EXTENSION AGREEMENT to be attached to and form a part of lease (which together with any amendments, modifications and extensions thereof is hereinafter called the Lease) made the 18th day of JANUARY, 1995 between TRACY L. KOBS, ROBERT W. DOWLING, EMILY HARDESTY , as Landlord, and CITY OF FORT WORTH , as Tenant, covering the premises known as 2509 MERRICK STREET, FORT WORTH, TEXAS. WITNESSETH that the Lease is hereby renewed and extended for a further term of 12 MONTHS to commence on the 1St day of JUNE, 2003, and to end on the 31St day of MAY, 2004, on condition that Landlord and Tenant comply with all the provisions of the covenants and agreements contained in the Lease, except 1. Rent will remain $3,400.00 per month. 2. On or before June 30, 2003, Tenant agrees to pay $1,320.93, being the difference in the taxes between the base year 1995 and 2002. (See attached tax statement.) 3. Tenant may have two 1-year options at the same monthly rate of $3,400.00 (plus increases in taxes above the base year). 4. Tenant may exercise each option by giving written notice to Landlord's agent, Kelly, Geren & Searcy, Inc., a minimum 60 days prior to the expiration of the lease term. 5. DOWLING, AND EMILY HARDESTY FOR A NEIGHBORHOOD POLICING DISTRICT HEADQUARTERS AT 2509 MERRICK STREET FOR THE POLICE DEPARTMENT RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute a lease extension with Tracy L. Kobs, Robert W. Dowling, and Emily Hardesty for office space located at 2509 Merrick Street at a cost of $40,800 per year; and 2. Approve the lease extension term of one year beginning June 1, 2003, and expiring May 31, 2004, with two one-year renewal options. DISCUSSION: The Engineering Department, Real Property Services Division, at the request of the Police Department, has negotiated a lease extension agreement with Tracy L. Kobs, Robert W. Dowling, and Emily Hardesty for office space to be used as a Neighborhood Policing District headquarters. The lease extension term is for one year with two one-year options to renew. There is a rental charge of$3,400 per month for the space. Rental for the remainder of the fiscal year is $13,600. The City has leased this space since April 1, 1995, and is responsible for payment of all utility costs. RENEWAL OPTIONS - This agreement may be renewed for up to two successive one-year terms at the City's option. This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligation during the renewal term. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current operating budget, as appropriated, of the Crime Control and Prevention District Fund.
