SCRAP METAL AREA MODIFICATIONS

WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant)
made and entered into City Secretary Contract No. 56870 (The Contract) which was
admiratively authorized for $39,410.00 for design services and did not include the
reimbursable expenses as noted in Consultant's proposal, the 17th day of December,
2021, for Scrap Metal Area Modifications at the Old Hemphill Drop -Off Station; and
Amendments No. 1 & 2 were administratively executed in the amount of $3,200.00 for
reimbursable expenses & in the amount of $55,801.00 for modifications to the
construction documents respectively; and Amendment No. 3 for the amount of
$9,092.00 was authorized on February 28, 2023 by M&C 23-0165; and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional design & construction administration services;
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design & construction administration services for the Old
Hemphill Drop -Off Station. The cost of this additional services is $45,575.00
including $2,000.00 in additional reimbursable expenses. The scope of services
is described more fully in Elements of Architecture, Inc.'s Letter dated July 21,
2023 subject: Proposal for A/E Services — Hemphill Scrap Metal Yard —
Additional Services 03 — Entry Drive Modifications — Revised.

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "D". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "D". However, the total fee paid by the City shall not
exceed a total of $155,078.00 unless the City and the Consultant mutually agree
upon a fee amount for additional services and amend this Agreement
accordingly."

ATTACHMENT "D"
Dear Alfonso;
Elements is pleased to provide you with this additional services proposal for A/E services
associated with the Scrap Metal Yard for addressing the entry drive area modifications as
defined in the sketch attached as Option A. This direction follows our discussions,
communications. and various site meetings between May 10, May 17, June 07. These
improvements will require an updated survey to the added areas, potential new retaining
wall design along entry drive, guardrails, additional heavy duty entry paving, and
updated Landscape / Irrigation / Urban Forestry improvements. Our services to date have
included discussions of the scope and feasibility, producing preliminary site plan sketches
for discussion and coordination with consultants to reach this option illustrated. It is
important to note that the option selected assumes that Old Hemphill Road is widened
with a turning lane added. We have not included any services or engineering associated
with modifications to this road as we anticipate that this will have to be engineered and
executed through the city directly.
We have defined our additional scope of services as follows:
SCOPE OF SERVICES
Construction Documents Phase
1. Scoping meetings, produce preliminary site plan sketches for review, floodplain
research, preliminary OPCC update, etc.
2. Revise the current Scrap Metal drawings & specifications to reflect the new entry
drive improvements and retaining walls as shown in attached exhibit dated 6-07-
2023
3. This proposal includes attendance at initial COFW Pre Development Conference
(PDC) meeting associated with these improvements.
4. Civil includes additional coordination with the city as defined within their attached
scope.
5. Attend 4 additional design phase meetings with Owner as requested.
6. Submit Substantially Complete documents for Owner's Review.
7. Address Owner Review comments and submit final sealed construction documents.

Exclusions and Qualifications to This Proposal:
1. We have not included MEP Engineering, nor do we believe these are required for
these additional services. If we see that these are needed, we will provide a
proposal for these services.
2. This proposal is based on the remaining design phase efforts being complete within
two months of NTP. If this phase extends beyond these anticipated schedules, we
will provide a proposal for these extended services.
3. This proposal does not include any improvements within the ROW or to Old Hemphill
Road.
4. This proposal does not include Planning Department meetings required for the
Planned Development Process (PD) or its improvements, IRC or CIP exhibits,
meetings, review comment updates or presentations related to the PD process. If a
PD resubmission is required, we will provide a proposal for these services.
PROPOSED FEE
Labor
Proposed Fee as follows for labor only and based on a lump sum fee which would be
invoiced monthly. This amount is in addition to our original proposal.

Expenses
We anticipate an additional $2,000 in expenses associated with this changes.
Preliminary Effort
The labor fee listed above includes effort already incurred in addition to projected effort
for the additional services identified. This incurred effort includes meetings, site visits and
sketches as required to compile and coordinate the scope of work for this proposal. Per
your request, we are providing the fee for this effort already incurred below:
