�; ECC. If ParticipaEing City ehoases to use such a system, it shall notify Fort Worth of the d�cisio�, and shall provide Fart Worth with a copy of ths official voncher. In addiiion, if a cit+zen from a Participating City that n1ali�es a voucher systam comes to the ECC or a mobi.te collection event without a�vaucher, Partiaipating City acknovvledges and a�rees that Fart Wortti will not accept the household hazardaus waste untiI Participatirig City autho�es the acceptance in writing. E. Partici�ating City m�ay s�bx�ait a written reques� fnr a rno�thly report �isting tbe number of its city's househalds that have disgaseci of househald hazardous waste at th� ECC ar a mohile collection event. F. Participating Ciiy shall pro�ide traffic control and siguage for the �nobile collection events, and s�all pro�de personne� ta assist Fort Worth with the survey and screening ofpersons dropping offhousehofd ha�ardaus waste. Particinatin� Citv's Mobile Collection Units Collectin� Household Hazardous Wast� PaxtiGipa#ing City shall ad�ise the ECC progra� manager at least 72 hours in advance af its mnbile collec�ion events. Farticipat�ng City shall aallect anly HHW during a mot��le collection event. Wastes from� connm�rcial, agric�ltural, and industria� sources shall not l�e accepted. Participating City shall not accep� compressed flamrnable gas contaiuners; radioaotive mater�a�s (i.e. s�xoke c�etectors}; r:xplosiv�s or patentially shock sensitive materials; hiologic�l, etiologic, and infectiaus rnaterials, and any ot�cer wastes �at Fart Worth has det�Yninsd are unaccepfable, inc�uding but not limited to ammunition, building material, earplosives, �adical wast�, teres, waste ge�nerated by business and Propane and Butane C�linders . Fort Worth shall accept aaids, aerosal cans, afl batteries, antifreeze, brake fluid, craft and hobby c�aemicats, degreas�rs, drain cleaners, fertilizer, fluorasc�nt ligh�s, h�rbicides, honsehold cle�ners, motor ail, pains/sta�ns, pestiaides, phatx�aceuticals, phota chenaica�s, pool cheinicals, oil fi�ters, solvents, trans�niasion fluid and varnishes, and ather items as deemed accepted by Forth Worth from tim� io tim.e, accarding to the terms nf this Agxe�ncent. 2. In acc�rdance with the latest DQT requirem�nts, Participa�g City's MCU operators will properly categflr�ze, package, matk, Iabel, and laad irito the MCU, al1 wa9tes recei�ed at tixe rnobil� collect�on event. Reayclable proci.ucts (used oil, used oil filters, lat� paint, recyela6le aniiwfreeze, leac�-acic� batter�es, a�d fl�oresce�t liglits) will be segregated into eontainers for r�scycl�bles. 3. A.fte�r accepting wastes, Pa�-ticipating Cifiy's MCU op�aiors shall tfioroughly check each container far proper labeling and identificatinn. If a ccantainer is praperly identifiec�, the material will be seg,regatec� accoxdiug to hazard class and prepared for packaging. If a container �dves not have adequa.te Iabeling to per�nit identification, the MCU operaiors shall then. attempt to identify the material from its physical characteristics usiug HAZCt�T aa�alysis and from information provided by th� household presenting the waste_ �„ ;.�.. . , �� ���:.���:�!� �.W�v�ii�uL� . - � r� 1 " lU� / / � 4. The Par#i..cipatEn� City's MCU aperators s�a11 pactcage all hazardons materials ixx accordance witb. United 5tates Department ai Tra�sportatian (DOT} require�aents, United States Environinental Protection Agency (EPA) requirem�nts, and al� other appiicable fedcral and st�te requirer�ents. After all the wastes have be,�n prop�rly ide�tified and segregated, the MCU aperators will reexamin�e the wastes for compatibility, list them on �.e container coutent sh�ets, �d pack them into drums. Oil�based paints and 1ate�c pain� shall be bulked separat�ly in 55- gallon drums, or if the paint is left in its containe�r, the p�int can be packed � a tined cubic yard bo� and packed and labeled according ta federal aIId state reg�laiions. P�rticipating City shall nat transpart waste that is not HHW to the ECC. Farticipat�.ug City agrees to make its own atrang�nents ta dispose of atty non-HEIVV waste cflllected at the evettt. 5. Pziar tc� transporti�ng ft�:e HI�W frozn the collection event site(s), Paeticipat�ng Ci�r's MCU operators shall complete a Bill af Lading, and s1�a11 keep the Bill of Lading in the cab of the truak h�uling the MCU during tra�port�tion of the HHW to th� ECC. Patricipating City shali requir� that a rn�u��n of one capy of the lat�st No3rth American Emergesicy Response Guideboak be kept withi� the cab af tlte truck. 6. During transportation, Paxticiparing City's MCU operatars shall ptacard the MCU for ira�asportation of hazardous waste i� accaxdanee wit� federai and state law. 7. Upan the return of t�� MCU to the ECC, Paraicipatiug City's MCU operators shall foltow the instructions of Fart Wart�► regardi�g tlze placement of the MCU for unlaading. Fart Warth si�l take possess�on nf tha MCU fram �'arCicipating City after the MCU b.as been praperly parked �or unlaading in accordance vvith Fort Worth's instructions a�d all requiret[ dacum�n.ts ha�ve been delivered #a the ECC program m�nagea' or his designee a� the EGC. �ort VVarth shall, with�a a reasonabl� �nount of time, ra�iload the HHW from the nan Fvrt Worth MCLT and stoze the HHW at tbe EGC. �, � Fort Warth, in its sole discret�on, determ%nes that Participating City's MCU operatars i.mpraper�y packaged any af the I�-IW deliv�red to the ECC, Fari Worth shatl repackage s�ch waste, ancf Participating City s�all reitnburse Fort Worth as set forth in Section lU, Paragraph B. 9. If a spill occu�rs at the ECC while the MCU is still in �'�ticipating City's passession, Fort Worth shall �ake cantarai nf the spill �esponse and Participatiug City w'sll rei�nbu�rsB Fort WorEh for its response costs as set forth in Secrion 10, Paragiraph C. 6. USE �F WASTE llI5P05AL/RECYCLII*�G FIRMS FQR HOUSEHOLD HAZARDOUS WAS'I`E A, Fort Worth will enter inia a contract(s) with r�vaste disposal/reeycling �n(s} for th� ha�dlin�, collec�ion, tra�sportation, s�orage, c�sposal, treatxnenx, recov�ry, andlQr reuse of ho�rsehold hazardous waste, w�ich is callected at the ECC. S. DISCUSSION: The City's Environmental Collec�ion Center is now in its sixth year of operation collecting household hazardo�s waste from the citizens of F'ar� W�rth and surrounding communities on a year round basis. In order far non-Fort Vllarth citizens to par�icipate at the Environmental Collecfion Center, each municipality is required to �nt�r info an interlocal agreement with the City of Fort Worth. The rate per househofd for the �sriod covered by fhese agreements (October 1, 2002 fhrough September 30, 20fl3} is $50.00. The decrease in ihe ra#e �s due to receipt of a grant from the North Central Texas Council of Go�ernments that will provide $150,0�0 for disposal costs during FY2002- 2003. [t is anticipated thaf approximately $�420,000 will be collected under these agreements. During FY2001-20�2 twenty-six area communities signed participatior� agreemenfs with the City of Fort Worth.
