HomeMy WebLinkAboutContract 57726-A1CSC No. 57726-Al AMENDMENT NO. 1 OF FORT WORTH CITY SECRETARY CONTRACT NO. 57726 BETWEEN THE CITY OF FORT WORTH AND JACOBS ENGINEERING GROUP, INC. This AMENDMENT NO. 1 ("Amendment") to City Secretary Contract (CSC) No. 57726 (Agreement) is made and entered into by and between the CITY OF FORT WORTH ("City"), a home rule municipal corporation organized under the laws of the State of Texas, acting by and through Dana Burghdoff, its duly authorized Assistant City Manager, and Jacobs Engineering Group Inc. ("Engineer"), acting by and through Sindhu Avalokita, its duly authorized Operations Leader. RECITALS WHEREAS, On April 15 and April 22, 2020, a Request for Qualifications (RFQ) was advertised for, among other services, Future Grant Related Projects at Fort Worth Alliance Airport ("Airport"), and on May 8, 2020, Engineer was selected; WHEREAS, On June 24, 2022, City and Engineer entered into City Secretary Contract ("CSC") No. 57726 ("Agreement"), for "Update of the Airport Layout Plan at Fort Worth Alliance Airport" ("Project"); WHEREAS, an additional exhibit illustrating property ownership and parcel lines on and around the Airport has been requested by the City to depict 1) land acquired with FAA funds, 2) land acquired with funds other than FAA funds, 3) land available for FAA grant local match and 4) land used previously for FAA grant local match; WHEREAS, in addition to the exhibit, an Airport Boundary Verification Survey is needed to locate and verify the correctness of the physical boundary monumentation on the Airport Layout Plan; WHEREAS, the cost of the additional exhibit and Airport Boundary Verification Survey ("Additional Services") for the ALP Update will be $98,681.43; and WHEREAS, City and Engineer have both agreed to (i) add the Additional Services to the Scope of Work under the Agreement; (ii) update the compensation section of the Agreement to include the additional $98,681.43 cost required for the Additional Services, bringing the total not to exceed amount to $568,214.02; and (iii) incorporate the additional costs into the compensation schedule under Attachment B of the Agreement through this Amendment. NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, City and Engineer hereby agree as follows: 1. The Agreement is hereby amended by deleting Article II, "Compensation and Term of Agreement," in its entirety and replacing it with the following: OFFICIAL RECORD Amendment No. 1 to CSC No. 57726 between the City of Fort Worth and CITY SECRETARY Jacobs Engineering Group Inc. for the ALP Update at Perot Field Fort Worth Alliance Airport FT. WORTH, TX Pagel of 3 Article II Compensation and Term of Agreement A. The ENGINEER's compensation shall be in an amount not to exceed $568,214.02 as set forth in Attachment B. B. Unless otherwise terminated pursuant to Article VI. D. herein, this Agreement shall be for a term beginning upon the effective date, as described below, and shall continue until the expiration of the funds or completion of the subject matter contemplated herein, whichever occurs first. 2. Attachment A, "Scope of Work" of the Agreement is hereby amended by adding the Additional Services listed in Attachment A of this Amendment. 3. Attachment B, "Compensation" of the Agreement is hereby amended by adding the additional labor hours and cost breakdowns for the Additional Services in Attachment B of this Amendment. 4. For this Amendment only, the parties agree that invoices will only be issued by Engineer upon completion of all work identified within the Scope of Work attached to this Amendment within Attachment A. 5. Except as expressly modified in this Amendment, all other terms and conditions of the Agreement shall remain in full force and effect. 0 The statements set forth in the recitals above are true and correct and form the basis upon which City and Engineer have entered into this Amendment. 7. All other provisions and conditions of the Agreement that are not expressly amended herein or directly in conflict with the provisions and conditions of this Amendment shall remain in full force and effect. WORTH, TX .;acobs Attachment A Scope of Work Airport Layout Plan (ALP) Update - Amendment 1 Perot Field Fort Worth Alliance Airport SCOPE OF SERVICES Preparation of a Grant Exhibit and performance of an Airport Boundary Verification Survey. 1. GRANT EXHIBIT The Engineer will prepare a property ownership exhibit for the purpose of illustrating parcel lines as specified by the City of Fort Worth in preparation of a Grant Exhibit. The Grant Exhibit will depict the following parcel definitions in separate colors: • Acquired with FAA Funds • Acquired with other than FAA Funds • Available for local match • Used previously for local match The Grant Exhibit will utilize parcel numbers and descriptions consistent with those on the ALP Exhibit A that has been submitted for review on July 14, 2023 and is shown in Attachment C. The Grant Exhibit will be utilized for as a visual representation of the City of Fort Worth's grant tracking process. The Grant Exhibit is for illustration purposes only and is not to be used for the conveyance of property. A title commitment was not and will not be provided for this deliverable. All research will be made through online resources only. Parcel lines illustrated on the Grant Exhibit will be derived from online public record search only at the local County Clerk from Denton and Tarrant Counties, TxDOT, City of Fort Worth, and the local County Appraisal District. The Engineer will deliver the Grant Exhibit in PDF and AutoCAD (*.dwg) format. The Grant Exhibit will include the following notation: o THIS DOCUMENT WAS PREPARED UNDER 22 TAC 663.21, DOES NOT REFLECT THE RESULTS OF AN ON THE GROUND SURVEY, AND IS NOT TO BE USED TO CONVEY OR ESTABLISH INTERESTS IN REAL PROPERTY EXCEPT THOSE RIGHTS AND INTERESTS IMPLIED OR ESTABLISHED BY CREATION OR RECONFIGURATION OF THE POLITICAL SUBDIVISION FOR WHICH IT WAS PREPARED. The Engineer will deliver the Grant Exhibit for review 7 weeks, or 49 calendar days, after issuance of Notice to Proceed. The City of Fort Worth will provide review comments and direction on parcel definition to the Engineer. The Engineer will incorporate the comments and direction and submit for final approval 2 weeks, or 14 calendar days, after receipt of comment and direction. AND EXCLUSIONS The following services are excluded from the Grant Exhibit scope and will be performed as an additional service, if required for the project: • The resolution of any deed overlaps or strips and gores. • Only recorded documents / legal descriptions conveyed to the City of Fort Worth will be included as applicable to the airport property. • This is a research and office exercise only. • No form of legal description will be provided. • No form of a boundary survey will be provided, nor can this exercise be used for conveyance. • Jacobs will not make an independent abstract of title or easement estate of the subject properties. • Legal instruments without recording information will not be included. • Survey field work is not included for the purposes of the Grant Exhibit scope. AIRPORT BOUNDARY VERIFICATION SURVEY The Engineer will locate and verify the correctness of the physical boundary monumentation. Further analysis will be based on the Client's current deeds, current -adjoining deeds, and right-of-way maps if applicable. The Airport Boundary is generally depicted and described on the latest version of the ALP Exhibit A that has been submitted for review on July 14, 2023 and is shown in Attachment C. The Engineer will deliver the Airport Boundary Verification Survey in AutoCAD (*.dwg) format. The Airport Boundary Verification Survey will include a resolved boundary line illustrating current recording information for the subject tract, immediate adjoiner tracts, and / or right-of-way if applicable. The Engineer will deliver the Airport Boundary Verification Survey 6 weeks, or 42 calendar days, after issuance of Notice to Proceed. AIRPORT BOUNDARY VERIFICATION SURVEY ASSUMPTIONS. CLARIFICATIONS. AND EXCLUSIONS The following services are excluded from the Airport Boundary Verification Survey scope and will be performed as an additional service, if required for the project: • The Airport Boundary Verification Survey deliverable for this scope of service cannot be used for conveyance or a real estate transaction. • Resolution of boundary conflicts or gaps discovered during Airport Boundary Verification Survey. • Signed and sealed survey files • Jacobs will not make an independent abstract of title or easement estate of the subject properties. • No form of legal description of airport property will be provided. • AFW does not issue Security Identification Display Area (SIDA) Badges. • All field work will be performed during normal working, daytime hours. • Employees that will perform work in the field will be required to complete On-line Training (4 hours) and In - Person Training (2 hours) facilitated through the AFW Operations Manager. In -Person Training will be completed the same day that field work begins and will not require a separate trip. • Field employees will need to be in a vehicle with an amber beacon light and company logos. Field employees will need to wear proper PPE. All work will be coordinated five (5) business days in advance with AFW Operations. • AFW will provide any necessary Right -Of -Entry (ROE) permits/permissions prior to the start of field work.
