HomeMy WebLinkAboutOrdinance 26465-09-2023 (2)ORDINANCE NO. 26465-09-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED PROJECTS FUND, IN THE AMOUNT OF $329,838.60, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE GUARDRAIL DESIGN & CONSTRUCTION PROJECT (CITY PROJECT NO. 105034); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Projects Fund in the amount of $329,838.60, from available funds, for the purpose of funding Guardrail Design & Construction project (City Project No. 105034). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Projects Fund, in the amount of $329,838.60, from available funds, for the purpose of funding the Guardrail Design & Construction Project (City Project No. 105034); and 2. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The guardrail installation, maintenance, and replacement programs are to be administered by the Transportation and Public Works Department, Transportation Management Division. The programs are to be funded via a Council appropriation of $329,838.60 for design consultants and construction services. Guardrails on the City's roadways are in need of repairs or replacement that have been damaged by crashes. The City has also received numerous requests from stakeholders regarding installing new guardrails and also repairing guardrails in poor condition. This program will prioritize new requests, repairs, or replacement of guardrails on roads by using a needs -based assessment, traffic volumes, and crash rates. The program will be reviewed and its progress and effectiveness reported annually by Transportation Public Works staff. Funding for this project was not included in the FY2023-2027 Capital Improvement Program because the funding source was unknown at the time of CIP development. The action in this Mayor & Council Communication will amend the Fiscal Years 2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022, Section 7. Capital Improvements, as listed on page 24. Funding is budgeted in the Specially Funded Projects for the purpose of funding the Guardrail Design & Constructio project. Guardrails are located in ALL COUNCIL DISTRICTS. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the Specially Funded Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Specially Funded Projects Fund for the Guardrail Design & Constructio project. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility of verifying the availability of funds.
