HomeMy WebLinkAboutOrdinance 26460-09-2023ORDINANCE NO. 26460-09-2023 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2022 BOND PROGRAM FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE RAMEY AVENUE AT STALCUP ROAD PROJECT (CITY PROJECT NO. 103635) IN THE AMOUNT OF $320,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRAFFIC SIGNALS PROGRAMMABLE PROJECT (CITY PROJECT NO. PB0006) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the 2022 Bond Program Fund, by increasing estimated receipts and appropriations in the Ramey Avenue at Stalcup Road project (City Project No.103635) in the amount of $320,000.00 and decreasing estimated receipts and appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing appropriations in the amount of $360,000.00 for the Mitchell Boulevard at South Beach Street project (City Project No. 103633) and decreasing appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount; 2. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund by increasing appropriations in the amount of $320,000.00 for the Ramey Avenue at Stalcup Road project (City Project No. 103635) and decreasing appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount; 3. Adopt the attached appropriation ordinance adjusting appropriations in the 2014 Bond Program Fund by increasing appropriations in the amount of $465,698.00 for the West Risinger Road at Garden Springs Drive project (City Project No. 103636) and decreasing appropriations in the Fund 34014 Approp Only project (City Project No. U34014) by the same amount; 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements Fund in the amount of $107,531.00, from available funds, for the purpose of funding the West Risinger Road at Garden Springs Drive project (City Project No. 103636); and 5. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The Texas Department of Transportation (TxDOT) approved funding for construction of six Highway Safety Improvement projects in November 2021. The scope of these projects includes design and construction of traffic signals, and intersection improvements including accessible pedestrian signals (APS) and Americans with Disabilities Act (ADA) ramps. In October and November 2022, Mayor and Council Communication (M&C) 22-0844, M&C 22-0997, and M&C 22-0994 authorized the execution of Advance Funding Agreements (AFAs) with the Texas Department of Transportation (TxDOT) for delivery of these projects. The AFAs require Fort Worth to fund cost overruns. The West Risinger Road and Garden Springs Road project was let by TXDOT in June 2023 and the other two projects (Ramey Avenue and Stalcup Road and Mitchell Boulevard at South Beach Street) were let in August 2023. The bids received for these projects were higher than the approved construction amount for these projects. The funding appropriated with this M&C will be used to fund the construction overruns as well as project management fees for the remainder of the project. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Texas Department of Transportation FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Traffic Signals programmable project within the 2022 Bond Program Fund, the Fund 34014 Approp Only project within the 2014 Bond Program Fund and the Unspecified -All Funds project within the Street Improvements Fund upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the 2022 Bond Program Fund for the Mitchell Blvd at S Beach St and the Ramey Ave at Stalcup Rd projects, in the 2014 Bond Program Fund and Street Improvements Fund for the W Risinger Rd at Garden Spring project. Prior to expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds.
